Fired for no reason - can I get California EDD unemployment benefits?
So I got let go from my job last Tuesday and honestly I'm still in shock. I worked at this logistics company for almost two years, never had a write-up, never missed a shift, and my supervisor calls me into the office and just says they're 'moving in a different direction' and that's it. No warning, no PIP, nothing. They handed me a box and walked me out. I keep going back and forth wondering if I even qualify for unemployment since they fired me - I always thought unemployment was only for layoffs? A coworker told me I probably won't get anything because I was terminated and not laid off, which has me panicking. I already filed a claim on UI Online but I have no idea what to expect from California EDD. Do I actually have a shot at getting approved if I was fired without any real reason given? Has anyone been through something like this?

Yes, you absolutely can qualify! A lot of people have this same misconception that being fired automatically disqualifies you from California EDD unemployment benefits. That's not how it works. California EDD looks at the REASON for the termination, not just the fact that you were terminated. If you were fired without cause - meaning they didn't let you go for misconduct, policy violations, or something you deliberately did wrong - you're likely eligible. 'Moving in a different direction' sounds like a business decision on their end, not a performance or conduct issue on yours. File your claim and be honest in your answers. The key question EDD will ask is whether you were fired for misconduct.

AuthorThis is such a relief to read. I was so stressed thinking I'd automatically be denied. So as long as I didn't do anything wrong, the fact that they fired me shouldn't disqualify me?

yeah this is right. my brother got fired 'without cause' and collected UI for like 5 months no problem. EDD just cares about WHY they fired you

To add to this - when you fill out your UI Online claim, there's a section asking about the reason for separation. Just describe exactly what happened. Don't try to guess what they want to hear, just be factual. 'Employer stated they were moving in a different direction, no reason or misconduct was cited.' That's your statement.

wait so even if ur fired u can get unemployment?? i thought that was only for layoffs this whole time omg

Really common misconception! Layoffs definitely qualify, but so does being fired without cause. The only thing that disqualifies you is being fired FOR misconduct - like stealing, harassment, willful violation of company policy, that kind of thing. Just being let go because the company wants to doesn't count as misconduct.

wow okay good to know. i got laid off last year and went thru this whole process so i kinda know how EDD works but i didnt realize fired people could also collect

Filing was the easy part for me when I was in your situation - it was actually getting someone at California EDD on the phone when I had questions that nearly broke me. I called for 11 days straight and couldn't get through. Someone in another thread mentioned Claimyr and I was skeptical at first but it genuinely works. You go to claimyr.com, they basically hold your place in EDD's phone queue and call you back when an agent is available. There's a video walkthrough at https://youtu.be/JmuwXR7HA10 if you want to see how it works before trying it. Saved me so much frustration when my claim got flagged for adjudication.

AuthorI haven't needed to call yet but I'm bookmarking this just in case. My claim is sitting at 'pending' right now and I'm already dreading having to deal with the phone situation if something goes wrong.

I thought the same thing until I tried it. I was pretty desperate after two weeks of busy signals. The call back actually happened and I talked to a real EDD agent who resolved my issue same day.

Can confirm Claimyr is real, used it when my weekly certifications stopped processing. claimyr.com - got through to an agent within a few hours instead of calling for days.

okay so im going thru almost the EXACT same thing right now. got fired from my restaurant job two weeks ago, manager just said 'its not working out' and that was literally it. filed with california edd but now my claim says theres an 'interview scheduled' and im freaking out. does that mean im being denied???
0 coins
Jamal Anderson
An interview scheduled doesn't mean denial - it's actually a normal part of the process when there's a termination involved! California EDD often needs to speak with both the claimant and the former employer to understand the circumstances of the separation before making a determination. Just be straightforward in the interview, stick to the facts, and explain that no specific reason or misconduct was cited when you were let go.

oh okay that makes me feel better. so they call both me AND my old job? what if my employer lies and says i did something wrong

Liam McGuire
If your employer claims misconduct in the interview and you dispute it, EDD will weigh both sides. Make sure you have any documentation that supports your side - emails, your schedule history, any positive performance feedback. If it goes to adjudication and you get denied, you have the right to appeal within 30 days.

same misconception i had. when i got fired my friend told me dont even bother filing, ur wasting ur time. filed anyway and got approved in like 3 weeks. employer said the same vague stuff about business direction and EDD sided with me

QuantumQuest
AuthorThis is so reassuring honestly. Did they ask you a lot of questions when you filed? Like did you have to go into a lot of detail about why you were fired?

mostly just the UI Online form questions. had to explain the circumstances of the termination. kept it simple, said no written warnings no misconduct just told me they were letting me go. approved pretty quick after that

lucky you!! mine took 7 weeks because my employer disputed it and said i violated attendance policy which was completely made up. had to appeal and everything

To answer your original question directly: yes, being fired without cause is called a 'non-misconduct separation' under California EDD rules. You remain eligible for UI benefits as long as you meet the base period earnings requirements (which it sounds like you do with 2 years at the same company) and you're able and available to work. The misconduct standard in California is actually pretty high - it requires a willful or wanton disregard of the employer's interests. Vague terminations like 'moving in a different direction' almost never meet that threshold.

