< Back to New York Unemployment

Applied for NY unemployment in August but stuck in limbo for 5 months - worked at same job for 7 years!

I was laid off from my manufacturing job back in August after working there for 7 years. Applied for unemployment benefits right away but got denied because they claimed I didn't make enough in my base period. That made no sense since I'd been at the same place for so long with steady income. I sent in all the wage documentation they requested to prove my income history. Now my claim status just says 'under review to determine benefit amount' and has been saying that for almost 5 months! I've been out of work since August and savings are running dry. Called the ny unemployment office like 25 times but can never get through to a human. Anyone know how to actually get this resolved or at least talk to someone who can explain what's happening?

Emma Davis

Same exact thing happened to me! Lost my job in November, they claimed I didn't have enough wages despite 5 years at my company. I think their system is messed up or something. Been waiting for 3 months in this 'review' status with no end in sight ๐Ÿ˜

I was in this exact situation last year but finally fixed it! After trying to call for weeks (impossible!!), I tried this service called Claimyr (claimyr.com) - they kept calling for me and when they finally got through, they connected me to a live agent who fixed everything on the spot. Talking to an agent got my $ released in 2 days after months of nothing. Best money I've spent in a long time, check out how it works: https://youtu.be/Rdqa1gKtxuE

Is this for real? I've been hitting redial for days and my finger is about to fall off lol

100% real. I was desperate after 2 months with no income. They keep calling until they get thru then transfer to you once there's a person. Got my backpay sorted in one call.

I tried this too! It actually works, I was shocked. Got my claim fixed after being stuck for 7 weeks.

Seriously just try it. I was a total skeptic too but my bills weren't getting paid while I waited on hold for eternity. The unemployment agent told me they're insanely understaffed.

The 'not enough wages' thing is such bull. I had this same issue and it turns out they were looking at the wrong quarter for my base period. When they finally reviewed my case properly, I qualified for the maximum benefit. Keep pushing!

How did you eventually get them to look at it properly? I've sent in so many documents already.

I had to talk to an actual agent who could see my file. Calling randomly never worked, but I ended up using claimyr.com after someone here recommended it. Got through in a day.

this is why im convinced the whole system is designed to be broken on purpose ๐Ÿคก they make it impossible to actually get ur benefits hoping people will just give up. happened to my brother too - took 4 months to get his first payment

CosmicCadet

Absolutely. They save millions by denying first and asking questions never. The whole "under review" status is just code for "we're ignoring you"

Conspiracy theory much? ๐Ÿ™„ It's not malicious, just incompetent. Their computer systems are from like 1995.

explain to me why a system 'accidentally' denies people who worked 5+ yrs at same job then? wake up sheeple

Hey OP, I had almost identical situation. Here's what you need to do to get this fixed: First, gather ALL your employment docs - not just the ones they asked for. Get your W-2s from all 4 quarters prior to your application, any pay stubs, and employment verification letter if possible. Second, you need to speak with a Tier 2 specialist - regular agents can't help with wage recalculations. Regular agents will just tell you to wait. Third, you MUST get through by phone. Online messages will be ignored for weeks. After trying for 3 weeks, I used claimyr.com which got me through to an agent who transferred me to a specialist. Finally, be extremely clear that you believe there's been an error in your wage calculation. Ask them to review each quarter separately. Once my specialist did this, they found they'd missed an entire quarter of wages. My case was resolved within 72 hours after the call, and I got backpay for the entire 5 months I'd been waiting. Don't give up - this is YOUR money that you're entitled to receive!

Thank you so much for this detailed answer! I have all my W-2s and paystubs already collected. Will definitely try to get to a specialist.

This is solid advice. The tier level of the agent makes ALL the difference. Regular agents literally cannot access the wage recalculation system.

fwiw I had the EXACT same problem in September. Filed an appeal and still waiting to hear back. ny unemployment is the worst ๐Ÿ˜ซ

Just a heads up - make sure you're still certifying every week even while you wait! If they eventually approve you, you'll only get paid for weeks you certified for.

Javier Morales

Oh crap I didn't know this! I stopped certifying after the first month because I thought it was pointless while denied. Can I go back and certify for previous weeks?

You might be able to if you call and explain. They can sometimes let you backdate certifications if you have a good reason. Definitely worth asking about when you get someone on the phone!

Have u tried contacting ur state representative? My case was stuck for 2.5 months and my rep's office got it fixed in less than a week. They have special contacts at the unemployment office.

THIS!!!! I did this too and it worked. Find your assembly person and email their office explaining your situation. They helped me when nobody else would.

I tried this and got a form email saying they're experiencing high volume of requests. Guess my rep sucks ๐Ÿ˜‘

ok this is probably dumb but did u check if they have the right employer on file? my friend had this issue and it turned out they had him working for some random company he'd never heard of

-

Javier Morales

I didn't even think of that! I'll definitely check when I can finally talk to someone. Thanks for the tip!

Check if your wages were reported under a different company name. My employer had a parent company that was different from where I actually worked, and that caused similar issues. Took forever to sort out.

New York's system is such a joke. I swear they intentionally deny everyone first time around hoping people give up. Keep calling and document EVERYTHING. Dates, times, who you talked to.

sad but true. my claim was denied THREE times before someone actually reviewed my documents properly.

The system isn't denying people because it wants to. It's denying people because it's ancient technology that can't handle modern employment situations.

Protip: call exactly at 7:59am when they open at 8. Thats how i finally got thru after 3 months of trying

Lmaooo welcome to NY unemployment!! Where nothing makes sense and the rules are made up! ๐Ÿคฎ I've been waiting 6 months and they keep saying 'just 2 more weeks'

their definition of 'not enough wages' is weird af. they look at specific quarters before you applied, not your actual work history. if your wages weren't distributed exactly how their formula wants, they deny you even if you made plenty of money.

-

QuantumQuasar

Thisโฌ†๏ธ They only look at the first 4 of the last 5 completed quarters before you applied. So if you had low wages in those specific quarters but good wages in others, you can get screwed.

Wait seriously? That's so messed up. My hours got cut before I was laid off so maybe that's what happened.

make SURE you download and save every single piece of correspondence they send you. my husband's claim suddenly said he needed to submit docs he'd already sent 3 times. thankfully we had confirmations of everything.
