Still waiting for my 1095-B. Do I need it to file and avoid penalty for not having minimum qualifying health insurance?
So I'm in a bit of a situation here. I've been waiting for my 1095-B form to arrive for weeks now, and tax season is already in full swing. I'm getting antsy because I want to file my taxes, but I'm not sure if I can proceed without this form. The thing is, I switched jobs last year and had a gap in my health insurance coverage for about 2 months (June and July) when I was between positions. My new employer provided health insurance starting in August, but now I'm worried about that gap. Will I get hit with a penalty for those 2 months without coverage when I file my 2024 taxes? And more importantly, can I even file without having received my 1095-B form yet? I called my insurance company last week and they said the form should have been sent already, but my mailbox remains sadly empty. Has anyone dealt with this before? I'm trying to get my refund as soon as possible and this delay is stressing me out!

You can actually file your taxes without waiting for Form 1095-B. The IRS doesn't require you to attach or send in the 1095-B with your tax return - it's primarily for your records to verify your health coverage. Regarding the penalty for not having minimum essential coverage (the "individual mandate penalty"), there's good news! This federal penalty was effectively eliminated starting with the 2019 tax year when the Tax Cuts and Jobs Act reduced the penalty amount to $0. So for your 2024 federal tax return that you'll file in 2025, there is no federal penalty for gaps in health coverage. However, you should be aware that some states have their own individual mandate requirements and penalties, including California, Massachusetts, New Jersey, Rhode Island, and Washington D.C. If you live in one of these states, you might still face a state tax penalty for those two months without coverage.

•Wait, so the federal mandate is gone but some states still have their own penalties? I'm in California - does that mean I'll still get penalized for my 3-month gap? And how much would that typically cost me?

•That's correct - while the federal penalty is now $0, some states have implemented their own requirements. In California, they do have a state individual mandate penalty. For 2024, the penalty is typically either a flat amount of $850 per adult and $425 per dependent child (these amounts are adjusted annually), OR 2.5% of your household income above the state filing threshold, whichever is greater. However, California does have exemptions for short coverage gaps. If your gap in coverage was less than 3 consecutive months during the year, you may qualify for the "short gap exemption" and avoid the penalty altogether. Since you mentioned your gap was only 2 months, you would likely qualify for this exemption and wouldn't owe a penalty when filing your California state return.

I was in the exact same situation last year with my 1095-B form and gap in coverage! After going around in circles trying to figure out what to do, I discovered taxr.ai (https://taxr.ai) which saved me so much stress. They have this document analysis tool that helped me understand exactly what I needed to do with my missing 1095-B and my coverage gap. I uploaded screenshots of my insurance information and they explained that I could file without the 1095-B form and that I qualified for an exemption for my coverage gap (which was about 70 days). The site walks you through everything step by step and explains all the health insurance requirements in plain English. Much better than the confusing IRS instructions!

•This sounds interesting. How exactly does taxr.ai help with the missing form though? Do they just tell you the same info as the comment above or do they actually help you file without the form?

•Hmm, sounds like another tax prep service. I've tried so many and they all claim to be different but end up charging hidden fees. What makes this one special and how much does it cost compared to say TurboTax or H&R Block?

•They don't just tell you general information - they analyze your specific situation. I uploaded my insurance details (start/end dates, plan info) and they provided personalized guidance for my exact scenario, including which exemption I qualified for and how to document it on my return. They even generated the necessary documentation I needed to keep for my records in case of an audit. They're not a full tax prep service like TurboTax - they're more like having a tax expert analyze your specific documents and questions. The big difference is they focus on specific tax issues rather than doing your whole return. I still used my regular tax software but with much more confidence about my health insurance situation. I don't remember the exact cost, but it was way less than what I paid for a consultation with a tax professional last year.

