ID.me verification blocked for ny unemployment - someone used my identity in California

I need serious help with id.me verification for my ny unemployment claim. Found out that someone in California has been using my identity to file unemployment claims back in August. I tried to verify through ID.me for my legitimate New York claim last week, but the system kept rejecting me saying there's already an account with my information. Called ID.me support and they confirmed someone in California already verified using my SSN and personal info. I've never even been to California! Now I can't access my benefits in New York and my claim is on hold until I can verify. Called ny unemployment 15 times but can't get through to anyone who can help with identity theft issues. Already filed a police report and froze my credit, but still no idea how to get my benefits flowing. Been out of work since November and my savings are almost gone. Has anyone dealt with cross-state identity theft with unemployment? What can I even do at this point?

StarSailor

The same exact thing happened to me!!! Some a-hole in Nevada used my info and I couldn't get verified in NY. I was freaking out because I had bills due and no income for weeks. What finally worked for me was this service called Claimyr (claimyr.com) - they got me connected with a real human at unemployment who fixed it. Talking to an actual agent was the only thing that worked after weeks of trying. Seriously it was the best money I've spent to get my benefits flowing again. Here's a video about how it works: https://youtu.be/Rdqa1gKtxuE

yeah right, another 'miracle solution'... what's the catch? 🙄

No catch man - it just gets you past the phone hell. I was skeptical too but after 3 weeks of no $$ I was desperate. They just call and wait on hold for you then connect you when a person picks up.

wait hold up - does this actually work or is it just the usual BS? I've been calling for DAYS and can't get through

It worked for me! The agent I talked to was able to see both claims and marked the California one as fraudulent. My NY benefits started processing 2 days later. Before that I couldn't even get anyone on the phone.

So I was about to throw my phone after 4 hours on hold when I saw this. Just tried it and got through to an agent within an hour. Still waiting for my claim to process but at least they acknowledged the identity theft now!

Sorry youre going through this! Identity theft with unemployment is rampant right now. You need to: 1) File an identity theft report with the FTC at identitytheft.gov 2) Contact both NY and California unemployment offices in writing explaining the situation 3) Get an Identity Protection PIN from the IRS so no one can file taxes in your name 4) Keep calling NY unemployment but try early morning (7:55am right before they open) 5) Send a secure message through your NY unemployment portal with all documentation I had something similar happen (but with Florida) and it took about 3 weeks to resolve. Keep all documentation and be persistent! Don't give up!

Thank you for this! I've already done the FTC report and froze my credit, but I'll definitely get that IRS PIN. Did you actually manage to get through to someone on the phone?

Yes but it took calling 20+ times. One trick that worked: when the automated system asks why you're calling, say "payment method" instead of "identity verification" - for some reason you get through faster with payment issues.

NYSDOL is the absolute WORST with identity theft cases. took me 5 months to get my claim straightened out after someone in texas used my info. the best advice I can give is to get through to a SUPERVISOR not just a regular agent. regular agents cant fix cross-state fraud issues.

Have you contacted ID.me directly? They have a specific process for handling identitiy theft cases. Goto help.id.me and submit a support ticket explaining the situation. They made me do a special video verification with extra security questions to prove I was the real me. Then they gave me documentation to send to NY unemployment.

Sofia Morales

I did contact them but they just told me I needed to work with NY unemployment to fix it. Did you have to wait long after submitting the ticket for them to help you?

It took about 4 business days for them to respond to my ticket, then another 2 days for the video verification appointment. Not super fast but it worked!

ID.me is completely overwhelmed right now. I know someone who works there and they said they're getting thousands of identity theft reports weekly. Definitely followup if you don't hear back.

This is why the whole unemployment system is trash 🗑️ They make it impossible to resolve identity issues but then blame claimants when fraud happens. I'd recommend contacting your state representative's office too - sometimes they can escalate unemployment issues. My sister had a similar issue and her assembly member's office got it fixed in a week after she struggled for months.

💯💯💯 THIS!!! My state senator's office fixed my claim when nobody else would help. They have special contacts at unemployment.

Just google "who is my NY state assembly member" and put in your address. Then call their local district office (not the Albany one). Ask to speak to whoever handles unemployment cases.

you might have to go in person to solve this. im serious. after 2 months of trying to fix my identity theft issue, i went to the nysdol career center in manhattan and they finally fixed it. they have special staff there who can handle id.me issues that the phone agents cant. bring all your documents (ss card, birth certificate, id, everything).

This 👆 In-person is the way to go for complicated issues. The office on Varick Street can actually help. Phone agents just read from scripts.

Literally IMPOSSIBLE to get a human on the phone with NY unemployment these days. After 3 weeks of trying I finally used claimyr.com and got a callback in less than 2 hours. The agent was able to put notes on my account about the identity theft and push my claim through. Before that I was just stuck in limbo.

