If you get fired can you get unemployment in California EDD?

So I just got let go from my job at a warehouse last Friday and I'm completely lost on what to do next. My supervisor said I was being terminated for 'performance issues' but honestly the whole situation was really unfair and there's way more to the story. I've never filed for unemployment in my life so I don't even know where to start. My main question is - if you get fired can you still get unemployment benefits through California EDD? I always thought you could only collect if you got laid off but my coworker told me it depends on the reason you were fired. Is that true? I have bills due in like 2 weeks so I'm kind of freaking out right now.

Yes you can potentially still get unemployment even if you were fired - it's not automatic though. California EDD looks at the REASON you were fired. If you were let go for 'misconduct' as defined by EDD that's when you get disqualified. Performance issues alone usually don't count as misconduct so you might actually be in pretty good shape. File your claim ASAP because there's already a waiting period built in.

0 coins

Wait so performance issues aren't considered misconduct? That's actually really good to hear. What counts as misconduct then?

0 coins

Misconduct under California EDD rules generally means intentional or willful violations of workplace rules - like stealing, showing up drunk, harassing coworkers, things like that. Just not meeting performance standards or being bad at your job typically doesn't rise to the level of misconduct that disqualifies you.

File the claim online at UI Online through the EDD website right now don't wait. Every day you delay is potentially money you're leaving on the table. The benefit year starts from when you file not from when you got fired. Go to edd.ca.gov and start the application process.

0 coins

I was scared to file if I thought I might get denied but I'll start the application tonight.

0 coins

yeah what they said, file immediately!! i waited like 10 days after i got laid off and i was so mad at myself lol

I went through almost the exact same situation about 8 months ago - got fired for 'not meeting expectations' at my old company. Filed for UI and was initially put in adjudication because my employer contested it. Spent weeks trying to get through to a real person at California EDD to find out what was happening with my claim. Tried calling every single morning and kept getting the 'high call volume' message and hung up on. Eventually someone in another forum mentioned Claimyr - it's a service at claimyr.com that basically holds your place in line and calls you back when they have an EDD agent on the line. There's a video showing how it works at https://youtu.be/JmuwXR7HA10 - honestly it was a lifesaver for me. Got my situation sorted out after talking to an actual agent and my claim was approved. Performance issues alone were not considered misconduct.

0 coins

Oh wow I've never heard of Claimyr before. So they actually get you through to a live EDD agent? That sounds way better than sitting on hold forever.

0 coins

I used claimyr too when my claim got stuck. Works exactly like they describe. You just wait for your phone to ring instead of listening to hold music for hours.

0 coins

does it actually work though? sounds kinda sketchy to me tbh

0 coins

To directly answer your question - here's basically how California EDD looks at fired claims: 1. You file your claim and report that you were fired 2. EDD contacts your former employer to get their side 3. Your employer has a chance to contest and say you were fired for misconduct 4. If there's a dispute it goes to adjudication where EDD investigates 5. You get a decision letter If your employer claims misconduct you have the right to appeal within 30 days of the determination. Document everything you remember about why you were fired right now while it's fresh.

0 coins

Should I be worried that my employer will say it was misconduct even if it wasn't really? Like can they just lie?

0 coins

Your employer can certainly characterize it however they want but EDD looks at the actual facts. Document everything - emails, performance reviews, anything in writing. If they say misconduct but can't back it up with evidence of an intentional rule violation, EDD tends to side with the claimant. Keep everything.

this is good info. my cousin got fired and his employer said misconduct but edd still approved him because there was no real proof of anything intentional

0 coins

omg i just went through this literally last month!! got fired from my restaurant job and was so scared i wouldnt qualify. filed online and got approved after like 3 weeks. the waiting period was the worst but it worked out. hang in there!!

0 coins

That's so reassuring to hear, thank you! Did your employer contest it or did it go smoothly?

0 coins

my employer didnt contest it so it went pretty smooth. i think if they just let you go without a big fight about misconduct youre usually fine

A few things you should know before filing your California EDD unemployment claim after being fired: - Have your employment dates, wages, and employer contact info ready - Be honest and accurate when answering why you were separated - say fired/terminated - The base period EDD uses to calculate your benefit amount is typically the 12 months ending 3-6 months before you file - After filing there's a mandatory one-week unpaid waiting period before benefits begin - You'll need to certify for benefits every two weeks through UI Online - Job search requirements apply - you must actively look for work and document it Even with a termination, many people get approved. The key question is always whether there was misconduct as defined by California law.

0 coins

What exactly do I need to document for the job search requirements? How many jobs per week?