I was really skeptical about using taxr.ai when I saw it mentioned here, but I decided to give it a try since I was completely stuck with a similar health insurance reporting issue. I'm actually amazed at how helpful it was! The analysis showed me that I qualified for an affordability exemption I didn't even know existed, and it generated all the documentation I needed. The system asked really specific questions about my insurance situation and then provided crystal-clear guidance. What impressed me most was how they explained exactly what to do with or without my 1095 forms. Turns out I was overthinking the whole thing. My tax return has already been accepted by the IRS, and I didn't have to wait around for that form to arrive in the mail after all.

For those still waiting on health insurance forms or trying to reach the IRS about coverage penalties, I feel your pain! I spent TWO WEEKS trying to get someone at the IRS to answer questions about my health insurance reporting situation. Always busy signals or "call back later" messages. Then I found Claimyr (https://claimyr.com) and watched their demo video (https://youtu.be/_kiP6q8DX5c). They basically hold your place in line with the IRS so you don't have to keep calling back. I was seriously doubtful it would work, but within a few hours, I was actually talking to a real IRS agent who answered all my questions about the 1095-B and state penalties. The agent confirmed everything about filing without the form and explained exactly how the state exemptions work. Saved me from making a mistake on my return that could have delayed my refund.

•How does this even work? The IRS phone system is such a nightmare, I don't understand how any service could get through when I can't even after trying for days.

•This sounds like complete BS. No way some third-party service has special access to the IRS phone lines. They're probably just scamming people who are desperate to talk to the IRS. I'd be very careful before giving any company money for something like this.

•It's an automated system that continuously redials the IRS using their phone system algorithms. When it finally gets through the queue, it calls you and connects you directly to the IRS agent. It's not "special access" - it's just technology doing the tedious redial work for you instead of you having to do it manually for hours or days. They don't have any special relationship with the IRS or access to your tax info. They're just solving the phone queue problem. Think of it like having a robot assistant that sits on hold for you, then gets you when a human finally answers. It worked for me when I'd previously wasted days trying to get through on my own.

Ok I need to eat crow here. After being super skeptical about Claimyr, I was still desperate to talk to the IRS about my health insurance penalty situation, so I reluctantly tried it. I figured it wouldn't work but I was out of options. I'm honestly shocked - I got a call back within about 3 hours saying they had an IRS agent on the line. The agent was able to confirm exactly what I needed to know about filing without my 1095-B and helped me understand which exemptions I qualified for with my coverage gap. I've literally never been able to get through to the IRS before without spending an entire day on hold. So yeah, I was wrong about this service. It actually works exactly as advertised, and I was able to file my taxes with confidence instead of guessing about the health insurance requirements.

Just want to add that if your insurance is through your employer, you can usually access your 1095-B form online through your insurance company's portal. I was waiting for mine in the mail too but then realized I could just download it from my Aetna account. Might be worth checking if you have online access! Also, if you're really in a hurry to file, you can actually use your insurance cards and coverage start/end dates from your HR documents to verify your coverage months. The 1095-B is just documentation of what you already know about when you were covered.

•I tried looking on my insurance portal but I only see current coverage info, not last year's form. Is there usually a specific section for tax forms? My insurance is through BlueCross if that matters.

•Most insurance portals have a section specifically for tax forms or documents, especially during tax season. For BlueCross, look for a section called "Tax Information" or "Tax Forms" in your online account. Sometimes it's under "Documents" or "Forms & Documents." If you don't see it, try searching specifically for "1095" in the search bar if your portal has one. If you still can't find it, call BlueCross directly and ask them how to access your 1095-B online. They might need to enable access or they can often email you a copy immediately rather than waiting for mail. This is usually much faster than waiting for a replacement to arrive by mail.

One thing nobody mentioned yet - if your coverage was through Medicaid or CHIP, some states don't send 1095-B forms automatically. You might need to specifically request one from your state Medicaid office. I learned this the hard way last year when I was waiting forever for a form that was never going to come unless I asked for it! Check your state's Medicaid website as some states now have portals where you can download the form yourself.

•Good point! I had marketplace coverage (ACA plan) and they send a different form - the 1095-A. Those ARE required for filing if you got any premium tax credits. Don't confuse the different 1095 forms. The A version is necessary, but B and C versions aren't required for filing.
