Impossible to reach anyone at ny unemployment for overpayment payment plan

I've been given an overpayment notice of $1450 from benefits they accidentally sent me back in 2021. Been trying to set up a payment plan since I dont have that kind of money just laying around right now. But every single time I call, I put in my SSN and PIN, select the payment plan option, and get the same automated message saying 'all representatives are currently assisting other callers, please try again later' before it just hangs up on me! This has been going on for almost 3 months straight now. I've tried calling at different times - early morning, late afternoon, middle of the day - nothing works. Has anyone actually managed to get through to a real person to set up a payment plan? Is there some secret backdoor number or online method I'm missing? Getting desperate here as they're threatening to start collections soon.

Victoria Jones

welcome to the ny unemployment system 😑 been tryna reach them for WEEKS about a different issue and same exact recording every. single. time. Starting to think they only have like 2 people working the phones for the entire state!!

I know right? And its not like I'm trying to argue with them about the overpayment. I literally just want to PAY them back, just not all at once! You'd think they'd make it easier to give them money 🙄

Word is they're super understaffed since covid. used to be bad before but now its like next level impossible to get through.

the system is BROKEN. they expect us to be instantly available for them but they're completely unreachable for us. make it make sense!

I finally got through to set up a payment plan after trying for weeks! I used this service called Claimyr (claimyr.com) that actually calls for you and holds your place in line, then calls you when they get a real person. Talking to an agent got my payment plan set up in literally 10 minutes - it was the only way I could talk to a live agent. Check out their explainer video: https://youtu.be/Rdqa1gKtxuE

this sounds like those spam ads that pop up everywhere. does this actually work or is it just more unemployment system BS?

Yeah I was super skeptical too, but I was desperate after like 50+ failed calls myself. It actually did work though - got my callback in about 2 hours. I'd tried for almost a month before that with zero luck.

wait hold up - so you pay someone else to call unemployment for you? how does that even work? 🤔

They basically use some tech to keep dialing and navigating the phone tree until they get a human, then they connect you. Talking to the agent got my payment plan set up the same day - best decision I made after wasting so much time trying myself.

Hmm I've been burned by so many of these 'services' before... what makes this different? Anyone else try it?

I used it too a few weeks ago. It's just a way to skip the hold time nightmare. They call and wait in the queue and then call you when there's a real person. Saved me from throwing my phone out the window after days of trying 😂

Not sure if this helps but I got through once by calling at EXACTLY 7:59am right before they opened. Got put on hold instead of getting kicked off, and finally talked to a human after waiting 1hr 20mins. Still sucked but at least I got through.

There's supposed to be a way to set up a plan online but when I tried it the system gave me some obscure error. Classic NY unemployment 🙄 If you figure out a way please update us!

I tried looking everywhere on the website and couldn't find anything about setting up a payment plan. Just the threatening notices about repaying the full amount. If there is an online option, they've hidden it REALLY well.

I think its hidden in the 'messages' section somewhere. But when I tried it just errored out with some unhelpful code. The whole system feels designed to be as frustrating as possible tbh

Have you tried sending a physical letter??? I know it sounds crazy old-school but when I couldn't get anyone on the phone about my overpayment (around $800), I sent a certified letter explaining my situation and proposing a payment plan. They actually called ME back about 2 weeks later! Worth a shot if you're desperate.

Mateo Silva

That's actually a really good idea I hadn't thought of! What address did you send it to? And did you include any specific info in the letter besides your contact info and what you wanted to pay?

I sent it to their main office in Albany. Included my full name, last 4 of SSN, claimant ID, phone #, and a brief explanation of my financial situation and what I could afford monthly. They called me back and we set up $50/month payments.

THIS!!! 💯 Physical mail still works because so few people do it anymore. I had to do this with another state agency (not unemployment) but same concept worked.

Ugh my blood pressure rises just thinking about ny unemployment customer service. I had the EXACT same issue last year. $1700 overpayment and couldn't get through to set up a plan for months. Eventually my state rep's office helped me. Might be worth contacting your local state assembly member - their offices sometimes have direct contacts.

0 coins

-

Mateo Silva

That's actually really helpful! I hadn't thought about going through my state rep. Did you just call their office and explain the situation?

Yep! Just called my local assembly person's office, told them I was a constituent who'd been trying to reach unemployment for months. They took my info and had someone from a special NYSDOL unit call me within a week. They can't help with the actual overpayment decision but they can help get you to the right person.

