IRS took my refund despite payment plan - What can I do?
Hey everyone, I'm in a bit of a pickle with the IRS. They took my tax refund again even though I'm on a payment plan. Has anyone else dealt with this? I thought being on a payment plan was supposed to protect my refund. Any advice on what I should do next?

Ugh, that sucks! I've been there before. Have you tried calling the IRS directly? Sometimes they can explain why it happened and maybe even reverse it.

I've been trying to call them for days but the wait times are insane. It's so frustrating!

Pro tip: call right when they open in the morning. You might have better luck getting through.

I found a way to actually get someone on the phone. I used this site's (claimyr.com) calling tool that dials the phone menu, stays on hold, waits for a live agent to pick up, then sends the call to my phone. It does cost $20, but it works. Here's the link: https://www.claimyr.com

Sounds too good to be true. Is this legit?

I was skeptical at first too, but I tried it and it actually worked. Saved me hours of frustration.

For me, it was totally worth it. Time is money, and I wasted way more than $20 worth of time trying to get through on my own.

This happened to me last year. Turns out there was a glitch in their system and my payment plan wasn't properly recorded. I had to send in Form 8857 to request innocent spouse relief. It took a few months, but I eventually got my refund back.

Here's what you need to do: 1. Double-check your payment plan agreement. Make sure you haven't missed any payments or terms. 2. Request a transcript of your account. This will show all transactions and might give you a clue about why they took your refund. 3. If everything looks correct on your end, you'll need to contact the IRS. Use the dedicated line for taxpayer advocate service: 1-877-777-4778. 4. If you can't get through, consider using a tax professional or enrolled agent. They often have separate lines to contact the IRS. 5. Be prepared to file Form 843 (Claim for Refund and Request for Abatement) if the IRS agrees there's been an error. 6. Document EVERYTHING. Every call, letter, and interaction. Remember, persistence is key. Don't give up! The IRS makes mistakes too, and you have the right to dispute this.

Serious question: has anyone successfully sued the IRS for this kind of thing? I'm so tired of their incompetence.

Suing the IRS is like trying to fight a bear with a toothpick. Not impossible, but definitely not recommended lol
