Can't reach NY unemployment for missing backpay - tried 30x daily for a month

I'm at my wit's end with NY unemployment backpay! My claim was deemed eligible with backpay approved about a month ago. Before my claim was finalized, I had ZERO issues getting through to the call center. Then a specialist helped me certify for all my back weeks over the phone and told me to just continue claiming weekly going forward. Fast forward to now - I've been receiving my regular weekly payments for a month, but not a single penny of the backpay they approved. Even worse, it's literally IMPOSSIBLE to reach anyone now. I call at exactly 8:00am when they open, try 30+ times throughout the day, and instantly get the automated message to "call back tomorrow" before being disconnected. It's like they've flagged my number or something? Or maybe they're screening my SSN and sending me straight to the automated rejection? I've also sent 7 separate messages through my online account and nobody has responded to ANY of them. Is this happening to anyone else right now? What else can I possibly do to get my backpay that was already approved? I'm seriously starting to wonder if they're just hoping I'll give up...

Ugh, this is EXACTLY what happened to me in January! I think they're doing this on purpose - let you get approved, pay you weekly going forward, but then make it impossible to actually collect your backpay. I was owed about $8,600 and literally couldn't get through for 6 weeks. The online messaging system is completely useless too... I sent probably 10 messages and never got a single response. It's crazy how they're so easy to reach BEFORE your claim is approved and then suddenly they're impossible to contact. Classic NYSDOL tactic - they know most people will eventually give up on the backpay.

So did you ever get your backpay?? I'm starting to feel crazy, like maybe I misunderstood and they never actually approved backpay, but I KNOW the specialist specifically told me it was approved and would be coming in a separate payment!

i got my backpay but took 3 months... they doing it in batches based on your last name i think. my friend w/ last name starts with A got his in february, mine starts with M and got it in april. just keep certifying and eventually shows up. check ur payment history page not just ur bank account sometime it says its coming b4 it hits ur account

My last name starts with B though, so if they're going alphabetically I should have gotten mine already? The payment history just shows my weekly payments, nothing about backpay being processed or pending. That's what makes me think something is wrong rather than just delayed.

Here's what you need to do - stop calling and sending messages! That's actually putting you at the back of the queue each time. There's a special form called the BR100 specifically for approved backpay that hasn't been released. You can't find it on their website (intentionally). Email backpay@labor.ny.gov with subject line "BR100 Request" and your claim ID number. They must respond within 72 hours with the form. Once you submit it, they legally have 10 business days to release the payment or provide written explanation. I worked at NYSDOL until 2024 and this is the internal process they don't tell claimants about. Good luck!

It's not publicly documented because it's primarily an internal processing form. The BR in BR100 stands for "Benefit Reconciliation." It became internal-only after 2023 when they had issues with people submitting them incorrectly which created more backlogs. But they are still obligated to provide it upon specific request. Not all agents know about it since turnover is high - ask specifically for a "backpay reconciliation supervisor" if you call.

same boat here! been waiting since January for backpay. my cousin works at the dept of labor (not unemployment directly) and she said theres a massive backlog because they switched computer systems in February and lost a bunch of data... theyre slowly rebuilding from backups. she said if you were approved before Feb 11th you might be in the corrupted data. after that date should be fine just regular delays.

The NYSDOL migrated from their legacy IDES system to the new BEACON platform in February 2025, and there were significant data corruption issues during the transfer. They didn't publicly announce the full extent of the problems to avoid panic. UPDATE: I finally got through to someone! I tried the TTY line like someone suggested here and was able to speak with an agent. They confirmed my backpay was approved but sitting in a "pending release" status that required supervisor override. The agent submitted the request and said I should see the payment within 5-7 business days. They also gave me a direct reference number to use if I need to follow up. Great news! Make sure to write down that reference number and the name of the agent if they provided it. If you don't see the payment in 7 business days (which sometimes happens), call the TTY line again and provide the reference number immediately. This will get you to the same department instead of starting over.
