Got fired from my job - can I still get California EDD unemployment benefits?

So I just got let go from my job two days ago and I'm completely lost on what to do next. I worked at a warehouse logistics company for about 2 years and my manager said I was being terminated. They didn't give me a ton of explanation, just said my performance wasn't meeting standards. I never got any written warnings that I can remember and honestly I feel blindsided by this whole thing. My question is - if I got fired can I get unemployment through California EDD? I always thought you could only collect if you got laid off but my coworker texted me and said I might still qualify depending on the reason. I have no idea how any of this works. Do I even bother applying or will I automatically get denied because they fired me? Really stressed about bills right now so any help is appreciated.

Short answer: yes, getting fired does NOT automatically disqualify you from California EDD unemployment benefits. People assume this all the time but it's actually a misconception. The key question EDD asks is whether you were fired for 'misconduct' as legally defined under California unemployment law. Simple performance issues, not being a good fit, or even being let go for production numbers typically does NOT count as misconduct. You have a really solid chance here, especially if you never received formal written warnings. File your claim ASAP at UI Online because benefits only go back to your application date, not your last day of work.

Wait seriously?? I genuinely thought I was just out of luck. So the difference is whether they fired me for like actual bad behavior vs just performance?

0 coins

Exactly. California EDD defines misconduct pretty specifically - it generally has to involve deliberate violation of company rules, dishonesty, or behavior that shows willful disregard for your employer. Struggling to hit metrics or performance benchmarks usually doesn't rise to that level.

0 coins

This is correct. I went through the same situation last year, terminated for performance reasons at a tech company, and got approved no problem. File immediately, don't wait.

0 coins

also depends on what your employer tells edd when they contact them. edd will reach out to your former employer after you file to get their side. if the employer claims it was for misconduct edd may send you an adjudication notice which means they need more info before deciding. happened to me and it was annoying but i still got approved eventually

0 coins

Ugh adjudication sounds scary. How long does that take if it happens?

0 coins

took about 3 weeks for me but i've seen people say way longer. just make sure you respond to ANY letters or calls from edd immediately or they can deny by default

0 coins

adjudication is basically just edd reviewing the circumstances of your separation from both sides. it's not an automatic bad thing it's just a hold while they investigate

I was in almost this exact spot about 8 months ago - fired from a retail management job, panicked thinking I'd get nothing. Filed online and then waited forever with no updates. I kept trying to call California EDD to check on my claim status and could not get through to anyone for WEEKS. Busy signal, disconnected, the whole nightmare. Someone here actually told me about Claimyr (claimyr.com) which is a service that gets you connected to a live EDD agent without you having to spend hours redialing. There's a video showing how it works at https://youtu.be/JmuwXR7HA10 - I was pretty skeptical at first but I was desperate. Got connected to an actual agent who confirmed my claim was in adjudication and told me exactly what documentation to have ready. Ended up getting approved. Definitely worth checking out if you hit a wall trying to reach EDD directly.

0 coins

Oh wow I didn't even know something like that existed. I'll bookmark that link, thank you

0 coins

claimyr saved my sanity during my claim last year lol. edd phone lines are basically impossible

0 coins

is this legit? like does it actually work or is it some kind of scam

0 coins

100% legit, I was skeptical too. You can watch the demo video at the youtube link I posted before committing to anything. It just gets you through to an actual EDD agent instead of being stuck on hold forever.

0 coins

DONT PANIC. I know it feels overwhelming but firing for performance is one of the most common reasons people get approved for California EDD benefits. The burden of proof actually falls on your employer to demonstrate misconduct. If they cant prove it, you win the adjudication by default essentially. Document everything you remember about your termination RIGHT NOW while its fresh - who said what, any verbal warnings or lack thereof, your work history there.

0 coins

Good call on documenting everything. I'm going to write it all down today. They really said almost nothing to me, just called me into an office and said today was my last day.

