Can you get disability and unemployment at the same time through California EDD?
So I've been going back and forth trying to figure this out and honestly the California EDD website is not making it easy to understand. Here's my situation: I was laid off from my warehouse job about six weeks ago and filed for regular UI benefits. My claim got approved and I've been certifying weekly without any issues. But then two weeks in I had a pretty serious accident that's going to keep me out of work for at least 2-3 months according to my doctor. My neighbor mentioned I should look into disability through California EDD but I'm still receiving unemployment payments. Can you even collect both at the same time? Like is that even legal? I don't want to accidentally commit fraud or anything but I genuinely don't know how these two programs interact with each other. I've tried calling EDD multiple times but can't get anyone on the phone. Anyone been in a situation like this?

Short answer: no, you generally cannot collect both California EDD unemployment insurance (UI) and State Disability Insurance (SDI) at the same time. They serve different purposes and have conflicting eligibility requirements. UI requires you to be able and available to work, while SDI is specifically for when you CANNOT work due to a medical condition. You can't certify that you're both able to work and unable to work simultaneously. What you should do is stop certifying for UI benefits and file a new claim for SDI instead. Make sure you have your doctor complete the physician's certificate portion of the DE 2501 form.

AuthorOkay that makes a lot more sense now. So I need to essentially switch programs? Will there be a gap in payments while I'm waiting for SDI to kick in?

Madison King
There's typically a 7-day waiting period before SDI benefits begin, so yes there could be a brief gap. But don't keep certifying for UI once you're medically unable to work - that's where the fraud issue would come in.

This is the correct answer. The able and available requirement for UI is the key thing. Once you're disabled you no longer meet that requirement.

Going through something similar right now and it's such a confusing system. When I asked about this the EDD rep told me that if you're already on UI and become disabled, you're supposed to stop your UI claim and transition to SDI. The SDI benefit amount might actually be different from your UI amount too - SDI is calculated based on your highest earning quarter in your base period, usually replacing about 60-70% of your wages up to the maximum weekly benefit.

Vanessa Chang
AuthorIs the SDI amount typically higher or lower than UI? I'm trying to figure out financially what this means for me.

Ella Knight
Depends on your earnings history honestly. SDI can sometimes pay more than UI because UI has its own formula and caps. Worth calculating both before you make any decisions, though medically you don't really have a choice if you can't work.

the SDI max benefit in 2025 is higher than it used to be, they updated it. still might not cover all your bills but better than nothing

One thing nobody mentioned yet - if you OVERPAY yourself by continuing to certify for UI after you become unable to work, EDD will eventually figure it out and send you an overpayment notice. I got one of those a while back for a completely different reason and it was an absolute nightmare to deal with. Nearly $4,200 they said I owed back. So please stop your UI claims right away and don't let that happen to you. The programs do NOT overlap.

AuthorYeah that's exactly what I was worried about. I haven't certified since my accident actually so hopefully I'm okay.

Good. Since you haven't certified you should be fine. Just file the SDI claim ASAP because there are time limits on backdating.

overpayment notices from EDD are literally the worst thing ever, my cousin had one and it took 8 months to resolve

Been trying to get through to EDD by phone for the past 3 weeks about a related question and I cannot get anyone on the line. Keeps disconnecting me or saying call volume is too high. Somebody in another thread mentioned a service called Claimyr that helps you actually reach a live EDD agent without sitting on hold forever. Apparently you go to claimyr.com and they basically navigate the phone queue for you. There's a video demo at https://youtu.be/JmuwXR7HA10 if you want to see how it works before trying it. I used it last week and finally got answers about my claim after almost a month of trying on my own.

AuthorWait really?? I've been trying to call EDD for two weeks straight. Does it actually work or is it too good to be true?

I was skeptical too but it genuinely worked for me. Got connected to an actual EDD rep who was able to look at my account and explain exactly what I needed to do. Definitely worth checking out claimyr.com if you're stuck.

