NY unemployment end date confusion - says May 17th but still have 58 effective days?

Kinda confused about my unemployment situation. My benefit year seems to end on May 17th according to the website, but it's also showing I have 58 effective days remaining. Does this mean my unemployment is completely finished on the 17th and I have to file a whole new claim? Or do the remaining effective days carry over somehow? The website is super unclear and I can't get anyone on the phone to explain it. Any advice appreciated!

Your benefit year ending (BYE) means you need to file a new claim, regardless of how many days you have left. The system resets after a year. But if you reapply and don't have enough wages in your base period, they might put you back on your old claim to use those remaining effective days. I just went through this last month.

Thanks for explaining! Do you know if there's gonna be a gap in payments while they process the new application?

0 coins

There probably will be a gap of 2-3 weeks. Make sure you keep certifying every week even while waiting for the new claim to process!

this is right - I had like 40 days left when my year ended and had to start all over. suuuucks.

After struggling with the same issue and not getting through to anyone for weeks, I tried this service called Claimyr (claimyr.com) and got a callback with an actual human agent in about 45 minutes. Talking to a real person got my benefits issue fixed in one call. It was the best investment I made after spending days trying to reach someone on my own. They have a YouTube video explaining how it works too: https://youtu.be/Rdqa1gKtxuE

sounds like one of those sketchy services that never actually work... did you really get through to someone?

0 coins

Yeah I was super skeptical too but it actually worked. I was about to give up after calling for two weeks straight with no luck. The callback came while I was cooking dinner lol

another day, another miracle solution 🙄 these things always turn out to be a waste of money

Not trying to convince anyone but it worked for me. After getting my issue fixed, the money I spent was nothing compared to the benefits I was missing. Just sharing what helped me 🤷‍♂️

wait I actually used this too! my roommate told me about it. the callback was weird cuz I wasn't expecting it but it saved me like 3 hours of hold music hell

Yeah this is normal. When your benefit year ends you have to file a new claim even if you have days left. The system is designed that way. Those days basically disappear unless you don't qualify for a new claim, in which case they MIGHT let you use the remaining days from your old claim, but dont count on it.

The NY unemployment system is literally designed to be as confusing as possible. Its all part of their plan to make people give up on claiming benefits they deserve. I went thru this exact same thing and wasted 3 weeks trying to figure it out myself.

Facts! 💯 They make it impossible on purpose. Then they can brag about how few people are collecting.

reminds me of when they changed the website during covid and nobody could login for like a month lmao

Here's what you need to know about your situation: When your benefit year ends (BYE date), you MUST file a new claim even if you have effective days remaining. This is a hard rule in the NY unemployment system. What happens to those days depends on a few factors: 1) If you qualify for a new claim with sufficient wages in your new base period, you'll get a new claim with a new weekly benefit amount and those old days are gone 2) If you don't qualify for a new claim, they may let you continue using your remaining effective days from the old claim Make sure you file your new claim right after your BYE date. Don't wait! Continue certifying weekly during this transition period. The most important thing is getting through to a real human if you have any issues. The phone system is awful, but I had success using claimyr.com to get a callback instead of waiting on hold for hours. Totally worth it to finally get my claim sorted. Also check if you can see your Monetary Benefit Determination letter online - that will show exactly what your BYE date is so you know when to refile.

This is the most helpful thing I've seen on this forum in months. Thanks for taking the time to actually explain everything!

Thanks so much for this detailed explanation! I'll definitely check my determination letter and file right after my BYE date.

Can confirm this is correct - I work with a community org that helps people with unemployment issues

I just had this EXACT same problem last week! I filed a new claim online and it went through but then they flagged it for review and I had to wait almost 3 weeks before getting paid again. Keep certifying every week tho.

Did they backpay you for those 3 weeks once your new claim was approved?

Jabari-Jo

yep got it all in one lump sum. just be prepared to wait a bit.

CALL THEM!!! Dont rely on randos on reddit for something this important. I waited 2 months trying to figure this out myself and nearly got evicted.

0 coins

good luck with that lol. i tried calling for 2 weeks straight and never got through 🤡

try claimyr.com - they'll wait on hold for you and call when theres an agent. saved me hours of my life

True calling is hell but its the only way to actually get answers specific to your situation. Better than guessing.

File a new claim right away, but be prepared for your account to go into some pending nightmare for a few weeks. Screenshot EVERYTHING from your current claim before it closes - weekly benefit amount, remaining days, payment history, etc. You'll need this if they mess up your new claim (which they often do).

anyone know if there's a grace period between the BYE date and when you have to file? My date is coming up next week but im going on vacation and won't have good internet.

0 coins

You should file as soon as possible after the BYE date. There's technically no grace period but waiting a few days shouldn't hurt. Just don't wait weeks.

0 coins

ur gonna need to call them. the system makes no sense and the website says different things depending on what page ur on. I had to call like 50 times before I got through last month.

0 coins

Ugh, I was afraid of that. Their phone system is the worst.

0 coins

Try calling right when they open, thats when I finally got through

This happened to me back in February. Had like 35 days left but my BYE date came up. I filed a new claim and got approved in about 10 days, but with a lower weekly amount because I didn't work much last year. Still certifying and getting paid tho.

NOPE those effective days mean NOTHING once your benefit year ends!!!! NOTHING!!!!! its a totally misleading system. makes me so angry how they trick people.

I know right?? Why even show the days if they're just gonna disappear? Makes no sense

0 coins

I bet if u call they'll just tell you to check the website which tells u to call them 😂 the circle of NY unemployment life

0 coins

🤣 too real. The ultimate bureaucratic loop

0 coins

Hahaha this is exactly what I'm afraid of 😅

Does anyone know if they're still doing those phone interviews after filing a new claim? I had to go through that last time and it was a nightmare.

0 coins

yeah they still do them but its random. I refiled in March and didnt get one but my cousin had to do it.