0 coins

That vague of a termination is actually really good for your case. No specific misconduct cited = harder for them to prove it during the EDD review.

this ^^^ document everything asap memory fades fast

Filing process for a termination claim in California: 1. Go to UI Online at eapply4ui.edd.ca.gov and create an account or log in 2. Start a new UI claim - it takes about 30-45 minutes to complete 3. When asked about reason for separation, select 'discharged/fired' and explain in your own words what happened 4. Be honest and factual - don't exaggerate or minimize 5. After filing you'll get a confirmation number - keep that 6. Watch for a DE 1080 form (Claim Confirmation) and any follow-up notices 7. Start filing your weekly certifications every Sunday-Saturday period even while your claim is pending The weekly certifications are critical - if you don't file them you lose those weeks of benefits even if you're later approved.

0 coins

This is incredibly helpful thank you. One question - do I file weekly certifications even if my claim hasn't been approved yet?

0 coins

YES absolutely file every week without fail. Even if your claim is in adjudication or pending. If you get approved later, those weekly certifications are what EDD uses to calculate your backdated payments. Missing weeks means missing money.

0 coins

seconding this, I almost made this mistake. file every single week no matter what, even if the portal looks weird or says pending

0 coins

the weekly certification questions are pretty straightforward, mostly asking if you were able and available for work, did you look for work, and did you earn any money that week

0 coins

my brother in law got fired last year supposedly for 'not following company procedures' and he applied and got fully approved. edd ruled in his favor because the company couldnt show he was properly trained on those procedures in the first place. point is even if your employer tries to claim misconduct they actually have to prove it with documentation

0 coins

That's actually really reassuring to hear. Thank you for sharing that

0 coins

yeah he was shocked too lol. edd is more claimant friendly than people think especially in california

0 coins

wait so what counts as actual misconduct then? like what would make you NOT qualify

0 coins

Generally speaking misconduct that disqualifies you includes things like: theft from employer, harassment of coworkers, repeated insubordination after warnings, falsifying company records, showing up drunk or on drugs, or abandoning your job. Basically deliberate harmful or dishonest behavior. Just being bad at your job or not hitting sales numbers? Usually not misconduct.

0 coins

ok that makes way more sense now. I was confused thinking getting fired automatically meant no benefits

0 coins

Yeah this is one of the biggest myths about unemployment. Even a lot of people who get fired for legitimate reasons like attendance issues often still qualify depending on the circumstances.

0 coins

I'm going through something similar right now actually, been trying to reach California EDD for three weeks straight because my claim shows 'pending' with no explanation and I'm losing my mind. Has anyone successfully gotten through on the phone recently??

0 coins

Check out Claimyr - claimyr.com - that's genuinely the only thing that worked for me when I was in the same situation. The regular EDD phone lines are a nightmare. There's a demo video at https://youtu.be/JmuwXR7HA10 that explains how it works.

0 coins

Thank you I will try this today, I'm desperate at this point

0 coins

The phone lines are genuinely terrible. Early morning right when they open at 8am is your best shot otherwise

0 coins

also want to mention - even if you do get denied initially don't give up!! you have the right to appeal any EDD decision within 30 days of the mailing date on the notice. appeals actually have a pretty decent success rate especially for termination cases where the employer couldn't clearly demonstrate misconduct. I appealed a denial two years ago and won at the hearing.

0 coins

I didn't know there was an appeals process. Is it complicated?

0 coins

Not terribly. You file a written appeal, then get a hearing date with an Administrative Law Judge. You present your side, employer presents theirs, judge decides. You can represent yourself, you don't need a lawyer. The key is having documentation of your employment history and the circumstances of your termination.

0 coins

appeals hearings are way less formal than you'd think. I sat through mine via phone and just explained my situation. Won on appeal after being denied initially.

0 coins

just want to validate that this whole thing is incredibly stressful and scary, you're not alone. the uncertainty of not knowing if you'll have income is genuinely awful. hang in there and file as soon as possible, the sooner you file the sooner the clock starts on your benefits

0 coins

Thank you, that actually means a lot. Filing today.

0 coins

Good luck! Come back and update us when you hear something

0 coins

one thing I should add - after you file your claim EDD might mail you a DE 4800 form asking for more details about your separation from the employer. Fill that out completely and return it FAST, don't let it sit. Missing deadlines on EDD paperwork can seriously delay or tank your claim

0 coins

How quickly do I need to return it?