QuantumQuest
AuthorThe 'able and available to work' part - does that mean I need to already be applying for jobs? I filed my claim but haven't started job searching yet because I wanted to understand what I was entitled to first.
0 coins
Fatima Al-Hashemi
Yes, once your claim is approved and you start certifying weekly, California EDD requires you to complete job search activities each week - currently 3 employer contacts per week for most claimants. You'll log these when you certify. I'd start now so you're in the habit when your claim kicks in.

Also make sure you're registering with CalJOBS (the state's job search portal) if you haven't already. It's tied into your EDD requirements and sometimes EDD will ask for your CalJOBS registration number during the process.

I work in HR so let me give you the other side of this since I see a lot of these situations. When an employer fires someone and says 'moving in a different direction' that is almost always code for an at-will termination with no documented cause. From a California EDD perspective this is actually one of the cleaner situations for a claimant because the employer typically has nothing to submit to contradict your account. They can't claim misconduct if they didn't document any. Your odds of approval here are genuinely high.
0 coins
QuantumQuest
AuthorThat's really interesting context. So the fact that they gave no real reason actually works in my favor with EDD?
0 coins
Dmitry Volkov
In most cases yes. If an employer claims misconduct after the fact but has no written documentation - no disciplinary records, no PIPs, no written warnings - EDD tends to give more weight to the claimant's account. It's hard to prove misconduct with zero paper trail.

this is helpful for my situation too. my manager never wrote anything up, never gave me any warnings in writing. if they try to claim misconduct now they have nothing to back it up

This isn't accurate in 2025 - processing times have improved significantly from the pandemic era backlog. Many straightforward claims without employer disputes are processed within 2-3 weeks now. Claims that go to adjudication do take longer but the massive delays people experienced in 2020-2021 are not the current situation.

my cousin filed in february and waited 6 weeks so
0 coins
Mei Zhang
6 weeks when there's an employer dispute is actually not unusual. claims where the employer disputes or where there's a termination involved sometimes take longer because of the interview process. that's still way better than what it used to be

Giovanni Ricci
Also wanted to mention - once you get your approval letter, do NOT delay setting up your UI Online account for certifications if you haven't already. You certify every two weeks and if you miss a certification week you can lose those benefits. Set a calendar reminder for your certification dates as soon as you know them.
0 coins
QuantumQuest
AuthorWait, every two weeks or every week? I thought I saw something about weekly certifications somewhere?
0 coins
Giovanni Ricci
You certify bi-weekly (every two weeks) but you're certifying for each week individually in the form - so you answer questions about week 1 and week 2 in the same sitting. The schedule is bi-weekly though, not weekly.
0 coins
Fatima Al-Hashemi
Correct. And the questions ask about each week separately - did you work, did you earn any money, were you able and available, did you look for work. Answer carefully and honestly for each individual week even though you submit them together.

One thing worth knowing: your former employer will receive a notice from California EDD asking about the reason for your separation. They have a set window to respond. If they don't respond or respond and confirm there was no misconduct, your claim moves forward. If they respond claiming misconduct, that's when it goes to adjudication and you may be scheduled for a phone interview. Either way, the process is designed to get to the truth of the situation.

Sofia Martinez
my employer responded claiming misconduct and it was infuriating because nothing they said was true. went through the whole interview process and EDD still approved me. the interview is actually your chance to tell your side and EDD does listen

QuantumQuest
AuthorGood to know the employer isn't just automatically believed. I was worried they could say whatever they wanted and I'd have no recourse.

you have full right to respond and present your side. just stay calm, stick to facts, avoid being emotional even if you're furious (i was VERY furious). just factual statements go a long way

honestly the california edd system makes no sense to me. my friend got approved for unemployment after being fired but then got an overpayment notice three months later saying she made too much during her base period. like how does that even happen after they already approved you
0 coins
Fatima Al-Hashemi
Base period overpayment issues are separate from the initial approval - they can happen if EDD later discovers that wages were reported incorrectly or if the employer submits corrected wage records after the initial determination. It's unfortunately more common than people realize. If your friend got an overpayment notice she should appeal immediately if the calculation seems wrong.

