How to stop unemployment benefit days from continuing - NYS Department of Labor

I started a new job last week but I'm still getting messages about filing my weekly claim and my unemployment days are still running. I don't want to accidentally collect benefits I'm not entitled to. How do I properly stop my NYS Department of Labor claim so the days stop counting? Do I need to call them or can I do it online through my.ny.gov? I'm worried if I don't do this right they'll say I was overpaid later.

You need to stop filing your weekly claims immediately. When you file your next weekly claim (if you haven't already), report your first day of work and your earnings. The system should automatically close your claim. You can also call NYS Department of Labor to inform them directly that you've returned to work. Don't just stop filing without reporting the work - that can cause issues.

Thank you! So I should file one more time and report the work start date? I was afraid to file at all once I started working.

yeah just stop filing the weekly claims, once you miss a few weeks it automatically closes

That's not correct - you should properly report your return to work rather than just stop filing. Missing claims without reporting work can cause problems with your account.

I had the same concern when I went back to work. The safest way is to file your weekly claim and report your start date and any earnings from that week. The NYS Department of Labor system will then close your claim properly. If you try calling them directly, good luck getting through - I tried for days and couldn't reach anyone. Actually, I found this service called Claimyr (claimyr.com) that helped me get through to an agent quickly. They have a video demo at https://youtu.be/qyftW-mnTNI showing how it works. Might be worth checking out if you want to speak to someone directly about closing your claim.

Thanks for the suggestion! I'll try filing with the work info first but if I have issues I might look into that service.

Wait, what if you started a part-time job? Can you still collect some benefits or do you have to stop completely? I'm in a similar situation but only working 20 hours a week.

For part-time work, you can often still collect partial benefits. You report your hours and earnings on your weekly claim and NYS Department of Labor calculates if you're eligible for any benefits that week. Don't stop filing if you're only working part-time.

Just wanted to update - I did exactly what you suggested and reported my work start date on my weekly claim. The system automatically ended my benefit year and sent me a confirmation. No issues at all!

I was in the exact same situation a few months ago! The key is to file your weekly claim one more time and report your first day of work and any earnings from that week. The system will automatically close your claim once you report the work. Don't worry about accidentally collecting benefits you're not entitled to - as long as you report your work honestly when you file, you'll be fine. I was also paranoid about overpayments but everything worked out smoothly when I followed this process.

That's really reassuring to hear from someone who went through the same thing! I was definitely being paranoid about the overpayment issue. It sounds like the system is designed to handle this situation properly when you report honestly. I'll file my weekly claim with my work start date and earnings. Thanks for sharing your experience!
