Finally got my NY unemployment backpay after 7 weeks - DOL specialist actually called me!

Just wanted to share some good news in case anyone else is in limbo. After waiting FOREVER (ok 7 weeks) with pending payments and getting zero responses through the message system, a DOL specialist finally called me today! They released all seven weeks that were owed to me and said the money should hit my account within 2-3 business days. Turns out they actually are working on the backlog, despite how it feels sometimes when you're waiting! 🤣 Just wanted to give some hope to those still stuck in pending status. Don't give up! 🙏

congrats!! im on week 5 waiting and getting desperate lol did they say why it was held up for so long?

They said something about my employer responding late to their verification request? I honestly was so relieved I didn't ask too many followup questions. The specialist just said 'system flag' a bunch of times.

This is actually pretty standard. NY DOL has been taking 6-8 weeks to process claims with any kind of issues or employer disputes in 2025. The system automatically flags certain responses during certification, and then a human specialist has to review it. The good news is once they resolve it, the backpay comes in a lump sum. Always make sure your phone number is up to date in your account so they can reach you!

ugh i hatee waiting. do u know if theres a way to tell if ur claim is flagged? my certifications just say pending but no explanation why

Unfortunately, there's no way to see flags in your online account. The only indicator is that your payments stay in 'pending' status for more than 3 business days. At that point, something has triggered a review. You can try calling, but as we all know, getting through is nearly impossible.

Okay so I've been waiting for FIVE MONTHS!!! Why did you get a call after just 7 weeks? I've called 27 times (yes I counted) and nobody ever picks up. I'm about to be evicted and I can't even get someone to tell me why my claim is stuck!!! This system is BROKEN!!!!

That's horrible! I have no idea why they called me and not you. Maybe it depends on what type of issue flagged your account? Five months is definitely not normal though - you should be escalating this somehow.

I was in the exact same situation last month! 8 weeks of pending payments and no way to reach anyone. I finally used this service called Claimyr (claimyr.com) that got me through to an actual human at NY unemployment in about 20 minutes instead of waiting on hold forever. They have a video showing how it works here: https://youtu.be/Rdqa1gKtxuE. The agent I spoke with released all my payments on the spot. Sometimes you just need to actually talk to someone to get things moving.

Does this actually work?? I'm desperate enough to try anything at this point. Did they ask for a lot of personal info?

It worked for me! They don't need any of your unemployment info - they just connect you to the regular DOL phone line but somehow get you past the busy signals. Once you're talking to an actual DOL agent, it's just like a regular call where you verify your identity with the agent. Totally worth it after months of frustration.

Just to add some actual information here - if your claim is pending for more than 4 weeks, you should request an official determination through your online account messaging center. Specifically say you are "requesting a determination on my pending claim under Section 590.11 of the NY Labor Law" which requires them to issue a decision. This won't guarantee approval, but it forces them to review your case and either pay you or formally deny you (which you can then appeal).

Wow, I wish I had known this before! Is this something new? I never saw this mentioned anywhere on the DOL site.

It's not new, but they certainly don't advertise it. The statute has been in place for years, requiring the DOL to make prompt determinations. In my experience working with claimants, citing the specific law often gets attention because it signals you know your rights. But I should note that even with this request, it can still take 2-3 weeks for them to respond.

7 weeks is nothing lol. My brother in law waited 13 weeks last year and then got all his money at once. Its actually kind of nice getting a big payment instead of weekly ones. Forced savings haha

Easy to laugh when it's not YOUR rent that's due! Some of us don't have the luxury of waiting months for "forced savings" 🙄

Did anyone else have the problem where a specialist called but then nothing happened afterward? I got a call two weeks ago, the woman said she fixed everything and I'd get paid in 3 days. Still nothing showing up in my payment history! I've been trying to call back but just get the stupid automated system every time. I'm worried she didn't actually do whatever she was supposed to do in the system.

That happened to my cousin! Turns out the specialist resolved the claim issue but didn't remove some payment block. She ended up having to call back. Have you checked if your payment method is still correct in your account? Sometimes they reset to debit card even if you had direct deposit.

OMG you might be right! I just checked and somehow my direct deposit info is completely gone from my account. I never changed this! I'm going to update it right now. Thank you!!!

For anyone reading this thread later: if you're waiting on pending payments, here's what the current process looks like in 2025: 1. Regular claims without issues typically process in 3-5 business days 2. Claims with minor verification issues: 3-6 weeks for specialist review 3. Claims with employer disputes: 6-10 weeks for adjudication 4. Claims with identity verification issues: 4-8 weeks for resolution The NY DOL prioritizes based on filing date and issue type, not by how many times you call (though getting through to someone can sometimes help identify the specific problem).

This is super helpful info! Where did you find these timeframes? I looked all over the DOL website and never saw anything this specific.

These aren't officially published timeframes - I've just been helping people with unemployment issues since 2020 and have tracked hundreds of cases. The DOL won't commit to specific timeframes because they vary based on current claim volume and staffing. But these ranges have been consistent through the first half of 2025 based on the cases I've assisted with.

did they give u a direct number to call them back if theres any problems with ur payment? im thinking of leaving a note on my door so i dont miss their call lol

0 coins

No, and that was the frustrating part! They called from a blocked number and didn't leave any direct way to reach them again. Definitely keep your phone with you at all times - I almost missed the call because I was in the shower!

MY ACCOUNT SAYS THE EXACT SAME THING! Pending for no reason since January and my landlord is threatening eviction. I can't even get through the phone system to talk to a real person. I've sent 12 messages through the online portal and gotten zero responses. Did they tell you why yours was held up for so long? Was there something specific you did that finally got them to call you?

0 coins

They didn't really explain much other than saying there was a "verification issue" with my employer. I didn't do anything special - the call was completely unexpected. I had given up hope of ever getting through to anyone. Hang in there!
