definitely get everything in writing from your doctor about what you can and cant do workwise. learned that the hard way when i had my back injury
I went through something similar about 8 months ago. The key thing to understand is that NYS Department of Labor looks at whether you're "able and available" for work, not just your employment status. In my case, I was on workers' comp for a shoulder injury but my doctor cleared me for sedentary work. Even though my regular job was warehouse work that I couldn't do, I was able to get unemployment because I could demonstrate I was available for office-type positions. You'll need to file for unemployment and be honest about your limitations - they may approve you for partial benefits if you can work in some capacity. The workers' comp and unemployment serve different purposes, so you might be eligible for both depending on your medical restrictions. Document everything and be prepared to explain your situation clearly to the DOL representative.
UPDATE: I finally got through to someone at DOL! Used the Claimyr service that was suggested here and it actually connected me to an agent within about 45 minutes. The agent told me my investigation was actually complete last week but there was a system flag preventing payment release. They cleared it manually and I should receive all 7 weeks of backpay within 3 business days! Thank you everyone for your help and suggestions during this stressful time.
That's amazing news Connor! So glad you finally got through and got it resolved. This is exactly what I suspected might be happening - the investigation was done but stuck in their system. Your story gives me hope for others dealing with this nightmare. 7 weeks of backpay is going to be a huge relief! Thanks for updating us all, and definitely keep this thread in mind if anyone else runs into similar issues with NY DOL investigations.
I got fed up with the phone system and used claimyr.com - had my issue resolved the same day after weeks of trying. Just sharing what worked for me - talking to an agent got my $ unlocked so fast. Their youtube explains how it works: https://youtu.be/Rdqa1gKtxuE
I went through something similar last year - had to quit due to a medical condition and waited months with $0.00 showing. The key is getting proper medical documentation that clearly states your vaccine reaction made it impossible to continue working at that job. You'll also need to show you tried to work with your employer first (like requesting accommodations or medical leave). Once I finally got through to an agent with all my paperwork ready, they were able to approve my claim and I got all the back pay. The $0.00 definitely just means it's pending review, not denied. Don't give up - medical reasons CAN qualify for unemployment in NY, but you need to advocate for yourself and get that documentation submitted properly.
UPDATE: My payment just hit my account about an hour ago (Thursday morning)! Just one day late. Hopefully yours arrives today too!
I'm going through something similar right now actually! Filed Sunday and still waiting on my payment (it's Thursday afternoon for me). This thread has been really helpful - I was starting to panic thinking something was wrong with my claim. Good to see yours came through Luca, gives me hope mine will hit tomorrow. The NY system really needs to do a better job communicating when there are delays instead of leaving everyone in the dark wondering what's going on.

honestly the whole phone interview thing is just them going through the motions most of the time... they probably already decided before they even called you based on what your employer said. just my experience but dont get your hopes up too much

I just went through this exact same process last month! After my phone interview, it took about 12 days to get the determination letter. The key thing is to keep checking your online account - mine updated to show "determination issued" about 2 days before I actually received the letter in the mail. Also, make sure you're still filing your weekly claims like others mentioned. The waiting is brutal but try to stay patient. In my case, they did approve me and I got all my back pay within 3 business days of the approval. The adjudicator told me they really just want to make sure your story matches what your employer reported, so as long as you were honest about your situation, you should be okay.
