Moved from NY to NH - how do I properly close my NY unemployment claim?

I just relocated from New York to New Hampshire last month after my hours were cut back significantly at my retail job due to pandemic staffing issues. I had been collecting partial unemployment in NY since August because of the reduced hours, but now I've completely left that job behind. I'm starting a new position here in NH next week and won't need unemployment anymore, but I'm confused about the proper way to end my NY claim. Should I just stop certifying weekly? Or is there some formal process to close out my claim? I don't want to accidentally commit fraud or have problems later if I ever need benefits again. Anyone know the right way to handle this situation?

Just stop certifying. That's all you need to do. They don't have a formal "closing" process for claims - if you don't certify for 2-3 weeks straight, your claim becomes inactive automatically. No need to call or do anything special.

thanks, thats a huge relief! I was worried I'd have to call them and sit on hold for hours just to close it out.

this is correct. I did the same thing when I got my new job in October. Just stopped claiming and that was that.

Yep, it's one of the few easy things about ny unemployment. Just stop certifying and your done 👍

When I had this problem last year I tried calling NY unemployment for DAYS with no answer. Eventually I discovered this service called Claimyr (claimyr.com) and it was amazing. They got me connected to a real agent who confirmed I just needed to stop certifying, and also helped clear up some other issues with my claim. Talking to an agent got my last payment processed super fast too. Check out this explainer video: https://youtu.be/Rdqa1gKtxuE

wait, what even is that? sounds kinda sketchy tbh...

Not sketchy at all! It's literally just a service that waits on hold for you and then calls you when they reach a live agent. Saved me like 4 hours of hold music. It was the only way I ever managed to talk to a real person.

yeah right, another 'miracle solution'... what's the catch? 🙄

No catch! You pay a fee and they wait on hold instead of you. Then when they reach an agent, your phone rings and you're connected. That's it. Total lifesaver when you need to talk to someone and can't waste half your day on hold.

sounds like one of those ads that pops up everywhere. anyone ACTUALLY try this before?

I actually used it last month! My benefits were on hold for verification and I was going INSANE trying to reach someone. Claimyr got me through in about 45 minutes when I had been trying for weeks on my own.

You should probably tell NH that you were collecting from NY also. Different states have different rules about transferring claims. Just to be safe.

Pretty sure you need to notify NY about moving out of state. If not now then definitely when filing taxes. I think there's a specific form you need to get from them about unemployment paid to out-of-state residents.

wait really? Now I'm confused again. Does anyone know for sure?

Nah, this isn't accurate. Your unemployment benefits are based on where you WORKED, not where you live. Moving doesn't change your eligibility for benefits you earned working in NY.

0 coins

That's not what I meant. You still have to pay NY state tax on NY unemployment even if you move. And there are residency requirements for some benefits. But yeah the basic claim doesn't change just cuz you moved.

The NY unemployment system is such trash 🤮 The fact that you even have to ask this question shows how badly they communicate with people. Typical New York bureaucracy.

PREACH 💯 I spent 11 weeks with a pending claim last year and nobody could tell me why

better than florida unemployment tho

Hey fyi when you work in NH make sure you understand how their unemployment works if you ever need it again. They have totally different rules from NY. I moved there from Albany and was shocked at the differences when I needed to file.

good point, thanks! Do you remember what the big differences were?

NH has much lower weekly benefit maximum, different job search requirements, and wayyy faster processing time ironically. Also they don't have state income tax so that's a nice bonus for you!

I've been through the NY unemployment system more times than I care to admit, and I've dealt with interstate claims too. Here's what you need to know: For CLOSING your NY claim: - Simply stop certifying weekly. After 2-3 weeks of not certifying, your claim automatically becomes inactive. - There is NO formal process to "close" a claim - the system just marks it inactive when you stop requesting benefits. - You don't need to call anyone or fill out any special forms just to stop collecting. About your MOVE to NH: - You should update your address in the NY unemployment system (just for their records) - Your eligibility was based on NY employment, so moving doesn't affect your eligibility for the benefits you've already qualified for - Make sure all your contact info is updated in case they need to reach you about your claim later Tax implications: - You'll still get a 1099-G from NY for any unemployment benefits you received this year - You'll need to file a part-year resident NY tax return for the period you lived there If you have any other issues or questions and need to actually SPEAK to someone (which can be nearly impossible), I highly recommend using claimyr.com - it's a service that will wait on hold with NY unemployment for you and then connect you when they reach a live agent. It saved me countless hours of frustration. Best of luck with your new job in NH!

I moved from NY to CT last year and just stopped claiming. Six months later I got a letter asking if I wanted to reopen my claim so I think youre fine just stopping.

Is your new job in NH definitely going to work out? Might be worth keeping the claim active just in case, especially during probation period. You can always just not certify for those weeks but the claim stays open for a year from when you first filed it.

thats a good point. i think i'll be fine but better safe than sorry. i'll just not certify but keep it open just in case something goes wrong in the first few weeks.

Anybody know if this affects the total amount of benefits you can get? Like if the OP moves back to NY in a few months and needs unemployment again, will the previous claim amount still count against the total?

0 coins

Good question! Each benefit year is separate. So if you open a new claim after the current one expires (they last 1 year from filing date), you get a fresh calculation based on your most recent employment.

0 coins

depends on when you go back. claims are good for a year, so if its within that year, yes it counts against your total. if its after, then its a new claim.

0 coins

ok that makes sense, thanks for clarifying!

dont 4get to file ur taxes for both states next year. ny will want their cut of income tax on both your wages AND the unemployment you collected 🙃
