If you get fired are you eligible for unemployment in California EDD?

So I got let go from my job last Friday and I'm honestly still in shock. I worked at a logistics company for about 2 years and my manager called me into the office and said they were letting me go due to 'performance issues.' I never received any written warnings and HR just handed me a separation form to sign. I didn't even think to ask questions, I just kind of signed and left. Now I'm sitting here wondering - if you get fired are you eligible for unemployment in California? I always thought being fired automatically disqualified you but a coworker texted me saying that's not always true. I filed a claim on UI Online yesterday but honestly I have no idea what to expect. My account just shows 'pending' and I don't know if that means they're going to investigate why I was terminated or what. I'm the main income earner in my household and I have about 6 weeks of savings before things get really tight. Any insight into how California EDD handles terminations would be really helpful right now.

Good news - being fired does NOT automatically disqualify you from unemployment in California. California EDD looks at the reason for the termination, not the termination itself. The key distinction is whether you were fired for 'misconduct' as defined under California Unemployment Insurance Code. If you were fired for things like general performance issues, not being a good fit, or inability to meet job requirements, you can still qualify. What WOULD disqualify you is if you were fired for deliberate misconduct - like willfully violating company policy, theft, or intentional rule-breaking. The fact that you never received written warnings actually works in your favor. California EDD will reach out to your former employer to get their side, so just be completely honest when you certify and answer any questionnaires they send you.

This is really reassuring to hear. So when EDD contacts my former employer, what exactly are they asking them? I'm worried my manager might exaggerate the performance issues.

0 coins

EDD will send your employer a form asking them to describe the reason for separation. Your employer has to respond under penalty of perjury, which keeps most employers honest. If their explanation conflicts with yours, that can trigger adjudication - basically EDD investigating both sides before making a determination.

0 coins

yeah my brother got fired and still got unemployment, it really does depend on the situation

0 coins

The way California EDD handles terminations is pretty nuanced. They essentially ask: did you do something deliberately wrong, or did you just not meet the employer's expectations? Performance-based terminations usually fall into the second category and are generally approved. When you filed your claim, EDD sent a notice to your employer giving them 10 days to respond and explain the termination reason. Based on what they say, EDD might send you a questionnaire too. Fill that out immediately when it arrives - delays can slow everything down significantly.

0 coins

I haven't gotten any questionnaire yet but I'll watch my mail and email carefully. How long does this whole determination process usually take?

0 coins

Typically 3-5 weeks from the date you filed, but it can stretch longer if your employer contests the claim. Keep filing your weekly certifications every week regardless - you don't get paid for weeks you didn't certify even if your claim eventually gets approved.

0 coins

THIS. Do not stop certifying weekly just because your claim says pending!! I made that mistake and lost like 3 weeks of benefits because I thought I had to wait for approval first

I was fired from a retail job about a year ago and went through exactly this process. My employer claimed I violated store policy but I had never been given a written copy of that policy. I was honest with EDD about everything, answered their questionnaire thoroughly, and got approved about 4 weeks later. One thing that really helped me was actually being able to talk to an EDD rep on the phone to understand where my claim was. I used a service called Claimyr (claimyr.com) because I was spending literally hours redialing and never getting through. There's a video demo at https://youtu.be/JmuwXR7HA10 that shows how it works. Got connected to an actual EDD agent pretty quickly and they walked me through what was happening with my claim. Definitely worth it when you're anxious and need real answers.

0 coins

I've been trying to call EDD and keep getting the 'we cannot take your call' message. How does Claimyr actually work?

0 coins

It basically navigates the EDD phone system for you and holds your place, then calls you back when an agent is available. Saved me so much frustration. Check the video at https://youtu.be/JmuwXR7HA10 and the site claimyr.com for details.

0 coins

I've heard of this before. Does it actually work or is it one of those things that sounds good but doesn't deliver?

0 coins

Worked for me personally. Got connected same day I tried it. Your experience may vary but after days of failed calls I was pretty desperate and it came through.

0 coins

wait so if ur fired for like being late a lot does that count as misconduct?? asking for a friend lol

0 coins

Depends on the circumstances. Isolated or occasional tardiness usually isn't considered misconduct under California law. But if you were repeatedly late despite written warnings and formal disciplinary action, EDD might view that differently. The key word EDD uses is 'wilful' - did the person intentionally disregard the employer's rules.

0 coins

ok so like one written warning probably doesnt make it misconduct right

0 coins

Generally correct. One written warning followed by termination is usually not going to rise to the level of misconduct that disqualifies a UI claim in California. EDD looks at the totality of circumstances.

0 coins

I went through a termination claim last spring and I want to add something important nobody has mentioned yet. When EDD sends you the claimant questionnaire about your separation, be SPECIFIC and DETAILED in your answers. Don't just write 'I was fired for performance.' Explain the actual situation - that there were no written warnings, that you had no documented disciplinary history, that the termination was sudden. I wrote two full paragraphs explaining my situation and I believe that detail is what got my claim approved even though my employer tried to contest it. The EDD interviewer told me my written explanation was very thorough.

