I've been on unemployment for about 2 months and my employer originally told me I'd be returning to work on August 1st. There was some kind of issue with their reopening schedule, so now they're bringing me back August 4th instead (just a 3-day difference). When I certified for my benefits this week, one week says "paid" but the week that includes August 1st now shows "pending" status. I reported everything honestly on my certification - said I was scheduled to return but then the date changed. Will EDD still pay me for that pending week? Anyone else had this happen with a changed return-to-work date? I'm stressing about bills since I was counting on both weeks of payment.
I got terminated from my healthcare job in January because I refused to get the COVID vaccine (personal choice). I applied for unemployment right away, but EDD denied my claim stating I was fired for 'misconduct' and not eligible. The denial letter says I violated company policy which was a condition of employment. Has anyone successfully appealed an EDD denial after being fired for refusing the vaccine? What documentation helped your case? I have a religious exemption request that was denied by HR, wondering if that might help my appeal. I've already filed the appeal but my hearing isn't for another 6 weeks. Getting really stressed about bills piling up!
I'm freaking out a bit because I just received notice of my FIRST EVER EDD appeal hearing scheduled for May 18th. I got disqualified back in March because they said I 'voluntarily quit without good cause' (which is NOT true - I was basically forced to resign after they cut my hours to almost nothing). I filed the appeal right away but had no idea what would happen next. The letter says it's going to be a phone hearing with an Administrative Law Judge. Has anyone been through one of these before? What kind of questions do they ask? Should I have a lawyer? I'm so worried I'll mess up and say the wrong thing. I've been without benefits for 7 weeks now and my savings are almost gone. This hearing feels like my last chance to get the benefits I deserve. Any advice from someone who's been there would really help calm my nerves!
My hearing was supposed to be in person pre-covid but I imagine phone is similar. I was super nervous too but honestly its pretty informal. I wrote down all my points beforehand which helped a lot because I get nervous and forget things. BTW my employer didn't even show up to defend their position and I automatically won! Hope the same happens for you!
To answer your follow-up question - yes, my employer did show up with their HR person, but the judge made sure everyone had a chance to speak without interruptions. After the hearing, I received the decision in about 10 days, and my back benefits were processed about a week after that. One thing I didn't mention: the hearing was recorded, so speak clearly and try not to talk over anyone. And remember that constructive discharge (what happened to you with reduced hours) is recognized as good cause to leave a job. The EDD Guide for Appeals specifically mentions this.
I've been dealing with this conditional payment hold for weeks now. EDD flagged my account for ID verification, and I sent in all the required documents through ID.me on February 13th. They confirmed receipt, but my benefits are still on hold! It's March 2nd now and I'm getting really worried about making rent this month. I can see in my UI Online account that the documents were received, but there's no update on when the conditional payment hold will be lifted. Has anyone gone through this recently? How long did it take for your benefits to start flowing again after they received your ID verification? I've tried calling but can't get through the automated system.
When I was going through identity verification last year, I spent TWO MONTHS with no benefits because of EDD's incompetence!!!! I submitted and resubmitted documents THREE TIMES and they still claimed they "never received them" even though I had confirmation emails!!!! The entire system is DESIGNED to deny legitimate claims and make us give up!!!! The only thing that worked was when I contacted my state assembly member's office and they intervened on my behalf. Don't waste your time with their phone system - it's BROKEN ON PURPOSE!!!!
That sounds like a nightmare, I'm sorry you had to deal with that. How do I find my state assembly member? I've never contacted one before.
UPDATE: Just wanted to let everyone know that I finally got through to EDD this morning! I used the Claimyr service that someone suggested here, and it actually worked - got me connected to a live agent in about 20 minutes. The agent confirmed they received my ID verification but it was still in the processing queue. She was able to expedite it while I was on the phone, and my conditional payment hold has been lifted! All my pending payments should be released in the next 24-48 hours. Such a relief! Thanks everyone for your advice.
Had my EDD appeal hearing today with an admin law judge over the phone. Super stressful!! Been waiting almost 2 months just to get this phone interview scheduled after being disqualified for supposedly 'refusing suitable work' (which is NOT what happened). The judge asked tons of questions about my previous job, why I left, and what kind of work I've been looking for. The hearing lasted about 45 minutes. Has anyone gone through this process recently? How long did it take to get the judge's decision after your hearing? I'm literally checking my mailbox every day because I'm down to my last $230 and rent is due next week. Getting desperate here...
One important thing to note: if the judge rules in your favor, your EDD account won't necessarily update right away. Even after you receive the favorable decision letter, it can take 7-10 business days for EDD to process the judge's order and release your payments. If it goes beyond that timeframe, that's when you need to start making calls. Also, if the decision is not in your favor, you have 30 days from the mailing date (not the date you receive it) to file an appeal to the California Unemployment Insurance Appeals Board, which is the second level of appeal.
the whole system is rigged against us regular people. good luck but don't hold your breath. they made me wait 8 weeks just to DENY me again after my appeal hearing. total waste of time.

UPDATE: I finally got through to EDD! The rep said exactly what some of you mentioned - the system flagged my certification because of the return date change. She reviewed my account, confirmed I was still eligible for those days, and manually pushed the payment through. She said it should switch from pending to paid within 24-48 hours. Just sharing in case anyone else runs into this issue!

AuthorI actually tried that Claimyr service someone mentioned above. I was desperate and it worked - got connected to a rep within about an hour instead of spending days redialing.