LISTEN UP EVERYONE dealing with NY unemployment overpayments and phone issues!!! I used to work as a call center supervisor (not for unemployment but similar govt agency) and here's what you need to know: First, understand that the system is DESIGNED to make you give up. It's not broken - it's working exactly as intended. They know a certain percentage of people will just pay whatever they're asking rather than fight the system. Here are your actual options: 1) Keep calling but use strategy - Tuesday and Wednesday tend to be lower volume days. Call at 8:01am or between 11:45-12:15 when shifts are changing. Press DIFFERENT options than the payment plan one - sometimes the fraud department or general questions lines have shorter queues and they can transfer you. 2) Use a service like claimyr.com - these services basically automate the dialing process using tech that can navigate phone trees. They keep calling until they get a human then connect you. This was the only way I got through when I had an issue. 3) Go up the chain - contact your state assembly person or senator's office. They have special liaisons with unemployment who can intervene. 4) Send a certified letter (return receipt) stating your intention to set up a payment plan. Include a proposal for what you can pay monthly. Keep proof you sent this - it can help if they try to send you to collections because you can show you made good faith efforts. 5) If they do start collections, don't panic. You have rights and can still set up a payment plan even then. Remember: document EVERYTHING. Every call attempt, letter, email. Take names and ID numbers if you ever reach anyone. Feel free to DM me if you have specific questions about navigating this hellscape.

Thank you SO MUCH for this detailed advice! I'm going to try the different option numbers tomorrow morning. It's so frustrating that they make it this difficult just to pay them back responsibly.

This is gold 🔥 Especially the part about pressing different menu options. That's how I eventually got through - selected the "new claim" option instead of payments.

Totally cosign the claimyr.com recommendation. Only thing that worked for me after weeks of trying. Saved my sanity.

Yup, can confirm these strategies work. I used to work in a different state's benefits system (Florida) and it was the same concept - confuse and frustrate people into giving up.

have you tried emailing them? sometimes I've gotten responses that way when phone is impossible. not fast, but better than nothing

0 coins

-

Mateo Silva

I tried sending an email about 6 weeks ago but never heard anything back. Did you use a specific email address that actually worked?

i used the general contact form on their website. took like 3 weeks but someone did eventually get back to me. not ideal but might be worth trying again

Anyone else think its INSANE that they can instantly decide you owe them money but make it nearly impossible to actually set up a way to pay it back?? Make it make sense 🤡

THIS!!! And they expect immediate payment but take 6+ months to process anything on their end. The double standard is ridiculous.

fr fr the whole system is designed to be as frustrating as possible. they hit you with that overpayment notice QUICK but try to get help? crickets...

0 coins

-

it's because they want you to just give up and either pay it all or ignore it so they can hit you with late fees. classic govt tactic.

0 coins

-

22d

Mateo Silva

Exactly! And it's not like I'm even trying to avoid paying. I'm literally trying to GIVE THEM MONEY, just in installments. You'd think they'd make that part easy!

Weird question but have you tried the online chat feature? Sometimes that works when the phones are jammed. It's hard to find but should be on the contact page somewhere.

0 coins

-

I tried looking for an online chat but couldn't find one on the NY unemployment site. Maybe I missed it? If anyone has a direct link that would be super helpful!

hmm i used it about 6 months ago but maybe they removed it? it was definitely buried in the site. anyone else know if the chat still exists?

they got rid of the chat feature back in february. too many people were using it i guess 🙄 typical nysdol - remove the one thing that actually worked

I thinck u can set up a payment plan once they send it to collections lol. not ideal but the collection agency is actually easier to reach than unemployment. that's how it works in this backwards system 🤦‍♂️

Don't they have some online portal to submit requests for things like this? Seems crazy they wouldn't have a way to handle simple payment plans without talking to someone.

0 coins

-

Mateo Silva

If they do, I can't find it anywhere on their site. Everything points to 'call this number' which then never connects to a person. It's maddening!

You could try contacting your state representative or assemblymember. My cousin had a similar issue with NY unemployment (different problem, same impossible-to-reach-anyone situation) and his state rep's office helped him get in touch with someone who could actually help.

i had a $1900 overpayment and went through the EXACT same thing. After 2 months of failed calls i got fed up and paid for a service called Claimyr. they got me through to an agent who set up a $100/month payment plan. best decision ever - worth checking out claimyr.com

0 coins

-

Olivia Evans

is that the service that calls for you and waits on hold? how much did it cost? im about ready to try anything at this point

0 coins

-

22d

Daniel Price

Yep that's the one - they call and navigate through all the phone menus, wait on hold, then call you when they get a human. Talking to the agent got everything sorted in one call. Def worth it after wasting so many hours trying to call myself.

yeah right, another 'miracle solution'... what's the catch? 🙄

0 coins

-

22d

Daniel Price

No catch - it's just a service that calls and waits on hold so you don't have to. The unemployment office is still a pain to deal with but at least you can actually talk to someone. After weeks of failed calls it was a no-brainer for me.

check your mail carefully - sometimes they send a form you can fill out and mail back to request a payment plan. might still take forever for them to process it but at least its an option that doesnt involve the phone hell

0 coins

-

Christopher Morgan

worst case scenario: if they do end up sending it to collections, immediately request a payment plan with the collection agency. they're usually much easier to work with than NYSDOL directly (which is sad but true). Just make sure to get everything in writing if it goes that route.

-

Mateo Silva

That's good to know but really hoping it doesn't get to that point. Would rather not have it affect my credit if possible.
