wait so if you get fired for being late too many times does that count as misconduct?? asking for a friend obviously lol
tell him to file no matter what!! the worst they can say is no but if he doesn't file he gets nothing for sure. I got fired for being late too much and still got benefits because they couldn't prove it was willful misconduct
This whole system is so confusing. I thought if you get fired you automatically can't get unemployment. Good to know that's not always true. The NYS Department of Labor really needs to make this stuff clearer for people.
It's definitely confusing but the basic rule is that you can get benefits unless you were fired for misconduct. Things like poor performance, attendance issues without warnings, or company downsizing usually don't count as misconduct. Only things like theft, violence, or repeatedly ignoring direct orders typically disqualify you.
THE WHOLE SYSTEM IS RIGGED AGAINST YOUNG PEOPLE! They make it harder for kids to get jobs then make them jump through hoops for benefits. My daughter went through this same BS last year and it took MONTHS to get her first payment. NYS Department of Labor doesn't care about helping young workers at all.
Similar situation here - my 20 year old had issues too but it turned out to be because he didn't report some cash wages from a summer job correctly. Once we figured that out and submitted the right paperwork, his weekly claims started going through normally. Check if there are any wage discrepancies showing up in his account.
this happened to my cousin last year, they fired her for being 'difficult' but she got unemployment no problem. just document everything they're doing to you now in case you need it later
The unemployment system is so confusing! I never know what counts as misconduct vs just getting fired. Seems like unless you like punch someone or steal money you should be okay?

Just remember that unemployment is temporary income. Make sure you're not overextending yourself financially. That said, if you need the car for work search activities and can afford the payments, there's nothing wrong with purchasing it. NYS Department of Labor doesn't have restrictions on how you use your benefit payments.

Wait, can they really not see your bank account? I thought the government could see everything...

•They don't routinely monitor bank accounts. That would only happen if there was suspected fraud and they got legal authorization for an investigation. For regular unemployment claims, they rely on your weekly certifications and employer reports.