Just to add some clarity here because I see some partial info in this thread - the rule is pretty clear in the California UI Code. You must be ABLE TO WORK and AVAILABLE FOR WORK to receive UI benefits. The moment you become medically unable to work, you are legally required to stop claiming UI. Continuing to certify that you're able and available when you're actually disabled is considered fraud regardless of whether you knew the rules. That said, EDD does understand people fall into gray areas and if you proactively stop your UI claim and file for SDI immediately, you're doing the right thing.

AuthorI appreciate the clear explanation. I genuinely didn't know this until this thread. I'll be filing the SDI paperwork today.

Good info. The able and available requirement trips up so many people. Wish EDD made this clearer on their website.

They do have it in the UI handbook but honestly that document is like 40 pages and written in bureaucratic language. Not surprised people miss it.

okay but what about partial disability?? like what if you CAN work but only light duty and your employer won't accommodate you? i've been wondering about this forever. are you supposed to be on UI or SDI in that situation
0 coins
Madison King
That's actually a different scenario. If you can do some work but your employer won't accommodate light duty, you might qualify for a combination situation - but typically SDI would still apply if your doctor has certified work restrictions. Consult with EDD or an employment attorney for partial disability situations, they're complicated.
0 coins
Zoey Bianchi
ugh figures it's complicated. my doctor gave me a 50% work capacity rating and i have no idea what to do with that
0 coins
Sophia Bennett
With a partial work capacity certification your doctor would fill that out on the SDI claim form. EDD can sometimes provide partial SDI benefits in those situations. It's not black and white.

I went through this exact transition last year - was on UI, then injured my back, had to switch to SDI. The process took me about 3 weeks from when I stopped certifying for UI to when my first SDI payment came through. Definitely a stressful gap period financially but it worked out. Make sure your doctor submits their portion of the claim quickly, that's usually the bottleneck in my experience.
0 coins
Vanessa Chang
AuthorThree weeks is a long time when you have bills due. Did you have any issues with the transition being flagged or anything?
0 coins
Christopher Morgan
No issues thankfully. The key was I had already stopped UI certifications before the disability start date, so there was no overlap period for them to question. Clean cutoff made it simple.

Aurora St.Pierre
same experience here, the doctor portion of the form is always what delays everything

Julian Paolo
Agree about the doctor being the bottleneck. Some medical offices are slow to submit that paperwork. Worth calling them to follow up.

does SDI pay the same amount as UI or different? i always get confused by all these different california EDD programs
0 coins
Ella Knight
They use different calculations. UI is based on your base period wages with a specific formula, usually replacing about 45-60% of your weekly earnings up to a max. SDI also uses your highest base period quarter but the replacement rate is 60-70% of wages. The maximums are different too.
0 coins
Grace Johnson
okay so SDI might actually pay MORE? that's wild i didn't know that
0 coins
Madison King
It depends entirely on your individual earnings history. For some people SDI pays more, for others UI pays more. There's no universal answer.

THIS SYSTEM IS SO BROKEN. I have a friend who was in almost this exact situation and she spent MONTHS going back and forth between UI and SDI getting conflicting information from EDD reps every time she called. One rep said she could collect both during a transition period, another said absolutely not, a third said something completely different. She ended up with an overpayment notice because she followed bad advice from an EDD phone rep and they still made her pay it back even though THEIR OWN EMPLOYEE told her wrong info. How is that even legal??
0 coins
Sophia Bennett
Unfortunately EDD reps giving incorrect information doesn't absolve the claimant of overpayment liability under California law, which is genuinely frustrating. Your friend may have had grounds to appeal the overpayment if she could document the rep's advice, but that's a hard thing to prove.
0 coins
Jayden Reed
she didn't have it documented because it was a phone call with no recording. lesson learned i guess but it's INFURIATING

This is why you want everything in writing when dealing with EDD. Screenshot your UI Online account, save every letter, document dates and rep ID numbers when you call.

just adding my experience - i transitioned from UI to SDI back in early 2024 and used Claimyr to get through to EDD to specifically ask about the transition process before i did anything. the agent i spoke to walked me through exactly which forms to file and in what order. really helped me avoid making a mistake. claimyr.com was how i found it after googling how to reach EDD by phone

AuthorI'm going to try this today honestly. I need to speak to someone before I make any moves on this, too much money at stake to guess.

