The whole NYS Department of Labor appeal system is a joke honestly. They deny people for ridiculous reasons then make you jump through hoops to prove you deserve benefits you already earned. But yeah you gotta play their game if you want your money. Good luck with your hearing.
just went through this myself actually. got terminated in december and filed right away. took about 3 weeks for them to approve my claim but i did get it. employer tried to say it was misconduct but i had documentation showing it was really about budget cuts. definitely fight it if they deny you
My cousin got fired and they told him he couldn't get unemployment but I think he was wrong about that. Sounds like maybe he just didn't fight it or something?
honestly the whole system is messed up, they expect you to take any garbage job just to get off unemployment even if it destroys your career prospects
The whole system is ridiculous honestly. They make it so complicated for students when we're the ones who need help the most. I went through this mess last year and it took forever to get approved even though I was clearly available for work around my class schedule. Just be prepared for a lot of paperwork and questions.
You should definitely apply! I'm a part-time student and got approved for partial benefits when my restaurant job cut my shifts. The important thing is being honest about your availability and actively job searching. Keep records of your job applications because they might ask for your job search log.
