I was fired from my job - can I still get California EDD unemployment benefits?
So I got let go from my job last Tuesday and I'm honestly in shock still. I worked at a distribution warehouse for about 2 years and my manager said I was being terminated for 'performance issues' but honestly I feel like it was completely unfair - I never got any written warnings, no corrective action plan, nothing. Just walked in one day and HR handed me a separation notice. I've heard different things from different people about whether you can even collect unemployment if you get fired versus quitting. My neighbor said I definitely can't get anything because I was fired but my cousin said she got unemployment after being fired from her retail job so now I'm confused. I went to the California EDD website and started looking at how to file but I'm worried if I apply and my former employer contests it, I'll just automatically lose. Does California EDD even let you collect UI benefits when you're terminated for cause? I really need this money to cover rent while I look for something new. Has anyone gone through this before and can tell me what actually happens when you file after being fired?

Your neighbor has this completely wrong - being fired does NOT automatically disqualify you from California EDD unemployment benefits. The key distinction EDD makes is between being fired for 'misconduct' versus being fired for reasons that don't meet that legal threshold. Performance issues, being a bad fit, restructuring, or even simple mistakes generally do NOT count as misconduct under California UI law. Misconduct specifically means intentional or willful violations of your employer's reasonable expectations - things like theft, harassment, deliberately ignoring safety rules, etc. If you genuinely had no written warnings and no formal discipline process, your case sounds like it could be approved. File your claim ASAP because there's a waiting period before benefits start and every day you delay costs you money.

AuthorThis is such a relief to read. So even though my termination paperwork says 'performance' I might still qualify? I was so scared to even apply.

yeah same thing happened to me, fired for 'not meeting quotas' and I got approved no problem. California EDD asked me some questions about what happened and that was it

This is accurate. California EDD will conduct a phone interview with both you AND your former employer to determine what actually happened. The burden is somewhat on the employer to prove misconduct - they need documentation. No written warnings usually means they can't prove it.

File your claim TODAY if you haven't already. Go to UI Online at https://myedd.edd.ca.gov and create an account. When you fill out the separation section, be honest and describe exactly what happened - that you were told it was performance related but received no prior warnings or documentation. Don't embellish, don't minimize. Just facts. California EDD will send a questionnaire to your employer asking them to explain the termination. If they can't provide documentation of disciplinary steps, their 'fired for cause' claim falls apart pretty fast.

AuthorI just logged into UI Online and started the application. It's asking about my reason for separation and I'm not sure exactly how to word it. Should I say terminated or discharged?

Kara Yoshida
Use 'discharged' - that's the official California EDD term for being fired. Then explain in the text box that you were discharged and that no prior written warnings or formal corrective action was provided before termination.

also make sure you have your last employer's address and EIN number handy when you file, makes the process way smoother

I went through almost this exact same thing eight months ago - fired from a logistics company, they claimed it was performance, I had zero documentation of any issues in my file. I was panicking trying to reach California EDD to ask questions before my phone interview and could NOT get through on the main line. Kept getting busy signals or automated disconnects after waiting forever. Someone in a thread like this mentioned Claimyr - it's a service at claimyr.com that gets you connected to an actual California EDD agent without sitting on hold for hours. There's a video showing how it works at https://youtu.be/JmuwXR7HA10. I used it before my eligibility interview to clarify a question about what I should say regarding my separation and the agent I spoke to was incredibly helpful. Ended up getting approved. Seriously worth looking into if you need to talk to someone at EDD before your interview.

never heard of this before, does it actually work? I've been trying to reach EDD for two weeks about a different claim issue

Yes it worked for me - I was shocked honestly. Got connected to a real agent within a reasonable time instead of the endless hold loops. The video demo on youtube walks you through what it does.

wait so your employer can actually FIGHT your unemployment claim?? I had no idea they could do that. Now I'm stressed about my own situation. I quit my job last month because the conditions were unbearable and I'm wondering if that's even worse than being fired??
0 coins
Kara Yoshida
Yes employers can contest claims but it doesn't mean they win. And quitting is actually a different issue - California EDD calls it 'voluntary quit' and you generally need to show 'good cause' to collect. Things like unsafe working conditions, harassment, significant changes to your job duties or pay can qualify as good cause for quitting. You should file and explain your circumstances.

Oh wow I didn't know unsafe conditions counted. My situation was actually pretty bad, like genuinely unsafe. I'm going to file today.

One thing people often miss when they file after being fired: California EDD will schedule what they call an 'eligibility interview' by phone - sometimes they call it a fact-finding interview. This is NOT an appeal, it's just EDD gathering information before making their initial determination. Both you and your employer will answer questions separately. Tips for your interview: stick to facts, don't get emotional or bash your employer, focus on the lack of documentation and process, and if your employer claims they gave verbal warnings, politely state you were never formally disciplined. The absence of a paper trail is genuinely significant in these determinations.

