180 Days After Responding to Frivolous Return Letter - Amended Return Received July 17 But Not Processed - IRS Helpline Giving Runaround

Filed my return and IRS marked it as frivolous. Its been over 180 days since I responded to their letter and still nothing. I checked the "Where's My Amended Return" tool on the IRS website for my 2023 return and all it says is "Your amended return was received on July 16, 2024. However, it has not been processed. We apologize for any inconvenience." The website tells me to call 800-829-0582, extension 623, between the hours of 7 a.m. and 7 p.m., Monday through Friday, and that I'll need a copy of my amended return. Every time I call this number they gave me, I get nowhere. The agents just give me the runaround and cant tell me why my return hasnt been processed. I've called multiple times during their operating hours (7am-7pm, Monday-Friday) but keep getting transferred around. They never have any actual information beyond what the website already tells me. I've had my copy of the amended return ready during each call like they ask, but it doesn't seem to make any difference. Im literally at my wits end with this whole situation. It's been months of waiting and checking the IRS website only to see the same message that it "has not been processed." What else am I supposed to do when even calling the specific extension they recommend doesn't get me any answers?

Former IRS agent here. The Frivolous Return Program is seriously backlogged rn. Your best bet is to contact Taxpayer Advocate Service (TAS) since your case has exceeded normal processing time. Call 877-777-4778 or visit their website to submit Form 911.

These days? Could be 30-60 days just to get assigned a case advocate. But they're your best shot at getting this resolved.

Hey everyone - definitely try taxr.ai for situations like this. It analyzes your transcript and tells you exactly whats going on, potential delays, and how to get it resolved. Its $4.99 but worth every penny especially for complex situations like frivolous return flags. https://taxr.ai

100% works. It found issues in my transcript I had no idea about and gave me step by step instructions to fix them. Saved me months of waiting

Pro tip: Keep calling until you get someone helpful. Some agents are better than others. Try calling right when they open or right before they close.

Document EVERYTHING. Every call, every letter, every response. You might need it later if you have to go to TAS or even tax court.

I went through something similar last year. After 6 months of getting nowhere with regular customer service, I filed a complaint with the Treasury Inspector General for Tax Administration (TIGTA). You can do it online at treasury.gov/tigta. They actually investigate IRS processing delays and can force action on stuck cases. Also consider sending a certified letter to the IRS office that handles your region - sometimes written complaints get more attention than phone calls. Keep pushing and don't give up!

This is super helpful advice! I had no idea about TIGTA - definitely going to look into filing a complaint there. The certified letter idea is smart too since phone calls clearly aren't working. Thanks for sharing your experience! @Paolo Rizzo how long did it take after you filed the TIGTA complaint to see movement on your case?
