How to stop NY unemployment claim after getting a new job?
My partner just started receiving unemployment benefits last month after being laid off from his warehouse job. He's been certifying weekly and getting payments for about 3 weeks now. Good news though - he just got hired at a new company and started working this Tuesday! Now I'm wondering what we need to do about his unemployment claim. Do we need to formally close it somehow? Should he call the office? Will it automatically stop if he just doesn't certify anymore? The last thing we want is to accidentally get overpaid and have to deal with paying it back later. Anyone been through this recently with NY unemployment? Any advice would be super helpful!

Congrats on the new job! When your partner certifies for this week, he just needs to answer honestly that he worked and report how many days he worked and how much he earned. If he worked 4+ days or made over $504, he won't get benefits for that week. After that, he can just stop certifying. The claim stays open for a year, so if something happens with the new job, he can start certifying again without a new application. No need to call - just stop certifying!

When he certifies next time, he needs to report the work and earnings. After that he can just stop certifying. The system doesn't require you to formally close a claim - you just stop using it. But make sure he reports that last week correctly so there's no overpayment issues later!

•If he worked full time that week, it's actually better to just not certify at all. If he certifies and reports full time work, the system will show $0 payment but still count as one of his benefit weeks used.

I went through this last fall. Just make sure he answers the certification questions truthfully for the week he started working. Report how many days he worked and approximately what he earned. After that, he can stop certifying and the payments will stop automatically. No need to call them (thank god lol). The claim stays open for a year in case he needs it again.

Okay so here's what you need to do from someone who works with this stuff: First, have your partner certify for the week they started work. They need to report exactly how many days they worked and estimate how much they earned pre-tax. If they worked 4+ days or earned more than $504, they won't receive benefits for that week. After that final certification, they do NOT need to formally close the claim. The claim remains open for the benefit year (52 weeks from when they first applied), but benefits only pay out when someone certifies. If your partner just stops certifying, the payments simply stop. No calls needed, no forms to fill out. The system is actually designed this way intentionally since many people experience multiple periods of unemployment within a benefit year. Important: Make sure they keep their online account login information. If they need to restart benefits later in the benefit year, they'll use the same account. Also, they should save any correspondence from NYSDOL for at least a year in case there are questions later. If they absolutely must speak to a representative (which isn't necessary in this case), the fastest way is through claimyr.com - they'll wait on hold and connect you directly to an unemployment agent. Saved me hours of frustration when I had a more complex issue.

Your partner should definately certify for the week he started working and report his earnings. After that just stop certifying. Keep the claim ID and password in case he needs to restart the claim later.The claim stays open for a year but no payments go out if u dont certify. No need to call, the phone lines are a nightmare anyway.

•That's correct. Claims stay open for the benefit year (usually 52 weeks from when you first applied). They just become inactive when you stop certifying. Makes it easier if you need benefits again during that year.

just to be safe I always send a message through the online system saying "I'm returning to work as of [date] and will no longer be claiming benefits." never had any issues that way.

Omg this is perfect timing - I literally just went through this last month! Just have him certify for the last week he was unemployed, reporting any partial work days. After that, just stop certifying. That's it! The system will show his claim as inactive after a few weeks of not certifying. No need to call (thank goodness because those hold times are BRUTAL). The claim stays open for a year in case he needs it again later.