0 coins

That's great advice, thank you. I'll make sure to be as detailed as possible. Should I keep copies of everything I submit?

0 coins

Absolutely keep copies of EVERYTHING. Screenshot your UI Online submissions, keep copies of any mail from EDD, and document every phone call you make including date, time, and what was discussed. If you ever need to appeal, that documentation is gold.

0 coins

100% agree with keeping records. I wish someone had told me this when I filed my first claim years ago

0 coins

EDD DOESN'T CARE ABOUT YOU they just look for any reason to deny claims and make you jump through a million hoops. I got fired after 4 years at my company for total BS reasons and EDD still put me in adjudication for 7 weeks before finally approving me. Seven weeks with no income while they 'investigated.' The system is broken.

0 coins

I feel this so hard. The waiting is genuinely awful when you have bills to pay. Did you at least eventually get all the back pay for those 7 weeks?

0 coins

Yes I got all the back payments at once which was something. But try explaining to your landlord why rent is going to be 7 weeks late. The system assumes you're guilty until proven innocent.

0 coins

The adjudication process is frustrating but it does exist to protect claimants too - without it employers could just claim misconduct for anyone and deny all claims. It's a flawed system but not without purpose.

0 coins

ok i'm in a similar situation and now i'm panicking reading this thread. I was fired two weeks ago and my claim has been in adjudication since I filed. I never got any questionnaire in the mail. Is that normal?? Do they always send one or only sometimes?

0 coins

Not everyone gets a questionnaire - it depends on whether EDD needs more information from you specifically. Sometimes EDD only needs to hear from the employer. Log into UI Online and check your inbox there too, not just physical mail - EDD sometimes sends notices electronically.

0 coins

Oh I didn't realize they send notices through UI Online too! Just checked and there's actually a message in there asking me to call them. I would have missed that completely. Thank you!!

0 coins

Check your UI Online inbox regularly - this is so important and a lot of people don't know about it. Glad you caught it in time.

0 coins

just want to share my experience since it might help - i was let go last year, employer said it was performance related, I filed for UI and got approved in about 3 weeks with no issues. never even got a questionnaire, it just went through. so it doesn't always have to be a big complicated thing

0 coins

That's really encouraging to hear. I'm hoping mine goes smoothly like yours did.

0 coins

just be honest and keep certifying every week and you should be fine. fingers crossed for you

0 coins

Something nobody mentioned yet - make sure you understand the weekly certification questions correctly. When it asks if you were 'discharged' that means fired. Don't accidentally click the wrong reason for separation when certifying. I've seen people accidentally select 'quit' instead of 'discharged' and it causes a massive mess that takes forever to fix.

0 coins

Oh wow I didn't even think about that. I'm going to double-check what I entered when I first filed.

0 coins

Yes go check that right now in UI Online. The initial claim should show your reason for separation. If it's wrong you need to contact EDD immediately to correct it before it affects your determination.

0 coins

wait how do you even fix that if you put the wrong thing

0 coins

You have to call EDD or send a message through UI Online to request a correction. Which is why using something like Claimyr (claimyr.com) to actually get through on the phone is so helpful for things like this - some corrections can't be done online and you need to actually speak to an agent

0 coins

I work in HR (not at your company obviously) and I can offer some perspective from the other side. When EDD contacts employers about a termination, most HR departments just respond factually based on what's in the personnel file. If there's no documented misconduct in your file, an honest HR response is actually going to help your claim. The employers who fight unemployment claims hardest are usually the ones with very specific documented misconduct they can point to.

0 coins

That's really helpful context. Since there were no written warnings in my file, hopefully their response won't give EDD reason to deny me.

0 coins

Exactly. 'We terminated for performance issues but have no formal documentation' is actually a very weak position for an employer trying to deny a UI claim. EDD generally sides with claimants in those situations.

0 coins

This is accurate from my experience. Employers who just say 'performance' without documentation rarely succeed in contesting claims.

0 coins

went through this exact situation in march. fired without any written warnings after 3 years at the company. EDD approved my claim in about 5 weeks. it was stressful waiting but it worked out. hang in there

0 coins

Thank you, this kind of reassurance really helps when you're in the anxious waiting period.

0 coins

totally understand the anxiety. the not knowing is the hardest part

0 coins

Circling back to add - if your claim does end up in adjudication and you need to talk to someone at EDD, seriously consider using Claimyr. I mentioned it earlier but wanted to emphasize it because adjudication situations especially benefit from being able to speak to an actual agent. They can tell you exactly what information EDD has, what your employer said, and what you can do. That clarity is worth so much when you're stressed about your income. claimyr.com and the demo video is at https://youtu.be/JmuwXR7HA10.

0 coins

How long does it usually take to get connected through Claimyr? I've been trying to call EDD for days and need to talk to someone about my adjudication.

0 coins

My experience was same day but I've heard it can vary. Still way faster than the regular call line where you often just get disconnected or can't even get into the queue.

