Can someone collect unemployment if they are fired - NYS Department of Labor eligibility question
My brother just got fired from his job last week and he's asking me if he can still file for unemployment benefits. I told him I wasn't sure because I thought you had to be laid off to get benefits. Does anyone know if you can collect unemployment if they are fired from NYS Department of Labor? He worked there for like 2 years and they said it was for attendance issues but he claims he was never given any warnings. I'm trying to help him figure out what to do next.

tell him to file no matter what!! the worst they can say is no but if he doesn't file he gets nothing for sure. I got fired for being late too much and still got benefits because they couldn't prove it was willful misconduct