random question but does your employer know you're on disability? like does SDI affect your job or can your employer fire you while you're collecting?
0 coins
Sophia Bennett
SDI is separate from job protection. Your job isn't automatically protected just because you're collecting SDI. You may have protection under FMLA/CFRA depending on your employer size and how long you've worked there, but SDI itself doesn't protect your job. That's a separate legal question.
0 coins
Cassandra Moon
oh wow i had no idea they were separate things. so you could lose your job AND be collecting SDI at the same time?
0 coins
Sophia Bennett
Theoretically yes. If your job protection runs out and your employer moves on, you'd continue collecting SDI until you recover, then potentially UI again after recovery if you don't have a job to return to.
0 coins
William Schwarz
california has more protections than most states but yeah they don't automatically overlap
0 coins
Olivia Evans
Something I haven't seen mentioned - if you recover from your disability and are still unemployed, you can potentially file a new UI claim or reopen your existing claim after SDI ends. So the sequence can be: UI → SDI → UI again. You'd need to meet all the eligibility requirements at each stage but it is possible.
0 coins
Vanessa Chang
AuthorOh that's actually really good to know. So after I recover I might be able to go back on unemployment while I'm job searching again?
0 coins
Olivia Evans
Exactly. Once SDI ends and your doctor clears you, you'd certify that you're again able and available to work and could re-open your UI claim if it's still active, or file a new one if needed. EDD would review your remaining benefit balance.
0 coins
Christopher Morgan
This is correct. I did exactly this sequence. Went back on UI after SDI ended and still had benefit weeks remaining.

Daniel Price
can i ask something kind of related - what if you become disabled BEFORE you file for unemployment? like the layoff and injury happened around the same time
0 coins
Madison King
That's a tricky situation. If you're not able and available to work, you wouldn't qualify for UI at all - you'd go straight to SDI. The determining factor is your medical condition at the time of filing, not just the employment status.
0 coins
Daniel Price
okay so in that case SDI is the right first move not UI. got it
0 coins
Ella Knight
Yeah if you're medically unable to work when the layoff happens, SDI should be filed first. Once you recover and are able to work again, then UI would be appropriate if you're still unemployed.

For anyone finding this thread later - the basic rule is UI and SDI are mutually exclusive. UI = able to work but no job. SDI = unable to work due to disability. You can go back and forth between them as your situation changes but never both at the same time. Get your doctor's paperwork done fast because processing takes a while.

my sister tried to collect both at once a few years ago because she didn't know you couldn't, and EDD caught it during an audit like 14 months later. the overpayment notice was for something like $5,800 and they threatened to refer it for fraud investigation. she was able to show it was an honest mistake and paid it back in installments but it was a really stressful year for her
0 coins
Lauren Johnson
This is a really important cautionary tale. EDD does cross-reference UI and SDI claims and they will catch it, sometimes not immediately but eventually. The interest and penalties on overpayments make it way worse than just dealing with it correctly upfront.
0 coins
Eli Wang
exactly. the original overpayment was bad enough but the stress and uncertainty of not knowing if it would become a criminal matter was so much worse
0 coins
Jayden Reed
EDD absolutely will refer things for fraud prosecution if the amounts are large enough or if they believe it was intentional

one more thing i want to add - when you file SDI make sure you use the EDD website portal SDI Online, not a paper form if you can help it. the paper forms take forever to process and the online portal is faster. also the doctor has their own separate portal to submit their part so make sure they know that
0 coins
Christopher Morgan
This is a good tip. SDI Online definitely speeds things up. The doctor can get an email invite to complete their certification digitally too.

AuthorI didn't know doctors had their own portal, I'll let my doctor's office know when I call them. Thank you!

Has anyone else noticed that when you search for answers to these questions the EDD website always comes up first but never actually answers the specific question you have? I spent two hours on edd.ca.gov trying to find clear info about the UI to SDI transition and couldn't find anything that directly addressed it. Forums like this are the only place to get real answers.

Honestly the best way I've found to get actual answers is talking to a live EDD agent. After struggling to get through by phone for weeks I used Claimyr (claimyr.com) and finally reached someone who could give me a direct answer. The hold queue workaround is genuinely useful.