Mateusius Townsend
AuthorSo this interview happens before they decide? I thought the decision came first and then you could appeal. Glad I know this now.
0 coins
Caesar Grant
Correct - the interview is part of the initial determination process for disputed separations. If you disagree with the determination AFTER the interview, then you can file an appeal within 30 days. But ideally the interview goes well and you get approved without needing to appeal.

I had one of these interviews and honestly it was less scary than I expected. The EDD interviewer was pretty neutral and just asked what happened.

same, they're not out to get you, they just want both sides of the story

my coworker got fired for being late too many times and she still got unemployment. edd told her that attendance issues dont automatically count as misconduct if the employer never gave her a formal last warning before firing. so your performance thing sounds even more likely to be approved imo

Mateusius Townsend
AuthorThat's actually really similar to my situation. I had some days where my output numbers were lower but nobody ever sat me down and said your job is at risk.

attendance is a gray area tho tbh i know someone who got denied for chronic tardiness so it really depends on the specifics

Here's what happens procedurally after you file: 1) EDD reviews your application and sends both you and your employer a questionnaire about the separation. 2) Based on those responses, EDD may schedule a phone interview if the separation is disputed. 3) EDD issues a Notice of Determination. 4) If approved, you start receiving benefit payments. 5) If denied, you have 30 calendar days to file an appeal with the California Unemployment Insurance Appeals Board. The whole initial process from filing to determination can take 3-5 weeks when there's a dispute. Keep filing your weekly certifications the whole time even if your claim shows as pending - you'll get paid retroactively for those weeks if approved.

Mateusius Townsend
AuthorWait I need to keep certifying even before I'm approved? I didn't know that, thank you!

Beatrice Marshall
how do you certify each week? is it through the same UI Online website?
0 coins
Lena Schultz
Yes, log into UI Online each week during your certification window (usually Sunday-Saturday) and answer the questions about whether you worked, earned any wages, and were available for work. You can also do it by phone through EDD Tele-Cert at 1-866-333-4606.

PERFORMANCE ISSUES is basically employer code for we dont have real documentation to fire you for a legitimate reason. i worked in HR for years and companies use vague language like that specifically when they cant prove actual misconduct. California EDD knows this. your case sounds solid honestly
0 coins
Mateusius Townsend
AuthorFormer HR person saying this actually makes me feel way more confident. Thank you.
0 coins
Caesar Grant
This is accurate - vague termination language without documentation tends to favor the claimant in EDD determinations. Employers who want to avoid paying unemployment need to show a pattern of documented discipline, final warnings, and clear expectations that were violated.

Melina Haruko
can i ask a kinda related question - if you get fired and your employer says you quit does edd figure out who's telling the truth? because my boss is literally telling people i resigned when i was definitely fired
0 coins
Kara Yoshida
Yes this happens and EDD does investigate conflicting accounts. This is exactly why the fact-finding interview exists. Bring any evidence you have - texts, emails, the separation notice, anything that shows you were terminated rather than resigned. If your employer sent you home or stopped scheduling you, that pattern matters too.

I have a text from my supervisor saying my position was being eliminated so I think that helps right?
0 coins
Caesar Grant
That text is strong evidence. Save it, screenshot it, and reference it during your eligibility interview. A message saying your position was eliminated is documentation of involuntary separation.

went thru this last year. got fired from restaurant management, they said it was performance. no write-ups, no PIP, nothing. filed with California EDD, had my phone interview, got approved within about a month. the key thing the EDD interviewer kept coming back to was whether i had ever been formally warned my job was at risk. answer was no, and that seemed to really matter in my favor

Mateusius Townsend
AuthorThis is exactly my situation. Did you do anything to prepare for the phone interview?

I wrote out a timeline of my employment - when I started, any positive feedback I'd received, and specifically the fact that I was never given a formal warning. Kept it in front of me during the call so I didn't forget anything.

AuthorThat's a great idea, I'm going to do the same thing. Making notes right now actually.

one thing that tripped me up - when EDD asks about your job search activities you need to be actually doing them and keeping a log. you can't just collect benefits and sit at home. you need to be applying to jobs and documenting it because EDD can audit your job search records. just something to be aware of before you start receiving payments
0 coins
Mateusius Townsend
AuthorHow many job contacts do you need per week? I've seen different numbers online.
0 coins
Saanvi Krishnaswami
currently it's 3 job search activities per week in California. can be applying to jobs, attending a job fair, doing a resume workshop, etc. look up the EDD job search requirements page for the full list of what counts
0 coins
Caesar Grant
Correct - 3 job search activities per week is the current requirement. Keep a log with dates, company names, position titles, how you applied, and contact information. EDD can request this at any time.