Ava Thompson
she was so stressed. she already spent the money on rent and bills obviously
0 coins
Jamal Anderson
If she can't repay it all at once she can request a repayment plan with California EDD, or if it was EDD's own error and she had no way to know the payment was wrong, she may be able to request a waiver of the overpayment. Worth looking into - overpayment waivers are a real option in certain circumstances.

For what it's worth I was in almost this exact situation 8 months ago. Fired from a tech support role, no written reason, just escorted out. Filed with California EDD, went through the whole process including an interview, and was approved. Received benefits for about 4 months before finding a new job. The system works when you use it correctly. File, be honest, document everything, and don't let anyone talk you out of applying because you were fired.

AuthorThis is exactly the kind of real experience I needed to hear. Did the phone interview feel really intimidating?

A little nervous going in but it was actually pretty conversational. The EDD interviewer asked me to describe what happened, I explained it clearly, they asked a few follow up questions, and that was it. Maybe 20 minutes total. Got my approval letter about a week after.

Has anyone had trouble actually reaching EDD by phone when they have questions after filing? I have a claim in right now from a termination situation and my status has been sitting at pending for almost 3 weeks with no updates and I cannot get anyone on the phone

This is exactly when Claimyr is worth trying. I mentioned it earlier in the thread - claimyr.com basically navigates EDD's phone system for you and gets you to an actual agent. There's a demo at https://youtu.be/JmuwXR7HA10 that shows how it works. When my claim sat pending for weeks and I couldn't get through, this is what finally got me answers.

Thank you, going to check that out right now. Three weeks of busy signals is absolutely destroying me mentally.

Also try calling right at 8am when the phone lines open. The queue fills up very fast but calling the exact moment they open gives you a better shot at getting in before it fills. Still not guaranteed but better odds than calling mid-morning.

I've tried the 8am thing twice and still got the 'we cannot take your call at this time' message both times. Definitely trying claimyr.com

just want to validate OP that the 'fired vs laid off' confusion is so common and honestly EDD's own website doesn't make it very clear. the important thing is whether your separation was your FAULT. layoff = company's decision = typically eligible. fired for cause/misconduct = your fault = typically not eligible. fired without cause = company's decision even if framed as a firing = typically eligible. your situation sounds firmly in that last category.
0 coins
QuantumQuest
AuthorThat framing actually makes it click for me. It's really about whose decision it was and whether I did something wrong, not the specific word used for the separation.
0 coins
Sofia Martinez
exactly. and 'moving in a different direction' is language employers use specifically to avoid documenting a reason, which ironically makes it very hard for them to later claim misconduct to EDD

not related but this thread made me realize i never appealed my EDD denial from last year when i probably should have. they said i was fired for misconduct because i was late three times but i had documentation that my schedule had been changed without notice and i just gave up. is it too late to do anything
0 coins
Fatima Al-Hashemi
Unfortunately the standard appeal window is 30 days from the Notice of Determination. If it's been a year that window is almost certainly closed. However if there were exceptional circumstances that prevented you from appealing in time you can sometimes request a late appeal - but it would need to be a compelling reason. Might be worth contacting an employment law clinic to see if any options remain.

Zainab Yusuf
yeah figured it was probably too late. still frustrating. i had the evidence and just got overwhelmed and didn't fight it
0 coins
Jamal Anderson
For what it's worth, if you face a similar situation in the future, please appeal. The appeal process exists exactly for situations like yours and EDD's initial determinations can and do get reversed, especially when there's documentation the claimant can present.

Quick update type comment - I was in OP's exact situation about 6 weeks ago and just got my approval letter yesterday. Filed after getting fired with no stated reason, went through an interview, employer apparently didn't claim misconduct, and I was approved. The benefit amount was close to what the calculator on EDD's site estimated based on my wages. For anyone scared to file after a termination: just file.

One last practical note for OP and anyone else reading: keep records of everything from here forward. Screenshot your UI Online claim status regularly. Save every letter EDD sends you. Log every phone call attempt with the date and time. If your claim goes sideways and you need to appeal, that documentation trail matters. Also start your job search log now even if you don't technically need to submit it until you're certifying - it's easier to maintain from the start than to reconstruct later.

AuthorWill do. I've been screenshotting everything which I'm glad about now. Thanks to everyone in this thread - I came in here panicking and I feel so much better about where things stand.
