My unemployment ran out can I file a new claim - NYS Department of Labor options?
So my regular unemployment benefits exhausted last month after 26 weeks and I'm still looking for work. I've been applying everywhere but the job market is tough in my field (retail management). Can I file a brand new claim with NYS Department of Labor or am I just out of luck? I had a part-time job for about 3 months earlier this year before I got laid off again, not sure if that matters. Really stressed about bills and rent coming up.

You might be able to file a new claim if you earned enough wages since your original claim started. NYS Department of Labor looks at whether you have sufficient earnings in your new base period. Since you mentioned working part-time for 3 months, you'll need to check if those wages meet the minimum requirements. You can start a new application on the my.ny.gov website and it will tell you if you're eligible.

yeah i think you can file again but not sure about the wage thing. i tried calling nys department of labor to ask about this same situation but couldn't get through to anyone

The minimum for a new UI claim in NY is generally around $2,600 in total wages during your highest earning quarter in the base period. Your part-time work might qualify you, but NYS Department of Labor will calculate this automatically when you apply. Make sure you have all your employment information ready including dates and employer details.

UGH the whole system is so confusing!!! I've been trying to figure out the same thing and NYS Department of Labor website doesn't explain it clearly. Why can't they just tell you straight up if you can file again or not???

I had this exact problem last year and couldn't get through to NYS Department of Labor on the phone for weeks.
