EIC Refund Offset for Ex's EBT debt - No Notice Received - Will Child Support Impact My Refund?

Filed with earned income credit for my 4 kids. Called the offset number and found out theres an EBT overpayment offset but never got any notice letter. Called DES and they said I dont owe anything, but then told me since im the father im responsible for my ex's debt? Anyone deal with this before?

This is actually incorrect information from DES. You are NOT responsible for your ex's EBT debt unless you were part of the household during the time the overpayment occurred. They cannot offset your refund for someone else's debt without proper documentation and notice. You need to request a review of the offset and file Form 8379 (Injured Spouse) if you file jointly.

Contact the Treasury Offset Program directly at 800-304-3107. Get everything in writing and demand a detailed explanation of the debt. Don't take any verbal confirmations as gospel
