Quit due to inflexible work schedule and childcare conflicts - EDD eligibility?
I'm at my wit's end with my retail management position. For the past 8 months, I've been struggling to find reliable childcare for my two kids (7 and 4) since my ex moved out of state. I've formally requested a more consistent schedule with no overnight shifts through HR. Despite having seniority (worked there 5+ years!), my store director keeps scheduling me for closing shifts followed by early mornings, making childcare arrangements nearly impossible. I've already used up my PTO for emergencies, and now they're denying my unpaid time off requests too. I'm considering resigning next week because I simply cannot continue like this. Would I qualify for unemployment benefits in California if I quit due to these childcare circumstances? I've documented all my schedule accommodation requests and their denials. Anyone dealt with something similar?

This is a tricky situation but you might qualify for "good cause" to quit. EDD considers childcare responsibilities a legitimate reason if you've made reasonable efforts to preserve your job. Since you've documented your requests and their denials, that's helpful evidence. Make sure you keep copies of all communications and the denied time-off requests. When you file, be very specific about timeline and how their scheduling made continuing work impossible despite your attempts to resolve it.

•Thank you! I've been keeping screenshots of the schedule app showing the crazy back-to-back shifts and emails to my manager. Do you think I should try one more time with a formal letter before quitting? Or would that just delay the inevitable at this point?

•That's encouraging to hear! How long did your approval take? And did you have to do an interview with EDD about why you quit?

DONT QUIT UNTIL YOUVE TALKED TO HR AGAIN!!! The EDD is gonna deny you if you haven't exhausted ALL options. They denied my claim when I quit my warehouse job because of childcare and I'm still fighting it 2 months later. At least get something in WRITING from HR that shows they refused to work with you. Trust me the EDD looks for ANY reason to deny benefits these days!!

•That's really good advice. I did email HR twice but only got verbal responses from my store director. I'll definitely make sure to get written documentation before making any moves.

You're doing the right thing by gathering documentation. When you apply, you'll need to explain during your eligibility interview exactly how you tried to preserve your employment. California's EDD does recognize childcare issues as potential good cause for leaving work, but the burden is on you to prove you had no reasonable alternative. Make sure you specifically mention: 1. Dates you requested accommodation 2. Who denied them and when 3. Why the schedule made childcare impossible 4. That you had no other childcare options 5. How long the issue persisted before you quit Be prepared for a potentially lengthy interview process and possible initial denial that you'll need to appeal.

•Thank you for the detailed checklist. I'm really nervous about the interview part. How long after filing would that typically happen? I'm trying to plan financially for a possible gap with no income.

I was in a similar situation with my manufacturing job last year. EDD scheduling interviews can take 4-8 weeks right now due to backlog, and many people get denied initially even with valid reasons. After trying for 3 weeks to reach someone by phone about my pending interview (calling 50+ times!), I finally used Claimyr (claimyr.com) and got through to an EDD agent in less than 2 hours. Worth every penny to get my issue resolved instead of waiting another month. They have a video showing how it works: https://youtu.be/JmuwXR7HA10?si=TSwYbu_GOwYzt9km For your situation, document EVERYTHING before quitting. Get final denials in writing. Then be prepared for the eligibility interview where they'll assess if you had good cause to quit.

•Thank you for the suggestion. I've been worried about how to even get through to EDD if I have questions. I'll check out that service if I end up filing. Did you win your case with childcare issues?

•Yes, I was eventually approved after the phone interview. The key was having documentation showing I tried to work with my employer for over a month to resolve the schedule conflicts. Make sure you can show a pattern of them being unreasonable despite your requests.

you should apply for UI but dont quit ur job until u find something else, the benefits r way less than ur probably making now and sometimes they take forever to approve u

•I've been applying for other jobs but haven't found anything that works with my childcare situation yet. You're right that benefits would be less, but I'm genuinely at a breaking point with the current schedule.

Just to follow up on your original question - under California UI code, you need to demonstrate you had no reasonable alternative to quitting. When you file your claim and explain the separation reason, make sure you indicate the specific circumstances that made continuing work impossible despite your good faith efforts. During the eligibility interview, you'll likely be asked detailed questions like: - Why couldn't you arrange alternative childcare? - Did you propose alternative schedules? - What specific accommodations did you request? - Was there a company policy regarding schedule changes? The eligibility determination hinges on whether EDD finds your actions reasonable given your circumstance. Documentation of all attempted solutions will be crucial.

•This is incredibly helpful - thank you! I'll start preparing answers to those specific questions and gathering all my evidence. If I do decide to quit, at least I'll be prepared for the claim process.