ngl the california edd phone system is absolutely brutal to deal with. took me almost 3 weeks to get through to someone about my claim when it was in adjudication. i eventually used claimyr.com to get connected and it saved me so much frustration. they have a youtube video that shows exactly what the service does - https://youtu.be/JmuwXR7HA10 - if anyone is struggling to reach an actual EDD agent i'd recommend at least checking it out

Just want to add for OP - document everything right now while it's fresh. Write down the exact conversation when you were fired, what was said, who was present, what the stated reason was, whether any documentation was given to you. If you received any positive performance reviews in the past, find copies of those. If coworkers witnessed anything relevant, note their names. You probably won't need all of this but if your claim gets denied and you need to appeal, having detailed notes you made immediately after the fact is really valuable.
0 coins
Mateusius Townsend
AuthorI actually got a paper saying 'termination effective immediately' but it just says performance issues with nothing specific. Is that helpful?
0 coins
Pedro Sawyer
Yes keep that. The vagueness of it actually supports your case - if there were documented specific performance failures they'd be listed. Vague language = no documentation trail.
0 coins
Kara Yoshida
Agree with this completely. Vague separation paperwork is frequently a sign that the employer had no formal disciplinary process, which undermines any misconduct claim they might try to make.

does anyone know if your benefits amount is based on how much you made at the job you got fired from or some average of all your recent jobs? asking because i had two jobs and got let go from one
0 coins
Caesar Grant
California EDD calculates your weekly benefit amount based on your wages during a 12-month 'base period' which typically covers the first four of the last five completed calendar quarters before you filed. So both jobs' wages would factor in if they both fell within your base period. Your maximum weekly benefit is currently up to $450 per week in California.
0 coins
Reina Salazar
oh interesting so my part time job wages count too, good to know
0 coins
Lena Schultz
Right, and if your base period wages aren't enough to qualify, you can request an alternate base period using your most recent quarters. Worth asking EDD about if your regular base period wages are low.

I've been following this thread and just want to say I was in a very similar spot 6 months ago. Fired unexpectedly, felt completely lost, wasn't sure I'd qualify. Filed anyway and was approved. It genuinely helped me stay afloat while I job searched. California EDD isn't perfect but the benefits are there for exactly this situation. Hang in there and file if you haven't already.

Just to throw a slightly different perspective in - I've heard that some employers will fight unemployment claims basically as a matter of policy even when they know they'll lose, just to make it harder for employees. If that happens to you don't get discouraged. An initial denial is not the end - the appeals process through the California Unemployment Insurance Appeals Board is a real option and many people win their appeals. The administrative law judges who hear appeals are independent from EDD and actually read all the evidence.
0 coins
Mateusius Townsend
AuthorGood to know. Honestly my old company is pretty big and I could see them doing exactly that.
0 coins
Mae Bennett
yeah big companies often have third party unemployment claim management companies that fight everything automatically. don't take it personally if you get denied initially, just appeal
0 coins
Mason Lopez
Exactly. An automatic denial isn't a judgment that you did something wrong - it's often just a mechanical response. The appeals process is where the actual evidence gets considered.

random tip - when you have your eligibility interview, answer the questions directly and don't volunteer extra information. Don't say more than what's asked. Keep it factual. The more you explain and elaborate the more potential issues you introduce. Short, factual, direct answers about what happened.

you can absolutely explain the key fact that you had no warnings. that's worth stating clearly. just don't start listing every grievance you have with the company or going into tangents
0 coins
Lena Schultz
Since you mentioned your former employer might contest - know that even if your claim gets flagged and goes into what California EDD calls adjudication, that's still not an automatic denial. Adjudication just means EDD needs to investigate further before making a decision. Your claim is basically in a holding pattern while they gather info. Keep certifying weekly during adjudication. The process can slow things down to 4-6 weeks sometimes but a claim in adjudication still gets resolved - usually with an eligibility interview. Use that time to gather documentation.
0 coins
Mateusius Townsend
AuthorMy claim already says 'pending' - is that the same as adjudication?
0 coins
Lena Schultz
Pending can mean a few things at first - it might just be in initial processing. If it goes into adjudication specifically you'll usually see that noted or you'll receive a letter from EDD. Either way keep certifying.

FIRED FOR PERFORMANCE with no write ups is basically the most common unemployment situation there is in california and the vast majority of people in that situation get approved. california is also an at-will employment state so employers fire people all the time without documentation and then try to claim misconduct to avoid unemployment - edd sees through this constantly. you are going to be fine. just file, be honest, show up for your phone interview

One last thing - if you need to speak with a California EDD agent at any point during this process and can't get through on the phone, that Claimyr service I mentioned earlier (claimyr.com) is genuinely the most reliable way I've found to get actual human help from EDD.