How does that claimyr thing work exactly? Do they just wait on hold for you?

Yara Nassar

Basically yeah. They call unemployment for you and use technology to detect when a human picks up, then they connect the call to your phone. Saved me hours of hold music lol

Does it actually work tho? Like are you getting payments now?

Yep! Got my first payment 4 days after talking to the agent. Before that my claim was stuck for weeks with no movement.

Crossstate identity theft is a NIGHTMARE to fix with unemployment. I spent 6 weeks trying to fix this exact issue (someone used my info in Texas). What finally worked: - I contacted my congressperson's office (not state rep, federal level) - They have a staff member who handles unemployment issues - They sent an official inquiry to NYSDOL - NYSDOL called me back within 48 hours - Had to do a special verification with a supervisor - Finally got approved after they coordinated with Texas Don't waste time with the general phone line - they can't help with interstate fraud. Go straight to your congressperson's office!

This is so helpful! I live in Queens - did you just look up your federal rep online and call their office? Did they require any specific documentation?

Yep just google "who is my us representative" and it'll show based on your address. I emailed AND called. They had me fill out a form authorizing them to inquire about my case, then submit evidence of the identity theft (police report, etc).

The whole ID.me system is broken tbh. When I had this problem I had to basically spam call the ny unemployment fraud department at 888-598-2077. Eventually got someone who could help but it took literally 37 calls. Don't give up!

Your gonna need to submit form FC-36 for identity theft to NY unemployment. It's not on their website but if you call and specifically ask for that form they'll email it to you. Fill it out and send it back with your police report and ID documents. That's what fixed it for me when I had almost the exact same situation.

Wait is this for real? I've never heard of form FC-36 and I've been dealing with NY unemployment for years

Yes its real. It's their internal fraud report form. They don't advertise it but it's what the fraud department uses to document identity theft cases.

I actually got through to a supervisor last week using claimyr.com when I had a similar issue - agent told me they're seeing a huge spike in cross-state identity theft cases. There's apparently a special team that handles these cases now. Ask specifically for your case to be transferred to the "interstate fraud unit" when you get someone on the phone. They helped me get verified through an alternate process since ID.me was blocked.

Can confirm this is true. My cousin works for NYSDOL and says they created this special unit last year because of all the cross-state fraud.

This is a huge problem right now! I just read that NY unemployment has seen a 300% increase in identity theft cases in the last year. Most happening exactly like yours - someone uses your info in another state then you can't claim in NY. It's a mess.

OK heres what u need to do - happened to me & my roomate both. The BIG mistake is trying to create a NEW id.me account. Instead: 1) Go to id.me and click "sign in" 2) Click "forgot password" and use your email 3) They'll send reset link 4) Once in, immediately go to security settings 5) Turn on ALL security features (2-factor) 6) Go to help section, report account compromised 7) They'll walk you through recovery process Basically you need to RECOVER the fraudulent account not make a new one. Then id.me will give you docs to send to NY unemployment showing you're the real person.

OMG THANK YOU!! I just tried this and it worked - I was able to reset the password and get into the account. Now I need to contact ID.me support to help clean it up, but at least I'm in!

Awesome! Just make sure you take screenshots of EVERYTHING in there before you report it compromised. You'll need that evidence for your NY claim.

Unfortunately this is happening EVERYWHERE right now. My advice after going through this nightmare myself: 1. First priority is getting control of your ID.me account following what @profile14 suggested 2. Call NY unemployment ONLY using Claimyr (claimyr.com) - saved me 3+ hours of hold time 3. Request to speak with a supervisor immediately - regular agents CAN'T help with this 4. Have all documentation ready: police report, FTC report, credit freeze confirmations 5. Be extremely persistent! Don't take no for an answer! 6. If supervisor says they can't help, hang up and try again (seriously) 7. Once you get the right person, they can override the ID.me issue It took me 5 calls but I finally got someone who knew exactly what to do. They have a specific procedure for cross-state identity theft cases, but most agents don't know about it. Only supervisors or the fraud department can help. Don't waste time with regular agents. Also - immediately check if tax returns were filed in your name! This is usually the next step in the scam after unemployment fraud. Get an IP PIN from the IRS ASAP.

This is the most useful comment in the thread. I followed these exact steps and got my issue resolved in under a week. The supervisor I spoke with said they're dealing with hundreds of these cases daily.

THANK YOU for the detailed advice! I just booked a callback through claimyr and I'm going to follow your steps exactly. Did you have to submit any special forms or just talk to the supervisor?

Just talking to the supervisor was enough in my case. They have an internal process they can follow once they confirm you're the real person. Make sure to ask them to note your account that you're a victim of cross-state identity theft!