0 coins

California EDD requires you to make at least 3 job search contacts per week during your benefit year. You should keep a log with the employer name, position, date, and how you applied. EDD can audit your job search records so keep them accurate and detailed.

0 coins

Also worth noting - if you're in a union or your industry has seasonal patterns there might be exceptions to the job search requirements. But for most standard terminated employees the 3 contacts per week rule applies.

I got fired last year and my old boss straight up told EDD I was fired for misconduct when I wasn't. Went through adjudication and it was SO stressful. Had to appeal the initial denial and present my case. Won the appeal but took like 3 months total. Keep every single text message, email, voicemail from your employer. You'll want all of it if they try to fight your claim.

0 coins

Three months is really scary to think about. Did you have any income during that whole time?

0 coins

It was brutal honestly. I had to borrow money from family. But I eventually got all my back pay once the appeal was approved. Retroactive payments covered everything back to my original filing date which helped.

0 coins

This is exactly why filing IMMEDIATELY matters so much. Even if it takes months to resolve, your start date for back payments goes back to when you filed, not when you got approved.

0 coins

wait i thought if u get fired u automatically cant get unemployment?? thats what my friend told me

0 coins

That's a really common myth. Plenty of people get approved for unemployment after being fired. The only firings that automatically disqualify you are ones involving clear willful misconduct. Your friend probably heard this from someone who got denied because THEY were fired for misconduct specifically.

0 coins

ohhhh ok that makes way more sense. so my friend probably did something wrong and just told me the wrong info lol

0 coins

Yep extremely common misconception. California EDD actually approves a significant percentage of claims from terminated workers. Employers have to demonstrate misconduct with real evidence, not just say 'we fired them.

0 coins

Something important that nobody mentioned yet - once you file, EDD will send your employer a Notice of Unemployment Insurance Claim Filed. Your employer then has 10 days to respond and contest. If they don't respond in time, EDD typically approves your claim without further investigation. Sometimes employers just don't bother contesting or miss the deadline.

0 coins

Oh interesting, so there's a chance my employer just doesn't respond and it gets approved faster?

0 coins

Definitely possible especially with bigger companies where HR is overwhelmed. Smaller companies that are angry about the situation tend to respond more aggressively. Either way file your claim and let the process play out.

0 coins

my employer didnt respond to my layoff claim and i got approved super fast. was like 2 weeks total

0 coins

The California EDD system is an absolute NIGHTMARE to deal with when your claim gets contested. I was fired over a year ago and my former employer lied about the circumstances. EDD put my claim in adjudication and I couldn't get anyone on the phone for WEEKS. I'm talking calling at 8am on the dot and still getting cut off. Called hundreds of times no exaggeration. Eventually found out about Claimyr from someone else who had the same problem - claimyr.com - and finally got through to an actual EDD agent who could see the notes on my claim. Turns out my adjudication interview had been scheduled and the notice got lost in the mail. Would have missed it completely if I hadn't called. Use whatever tools you have to get through to EDD, the regular phone lines are genuinely broken.

0 coins

Missing an adjudication interview sounds terrifying. What happens if you miss one of those?

0 coins

If you miss your adjudication interview without rescheduling they can deny your claim based on failure to respond. It's awful. Make sure your mailing address is correct in UI Online and also check your online inbox regularly because they send notices both ways.

0 coins

You can request to reschedule an adjudication interview if you miss it but you need to act fast and have a good reason. This is exactly why it's important to keep your contact info updated AND to check both your physical mail and UI Online messages.

0 coins

filed for UI after getting fired from my office job two years back. honestly the process wasn't as bad as I expected. filled out the online form which took maybe 45 mins. got a notice within a week. employer didn't contest and I got approved. first payment hit my Bank of America EDD debit card about 3 weeks after filing. just wanted to share a positive story since there's a lot of scary stuff in this thread lol

0 coins

This actually makes me feel so much better, thank you for sharing! Did you do anything specific to make the process go smoothly?

0 coins

Honestly just answered everything accurately and completely. Didn't try to spin anything or leave stuff out. I think being straightforward works in your favor with EDD.

0 coins

One thing to keep in mind - your weekly benefit amount is based on your highest earning quarter during your base period, not your most recent pay. So if you had a period where you were making less (like part time or a gap) it could affect your benefit amount. California EDD has a benefits calculator on their website where you can estimate what you might receive before you even file.

0 coins

I didn't even think about the benefit amount calculation. I was just focused on whether I'd qualify at all. I'll check that calculator.

