How to properly stop NY unemployment claim after getting a new job?
My husband just got approved for NY unemployment benefits last week, but he actually found a job and started working this Monday. We're not sure what the proper procedure is to stop his claim now. Does he need to call NYSDOL to inform them? Will the claim automatically stop if he just doesn't certify anymore? I don't want him to get in trouble for overpayment or anything like that. Any advice from people who've been through this would be really helpful!

Congrats on your husband finding work! He definitely needs to do something - it doesn't just automatically stop. The proper way is to simply stop certifying weekly, but when he does his final certification, he needs to report the earnings for any days he worked that week. The system will adjust his benefits accordingly for partial work. After that, he just stops certifying completely. No need to call unless there are special circumstances.

Thank you! So just to be clear, he should do one more certification for this week, report the days he worked, and then just never certify again? That seems too simple - are you sure that's all he needs to do?

To properly end an unemployment claim in New York after finding work, your husband should: 1. Complete his final weekly certification 2. Report ALL days worked and earnings for that week 3. Simply stop certifying after that He should also save documentation of his first day of work (offer letter, first paystub) in case there are ever questions later. The system does NOT automatically know he's employed until he either reports earnings or stops certifying. If he's already missed reporting some work days in a previous certification, he should contact NYSDOL immediately to correct this before it becomes a bigger issue.

DONT JUST STOP CERTIFYING WITHOUT REPORTING WORK!! I made this mistake in 2024 and ended up with a massive headache. Turns out the Dept of Labor eventually cross-references with employer tax records and I got hit with an overpayment notice plus penalties 8 months later!!! I had to appeal and it was so stressful. They can consider it fraud even if it was an honest mistake, and the penalties are worse than the overpayment itself!!

I was in this exact situation last year. Here's what I learned after talking to an actual DOL agent (which took forever to reach): - Do your final certification and report ALL work and earnings accurately - After that final certification, you just stop certifying - Keep documentation of your start date and first pay - DON'T just ghost the system without reporting the work days I had such a hard time getting clear info on this and spent days trying to reach someone at NYSDOL. If you didn't certify for any weeks after you started working, you're probably fine. The issue comes if you certified for weeks where you worked but didn't report the work. If you're concerned, you can always call NYSDOL to verify your claim is properly closed.

I feel much better knowing the proper procedure now. I'll also have him save his job offer letter and first paystub just in case there are questions later.

One other tip - make sure your husband checks his email and mail for a while even after stopping his claim. Sometimes there are notifications or questions that come up later. The NY unemployment system occasionally does random audits, and if they contact him and he doesn't respond, it can cause issues.