0 coins

also want to mention - if EDD denies your claim you have the right to appeal within 30 days of the determination notice. Don't give up if you get denied. A lot of initial denials get overturned at appeal hearings. The appeal process involves a hearing with an Administrative Law Judge and you can present your evidence there.

0 coins

I really hope it doesn't come to that but good to know there's a safety net. What kind of evidence helps at an appeal?

0 coins

Things like any emails showing your work performance was acceptable, pay stubs showing you were never docked pay for performance, texts or messages from your manager that contradict the misconduct claim, anything like that. Basically anything that shows you weren't intentionally violating rules.

0 coins

And at the appeal hearing you can have a representative or attorney assist you. There are free legal aid services in California that specialize in unemployment appeals if you need help.

0 coins

This is kind of a tangent but your post made me think about my situation from about 6 months ago. I was also fired and went through the whole EDD process. What nobody tells you is how mentally exhausting the uncertainty is. Like the actual financial stuff was manageable but the not knowing, the waiting, checking UI Online every single day... I ended up connecting with a therapist through my health insurance that was still active during the cobra period and it genuinely helped. Just throwing that out there because job loss is rough even when the unemployment claim works out fine.

0 coins

Thank you for saying that. I've definitely been feeling the emotional weight of this, not just the financial stress. I'll look into what mental health resources I might still have access to.

0 coins

this is such an underrated point. job loss hits different emotionally

One more practical thing to add about the job search requirements while your claim is pending: California EDD requires you to be actively seeking work and to document your job search activities. You need to complete at least three job search activities per week - this can be applying for jobs, attending job fairs, networking, etc. Keep a log of these because EDD can audit your job search activities at any time. Also make sure you're registered with CalJOBS (the California job search portal) if you haven't already - EDD requires this as part of the eligibility process.

0 coins

I didn't realize I had to register with CalJOBS. I'll do that today. Is there anything specific I need to do there or just create an account?

0 coins

Create your account, complete your profile with your work history and skills, and upload your resume. EDD can see your CalJOBS activity so a complete profile shows you're actively engaged in the job search process.

0 coins

wait u have to actually document every job search?? i thought u just clicked yes on the certification

0 coins

Yes you need to actually document your activities - keep a written log with dates, employer names, how you applied, etc. You're certifying under penalty of perjury when you say you conducted job search activities, so it needs to be real and documented.

To directly answer the original question for anyone who finds this thread through search: Yes, you CAN be eligible for unemployment in California even if you were fired. California EDD evaluates whether the termination was due to misconduct as defined by law. General performance issues, layoffs dressed up as terminations, personality conflicts, and inability to meet production standards typically do NOT constitute disqualifying misconduct. Deliberate rule violations, theft, harassment, or intentional insubordination typically DO constitute disqualifying misconduct. When in doubt, file your claim and be completely honest. Let EDD make the determination. Many people assume they're disqualified when they're actually entitled to benefits.

0 coins

good summary for anyone skimming. file the claim no matter what, worst they can say is no

0 coins

This should be pinned at the top honestly

0 coins

Really grateful for this thread and everyone who took the time to respond. I'll update when I get a determination.

0 coins

OP please do update us! Rooting for you. And for anyone else reading - the California EDD website has a pretty detailed FAQ about separation reasons and what qualifies as misconduct. Worth reading so you know exactly what they're looking at when they review your claim.

0 coins

Will definitely update. Going to go register for CalJOBS right now and make sure my weekly certification is in order. Thanks everyone.

0 coins

Good luck!! The fact that you're being proactive about it is a great sign

0 coins

Late addition but wanted to flag: some people in this situation worry about whether to reach out to their former employer or HR department. In general, I'd advise against contacting your former employer once an EDD claim is filed. Anything you say to them could potentially be used in their response to EDD. Let EDD handle the communication between parties.

0 coins

That's smart advice I wouldn't have thought of. I was actually considering reaching out to my old manager. I'll hold off.

0 coins

Especially avoid any communication that could be interpreted as an admission that you violated a rule or policy. Even innocent things like 'I know I wasn't meeting expectations' could complicate your claim.

0 coins

Solid advice. Keep all communication about the claim through EDD's official channels only.

0 coins

UPDATE FROM ME: I called EDD through Claimyr after seeing it mentioned in this thread and actually got through to an agent today. Turns out my adjudication was triggered because my employer checked a box saying 'policy violation' but when the agent looked at the notes, my employer had not provided any specifics or documentation. The agent told me my case actually looks favorable based on what's in the file. Still have to wait for the formal determination but at least I know what's happening. Thank you to whoever mentioned Claimyr, genuinely saved my sanity.

0 coins

So glad it worked out for you! That's exactly the kind of clarity that makes the waiting bearable. Fingers crossed for your determination.

0 coins

See this is why you need to actually talk to a human at EDD. The UI Online status means nothing, you need the actual details of what's in your file.

0 coins

This is so encouraging to see. Definitely going to try Claimyr if my claim goes into adjudication.

0 coins

rooting for you!! keep us posted