0 coins

Maximum weekly benefit in California right now is $450 per week for up to 26 weeks. Most people don't get the max - it depends entirely on your prior earnings. But knowing the estimate helps with budgeting while you wait.

0 coins

Also - if your claim is approved but you find part time work while collecting, you can still receive partial benefits. California EDD lets you earn up to 25% of your weekly benefit amount without any reduction. Anything above that gets deducted dollar for dollar.

0 coins

does your old job find out that u filed for unemployment against them

0 coins

Yes, EDD notifies your former employer when you file. That's how the process works - they get a chance to respond and contest or confirm the separation reason. So yes they'll know you filed.

0 coins

ugh. ok. was hoping they wouldn't find out but i guess that makes sense

0 coins

Don't let that stop you from filing though. It's your legal right to apply for benefits you've paid into through your payroll taxes. Employers are used to this and it doesn't expose you to any legal liability for filing a claim.

Update for OP and anyone else dealing with EDD phone issues during adjudication - I mentioned Claimyr earlier and want to add that the video demo at https://youtu.be/JmuwXR7HA10 really does explain it well. When my claim was stuck in adjudication the most important thing I needed was just to find out what stage it was at and whether I needed to submit anything. Being able to actually talk to an EDD agent through claimyr.com made all the difference because the online portal doesn't show you enough detail about where your case actually stands.

0 coins

I'm bookmarking Claimyr just in case my claim gets complicated. Really hoping it goes smoothly but good to have options.

0 coins

Same, saving this for later. My roommate has a claim that's been in adjudication for 5 weeks and she can't get through on the phone at all. Sending her this thread.

0 coins

went through this whole thing 6 months ago. the hardest part for me was the not knowing. like once i understood the process and knew my claim was moving forward i felt so much better even tho i still had to wait. check your UI Online account every single day. EDD updates it when things change and sometimes you get information there before a letter arrives.

0 coins

The not knowing is exactly what's killing me right now. My brain is jumping to worst case scenarios.

0 coins

Totally normal to feel that way. Just keep certifying on time every two weeks once you get approved - missing a certification period is a really easy mistake to make and it can mess up your payments.

0 coins

oh yeah certifying on time is SO important. i missed one once and had to call to get it reopened and that was a whole annoying process

0 coins

I want to address something - someone earlier said max benefit is $450/week but I want to clarify that's actually the maximum weekly unemployment benefit amount in California as of 2025. Your actual amount depends on your base period earnings. Also just to be clear about the job search requirement - you need to list 3 job search contacts per week on your biweekly certification. If you're in a licensed trade or profession some exceptions apply but for most workers it's 3 per week minimum.

0 coins

So when I certify every two weeks I'm reporting 6 job search contacts total for that period?

0 coins

Exactly right. 3 per week × 2 weeks = 6 contacts per biweekly certification. Keep a running log with dates, company names, position titles, and how you applied. EDD doesn't usually audit it but you need to be prepared to prove it if they do.

0 coins

Good clarification. The job search log requirement is something a lot of first time claimants miss or underestimate. Keep detailed records from day one.

0 coins

Just want to throw in - if your termination is contested and goes to an appeal hearing (not just adjudication but an actual Administrative Law Judge hearing) you're allowed to bring a representative. You don't need a lawyer but you can have one. Many people represent themselves successfully at EDD appeals hearings when they have good documentation. Don't be scared of the appeals process if it comes to that.

0 coins

Good to know about being able to bring someone. I'd want my partner there for moral support at minimum.

0 coins

Your partner can attend but as a 'witness' with limited participation unless you designate them as your authorized representative beforehand. Look up EDD CUIAB appeal hearing rules before going in - knowing the format helps a lot.

0 coins

I went through an appeal hearing without a lawyer and won. The ALJ was actually pretty fair and just wanted to hear the facts. Having organized documentation made a huge difference - I had a whole folder with everything in chronological order.

0 coins

OP hope your claim goes smoothly. Just remember even if you get denied initially don't give up. The appeals process exists for a reason and a lot of initial denials get reversed on appeal especially for terminations where misconduct is disputed. You've got this.

0 coins

Thank you everyone in this thread seriously. I went from complete panic mode to actually understanding what to do. Filing my claim tonight.

0 coins

Good luck! Come back and update us. And seriously document everything about your termination while it's still fresh in your memory - dates, conversations, any emails or texts. You might need it later.

0 coins

You got this. The system is clunky and slow but it does work. File tonight, certify on time, keep up your job search log, and don't ignore any mail or UI Online messages from EDD. You'll get through it.