0 coins

Usually 10 days from the mail date on the form. EDD dates everything from when they mail it not when you receive it so you sometimes have less time than you think. Return it certified mail if you want proof of delivery

0 coins

something nobody mentioned yet - you'll also need to start a job search log once your claim is active. california requires you to contact at least 3 employers per week and document it. EDD can audit your job search records at any time so keep detailed notes including date, company name, position applied for, and how you applied. use CalJOBS to register too, EDD cross references that sometimes

0 coins

Oh I didn't realize there were job search requirements. What if I'm picky about what I apply to, does it matter what kinds of jobs?

0 coins

They should be jobs you're reasonably qualified for and similar to your past work. You can't just apply to random stuff you'd never actually take. CalJOBS.ca.gov is where you register and it makes logging your contacts easier.

0 coins

Important clarification: the 3 employer contacts per week requirement applies during your active job search. If you're granted standby status because you have a definite return to work date, this requirement is waived. But for a termination situation like OP's, regular job search requirements apply.

0 coins

edd approved me after being fired 'for cause' at my last job. the whole process took about 5 weeks from filing to first payment hitting my EDD debit card. just be patient and keep filing those weekly certs

0 coins

Five weeks feels like forever when you have bills but knowing it eventually worked out helps

0 coins

I know. It's rough. See if family can help bridge the gap, and check if you qualify for any local assistance programs in the meantime

0 coins

Does anyone know if your previous employer can actually FIGHT your unemployment claim and like try to make you not get it??

0 coins

Yes, employers can contest unemployment claims. When EDD contacts them after you file, they can provide information arguing the termination was for misconduct. That's what triggers adjudication - when the employer's account contradicts yours. But again, the burden is on them to prove misconduct, not on you to prove you didn't commit it.

0 coins

Wow I had no idea. That seems like it could get messy

0 coins

It can. Especially with larger companies that have HR departments that proactively fight every claim to keep their UI tax rates down. That's exactly why documenting your side clearly when you file matters so much.

0 coins

if an employer contests and it goes to a hearing, you have full rights to present your case. I've seen plenty of people win even against large companies with lawyers because the facts were on their side

0 coins

Update for OP - I went through termination claim about 14 months ago. Timeline was: filed day 1, got DE 4800 form around day 10, returned it immediately, claim went to adjudication, took 4 weeks, approved, received backpay for all weeks I'd filed certifications. Total from filing to having money in my account was about 6 weeks. Not fast but it worked. Just be diligent about every step.

0 coins

This timeline is really helpful to have as a reference. Thank you for sharing the whole thing

0 coins

Of course. The anxiety of not knowing what to expect is almost worse than the wait itself. Now you know what to roughly expect.

0 coins

also heads up that your weekly benefit amount is based on your highest earning quarter in the base period which is roughly the first 12 of the last 15-18 months you worked. california edd calculates it as about 60-70% of your average weekly wages up to the maximum weekly benefit amount which is over $450 for most people. if you made decent wages at that warehouse job you might get a solid benefit amount

0 coins

I was making around $22/hour working 40 hours. Any rough idea what benefit I might expect?

0 coins

At $22/hour for 40 hours that's roughly $880 weekly gross. California EDD would typically pay around 60-70% of your average weekly wage, so potentially somewhere in the $500-600 range per week depending on your exact base period earnings. You can use the EDD Benefit Calculator on their website for a more precise estimate.

0 coins

yeah that's a decent benefit amount. definitely worth filing, that's real money each week

0 coins

this thread is super helpful, saving it. I'm not in this situation right now but feel like I need to know all this stuff just in case

0 coins

Same honestly. Nobody expects to lose their job but it's good to know your rights before it happens

0 coins

Agreed. And remember if you ever can't reach EDD by phone, Claimyr at claimyr.com is genuinely useful - saved me hours of frustration when I was dealing with my own claim issues.

0 coins

OP please update us on what happens! rooting for you

0 coins

Will do! Filed my claim this morning. Got my confirmation number. Now the waiting begins I guess. Thank you everyone in this thread, I went from completely panicked to actually feeling like I understand what's happening. This community is amazing.

0 coins

Great news that you filed! Remember - weekly certifications every week without fail, respond immediately to any EDD mail, and if you can't reach them by phone try claimyr.com. You've got this.
