NY unemployment email says claim can be paid after 2 years - waiting week from 2020 showing
I've been waiting TWO YEARS for my unemployment claim to process (filed back in December 2020). Yesterday I got this email from NYSDOL that has me confused: "Dear New Yorker: Thank you for your patience. We have determined that your unemployment insurance (UI) claim can now be paid. If you have not already, you will soon receive a letter in the mail telling you how much you will receive each week." I immediately logged into my account and noticed there's a "waiting week" listed from 12/2020. Does this email actually mean I'm FINALLY getting paid after all this time? Will they pay the entire backlog from 2020? I'm afraid to get my hopes up after waiting so long. Has anyone else had a claim suddenly approved after years?

Yes! This is good news. The email means your claim has been approved and you should be receiving payment for all eligible weeks. The waiting week is normal - it's the first week of your claim where you're eligible but don't receive payment (NY policy). You should be getting a monetary determination letter showing your weekly benefit amount. After that, back payments should start processing, though they might come in batches rather than all at once. Make sure your payment method (direct deposit or debit card) is up to date in your account.

•Thank you so much! I can't believe this is finally happening. Do you know how long it typically takes for the payments to start appearing after getting this email? I'm wondering if I need to do anything else or just wait for the letter.

•Thanks! Did your brother get all his backpay eventually? I'm worried they might only pay recent weeks and not the whole period.

TWO YEARS??? That's completely ridiculous even for NY unemployment!!! I waited 8 months in 2023 and thought THAT was bad! Did they ever explain WHY it took so long? Were you able to survive financially during this time? I'm genuinely curious how anyone could wait that long without going bankrupt...

•They never gave me a clear explanation - just kept saying my claim was "under review" and "pending determination." I had to move in with family and take whatever odd jobs I could find that wouldn't affect my claim. It's been absolute hell. I called hundreds of times but could never get helpful answers.

•That's truly awful. The system is BROKEN. I hope you get every penny plus interest (though I doubt they'll pay interest). Make sure to check every week they owe you once you get the determination letter. NYSDOL made "errors" on 3 of my backpay weeks that I had to fight to get corrected.

After dealing with a similar situation (though mine was "only" delayed 9 months), I found using Claimyr to reach an agent was the only way to get real answers about my backpay. I couldn't get through for weeks, then used their service and got connected with an agent in under 20 minutes who could actually see all my payment dates and amounts. Worth checking out at claimyr.com - they have a demo video showing how it works: https://youtu.be/Rdqa1gKtxuE In my experience, you'll want to talk to someone directly about your backpay situation since it's been so unusually long. The standard automated system isn't designed for these extreme cases.

•I've never heard of this service before. Does it really work? I've spent countless hours on hold only to get disconnected, so at this point I'm willing to try anything to make sure I get all my backpay.

•Yes, it definitely worked for me. The agent I spoke with was able to see exactly which weeks were approved for payment and when I could expect them. With a case as old as yours, you'll definitely want to confirm all eligible weeks are in their system correctly. The peace of mind from getting actual answers was worth it.

•Yes, I kept certifying every single week without fail, even though no money was coming in. That was one of the few clear instructions they gave me - to keep certifying no matter what.

To clarify a few technical points about your situation: 1. The waiting week showing from 12/2020 is correct - that would be the first week of your original claim period and is unpaid by design. 2. For claims with extensive delays like yours, NYSDOL typically processes backpay in batches of 4-8 weeks at a time, prioritizing oldest weeks first. The full backpay process might take 2-3 weeks to complete. 3. You might see "pending payment" status for several days before money actually arrives in your account. 4. Make sure to check your payment history daily as batches are processed - document everything. 5. The determination letter will show your weekly benefit amount, but might not clearly detail the backpay schedule. For that, you'll need to check your payment history or speak directly with an agent.

•This is incredibly helpful information! Do you know if there's a specific section in my online account where I can see the payment schedule, or will it just start appearing in my payment history?

•It will appear in your payment history as they process each batch. There isn't a pre-published schedule unfortunately. Check the "Payment History" section daily - newly approved payments will show there about 3-5 business days before they hit your bank account/debit card. Each entry will show the specific week being paid and any applicable taxes withheld.

My claim was held up for 14 months before suddenly being approved in January. Started getting payments a week after getting that same email. Just don't be surprised if there's another brief delay while they process everything. I made the mistake of calling every day which did absolutely nothing to speed things up lol

•That's reassuring to hear someone else got through this eventually. I've basically given up on calling at this point because it's been so frustrating. I'll try to be patient for a little longer.

btw my sister works at the bank and says big deposits sometimes get held for fraud review so maybe tell ur bank to expect it so they dont freeze ur account when like $20k suddenly shows up lol

•That's a really good point I hadn't thought about. I'll definitely call my bank to give them a heads up. The last thing I need is another delay because of a fraud hold!

One more tip based on your situation: Since your claim is from 2020, make sure you're prepared for the tax implications. Unemployment benefits from 2020 had different tax rules than current benefits. You might want to consult with a tax professional about how to handle this large amount of backpay that spans multiple tax years. Also, double-check if you need to submit any additional documentation within a certain timeframe once payments begin - sometimes there are verification requirements with these unusual cases.

•I hadn't even considered the tax complications! That's a really important point. I'll definitely look into finding someone who can help me figure out the tax situation. I don't want to make mistakes that could cause problems later.

Please update us when you start getting paid! I'm curious how long it'll take for your backpay to come through after such a long delay. My claim was nowhere near as old as yours.
