NY unemployment benefits stopped after return to part-time work - how to fix?
I started working part-time (20 hrs/week) three weeks ago while continuing to certify for NY unemployment. I've been reporting my earnings exactly as earned each week, but my payment status shows 'pending' for all three weeks with no money deposited. When I check my payment history, I see all three weeks listed with $0.00 benefit amounts! I should still qualify for partial benefits since I'm making way less than my weekly benefit rate. Called the unemployment hotline 12 times today and couldn't get through to anyone. Has anyone dealt with this situation recently? Did I mess something up in my certification process?

This happens a LOT when you start part-time work. The system automatically flags your account for review when you report earnings to make sure everything is calculated correctly. Unfortunately, these reviews can take 3-5 weeks to process. Keep certifying weekly and reporting your exact earnings - eventually they'll release all the back payments you're qualified for. Just make sure you're answering the certification questions correctly, especially the one about being ready and available for full-time work (you should still answer YES to this one).

•Thank you! That makes me feel better knowing it's a common issue. Do you know if there's any way to speed up the review process? I've got rent due next week and was counting on at least getting the partial payment. :

After you start reporting part-time income, your case gets flagged for manual review to verify your reported earnings. The system is supposed to automatically calculate your partial benefits, but it often fails to do this correctly. The issues are: 1. Your employer needs to report your wages to NYSDOL 2. Those reports need to match what you're certifying 3. A claims examiner needs to review the case 4. The system needs to be manually adjusted to release payments You really need to speak with a claims specialist to get this resolved. Keep calling but try this strategy: call exactly at 8:00 AM when they open, and if that doesn't work, try again between 4:30-5:30 PM when call volume drops off.

•Thanks for the detailed explanation. I've been trying to call at different times but still no luck. I'll definitely try right at 8 AM tomorrow. Do you know if there's a specific department or option I should select when calling?

I had a similar issue last month and FINALLY got it fixed. The secret is that you have to keep certifying even though you're not getting paid. After 6 weeks (yes, SIX!!) they suddenly deposited all my back payments at once. The system is completely broken when it comes to part-time work. I wasted SO MUCH time trying to get through on the phone.

•Six weeks is actually pretty quick nowadays. I've seen many cases where partial benefit reviews take 8-10 weeks to process. The NYSDOL is severely understaffed in the claims review department. If you need the money sooner, your best bet is to actually talk to a claims specialist who can manually release the payments once they verify your situation.

After struggling with the exact same problem for weeks, I finally got through to an agent using Claimyr (claimyr.com). They basically call NYSDOL for you and connect you when they reach an agent - saved me hours of redial frustration. You can see how it works here: https://youtu.be/Rdqa1gKtxuE Once I got an actual person on the phone, they explained that when you start part-time work, your case gets flagged for a BPC (Benefit Payment Control) review. The agent was able to verify my reported earnings matched my employer's reports and released my payments immediately. All my pending weeks were paid the next day.

THEY DO THIS ON PURPOSE!!!! The system is DESIGNED to trap people who start working part-time!!! They KNOW most people will give up trying to get their partial benefits because the phone system is impossible! I went through this EXACT thing in January and NEVER got my money because I couldn't afford to sit on hold all day every day for weeks. It's CRIMINAL how they treat people who are TRYING to get back to work!!!!!

•I understand your frustration, but it's more about outdated systems than malicious intent. The partial benefits calculation system was designed decades ago and hasn't been properly updated. When you report earnings, it requires manual verification to prevent fraud, but they don't have enough staff to handle the volume. It's definitely broken, but not intentionally so.

Here's what's actually happening with your claim: When you begin part-time work, NYSDOL's system initiates what's called a "partial benefit recalculation review." This process verifies that: 1. Your reported earnings match employer-reported wages 2. You're still eligible for partial benefits 3. The correct partial benefit amount is calculated The formula for NY partial unemployment is: Weekly Benefit Rate - (Gross Earnings - $183 earnings disregard) = Partial Benefit If your earnings are correctly reported but payments are still pending, request a "benefits recalculation review expedition" when you reach a claims specialist. This specific language will help get your case prioritized.

•Thank you for explaining the calculation! That helps me understand why I should still be getting something. I'll definitely use that specific phrase if I can get someone on the phone. Is there an email address I can try as well?

Update: I FINALLY got through today! Used the 8AM trick and called right when they opened. The agent confirmed everything everyone said here - my case was flagged for review when I reported part-time earnings. She said my employer had reported my wages correctly and everything matched. She processed a manual override and said I should receive all three weeks of partial payments within 2-3 business days. Such a relief! Thanks everyone for your help!

Glad you got through! For anyone else struggling with this issue, remember these key points: 1. Continue certifying every week, even if payments are pending 2. Report your earnings accurately - any discrepancies will cause further delays 3. Answer YES to being ready/available for full-time work (unless you're not) 4. Try calling at strategic times (8:00AM opening or 4:30-5:30PM) 5. If you can't get through after multiple attempts, consider using a service like Claimyr 6. When you do reach someone, ask specifically for a "benefits recalculation review expedition" Hope this helps others avoid the same frustration!

•This is such helpful advice - I wish I'd known all this three weeks ago! I'll definitely keep certifying weekly and make sure I answer all the questions correctly.
