Received CP05 Letter After Amended Return - Avoided $5,000 Frivolous Filing Penalty But Now Under "Further Examination" - Anyone Still Get Their Refund?
Filed my return in February and had to amend in June. Just got a CP05 letter and I'm completely lost. Starting to lose hope about getting my refund. So here's the situation. I filed my original return back in February, but then realized I needed to make some changes so I submitted an amended return in June. I just received a CP05 letter from the IRS dated July 1, 2024, acknowledging my response from June 30, 2024. The letter states: "Thank you for your response of June 30, 2024. We're sending your response, dated June 30, 2024, to the office at the address at the end of this letter because: Your amended return corrected your frivolous position; therefore, you will not be assessed the $5,100.00 frivolous filing penalty. However, your amended return included other changes which require further examination. You will be contacted if additional information is needed to process your case." I'm not sure what "frivolous position" they're referring to, but apparently my amended return fixed that issue. But now they're saying my other changes need "further examination" which sounds like more delays. The letter also mentions: "Find tax forms or publications by visiting IRS.gov/forms or calling 800-TAX-FORM (800-829-3676). If you have questions, you can call 866-883-0235. If you prefer, you can write to the address at the top of the first page of this letter. When you write, include a copy of this letter, and write your telephone number and the hours - can reach you. Keep a copy of this letter for your records. Thank you for your cooperation." Has anyone else received this verification letter and still eventually received their refund? How much longer should I expect to wait? I'm really starting to lose hope about ever seeing my money.

Tax pro here - CP05 letters are pretty common this year. It means they're reviewing your return for accuracy. Keep all your documentation handy (W2s, 1099s, receipts). Usually takes 60-120 days for review but could be longer with the amendment.

β’I know it sucks, but amended returns are taking forever this year. Hang in there!

Hey instead of playing the waiting game, you should check out taxr.ai - it analyzes your transcript and tells you exactly what's happening and when you'll likely get paid. Its like $1 but totally worth it to actually understand whats going on. https://taxr.ai

Don't lose hope! I went through something similar last year. The good news is that they acknowledged your amended return fixed the frivolous filing issue, so you avoided that $5,100 penalty which is huge. The "further examination" part is just them double-checking your other changes - it's annoying but standard procedure. My advice: keep checking your transcripts online every few weeks, and if you don't hear anything in 120 days, definitely call that number they gave you. The wait sucks but most people do eventually get their refunds processed. Hang in there! πͺ

β’Thank you so much for the encouragement! π You're right about avoiding that penalty - I didn't even realize how big of a deal that was until I read your comment. I've been checking my transcripts but they haven't updated much since the CP05. Really appreciate you taking the time to share your experience - gives me some hope that this will eventually work out!

I'm in a similar situation - got my CP05 in August after filing an amended return. The waiting is absolutely brutal but I've learned a few things that might help. First, the fact that they specifically said your amended return "corrected your frivolous position" is actually really good news - you dodged a massive bullet there. Second, I've been calling that 866 number every few weeks just to check status (best times are early morning). They can't speed things up but at least you know if there's movement. Also make sure you're checking your online account transcripts regularly - sometimes they update before you get any letters. The "further examination" sounds scary but from what I've read it's pretty routine when you amend. Stay strong! πͺ

β’This is super helpful advice! I never thought about calling regularly just to check status - that's actually a really good idea. And you're absolutely right about dodging that penalty, I'm starting to realize how lucky I was there. I've been checking my transcripts but they're pretty confusing to read. Do you know what specific codes or updates to look for that might indicate progress? Thanks for sharing your experience! π

I feel for you - the uncertainty is the worst part! I went through a similar CP05 review last year after amending and it took about 6 months total, but I did eventually get my full refund. The key thing that helped me was staying organized with all my documentation and being patient (easier said than done, I know). One tip: if you haven't already, create an online IRS account so you can monitor your transcripts - look for any 846 codes which indicate refund processing. The fact that they acknowledged your amendment fixed the frivolous filing issue is definitely a positive sign. Try calling that 866 number they provided if you hit the 120-day mark with no updates. Hang in there - most people in your situation do get their refunds eventually! π€

β’Thanks for sharing your experience! 6 months sounds about right from what I'm hearing from others. I actually just set up my online IRS account last week after reading similar advice - you're right that the transcripts are super helpful even though they're confusing at first. I'll definitely keep an eye out for that 846 code you mentioned. It's reassuring to hear that most people eventually get their refunds. The waiting game is just brutal but posts like yours give me hope! π

I'm going through almost the exact same thing right now! Filed in March, amended in July, got my CP05 in October. The "frivolous position" thing freaked me out at first but my tax preparer explained it's usually something minor that gets flagged by their system. The good news is you avoided that huge penalty! I've been checking my transcripts weekly and calling every month or so. No movement yet but the IRS rep told me amended returns with CP05 letters are taking 4-6 months minimum this year due to staffing issues. I know the wait is killing you (trust me, I feel it too) but from everything I've read here and other forums, most people do eventually get their refunds. Keep your documentation ready and maybe try calling that number if you haven't heard anything by the 4-month mark. We got this! πͺ

β’This gives me so much hope to hear from someone in almost the exact same timeline! π Your tax preparer's explanation about the "frivolous position" being something minor makes total sense - I was really confused about what that even meant. It's crazy that amended returns are taking 4-6 months minimum now, but at least we know it's not just us. I've been hesitant to call because I figured they'd just tell me to wait, but maybe I'll try next month if nothing changes. Thanks for the encouragement - it really helps to know we're not alone in this! πͺ
