I had a nightmare trying to reach NYS Department of Labor when my employer contested my claim after being fired. Spent weeks calling and never got through. THE SYSTEM IS RIGGED AGAINST WORKERS! I got fired for 'performance' which was really just my supervisor not liking me and NYS Department of Labor STILL made me jump through hoops for 6 weeks. They'll side with employers every time unless you have a lawyer. Don't get your hopes up that this will be easy even if you did nothing wrong!!!
ugh the whole system is so confusing. why can't they just make it simple to reopen a claim instead of making you start over from scratch every time
Just remember that unemployment is temporary income. Make sure you're not overextending yourself financially. That said, if you need the car for work search activities and can afford the payments, there's nothing wrong with purchasing it. NYS Department of Labor doesn't have restrictions on how you use your benefit payments.
THE WHOLE SYSTEM IS A JOKE! I've been waiting 6 WEEKS for my adjudication and they keep saying 'we're reviewing your case.' Meanwhile I'm about to lose my apartment. NYS Department of Labor acts like they're doing us a favor when WE PAID INTO THIS SYSTEM through our paychecks!
Just to add - make sure you're filing your weekly claims every Sunday even if your initial claim is still pending. Missing weekly certifications can delay your benefits even after approval. Also keep detailed records of any job search activities since you'll need to meet those requirements once approved.

tell him to file no matter what!! the worst they can say is no but if he doesn't file he gets nothing for sure. I got fired for being late too much and still got benefits because they couldn't prove it was willful misconduct

This whole system is so confusing. I thought if you get fired you automatically can't get unemployment. Good to know that's not always true. The NYS Department of Labor really needs to make this stuff clearer for people.

•It's definitely confusing but the basic rule is that you can get benefits unless you were fired for misconduct. Things like poor performance, attendance issues without warnings, or company downsizing usually don't count as misconduct. Only things like theft, violence, or repeatedly ignoring direct orders typically disqualify you.
