EDD claim stuck pending after reporting settlement backpay - how long is normal?

Just certified for my weekly benefits Sunday night and I'm still showing 'pending' status after 3 days. This hasn't happened before - normally my payments switch to 'paid' within 24 hours. The only thing different this time is I had to report some backpay from a legal settlement with my previous employer ($4,200). I included this in the 'other income' section during certification like I'm supposed to. Could reporting this settlement money be why my claim is taking longer to process? How long should I expect to wait before I start worrying? My rent is due next week and I'm getting nervous.

UPDATE: Just wanted to let everyone know that my payment finally switched from pending to paid this morning! Took exactly 5 days. Thanks for all the advice and support, it really helped me not panic while waiting. For anyone else in this situation - yes, reporting settlement money will trigger a review, but it does eventually clear if everything is properly reported.

That's great news! Thanks for coming back to update us. This information will be helpful for others in similar situations.

nice! u got lucky with only 5 days tbh

Glad to hear your payment went through! For future reference, if anyone else is dealing with settlement income, it's worth noting that EDD typically processes these reviews in order of submission. The 5-7 business day timeframe mentioned earlier is pretty accurate for most cases. Just remember to always report any income - even if it causes a delay, it's much better than dealing with overpayment issues later. The system is designed to protect both you and the state from errors.

EDD benefits during school district summer break - will my claim get suspended?

Hey everyone, I'm in a weird situation with my unemployment and need advice. Got laid off from my tech job in January and have been on EDD for about 6 weeks. I just got offered a position with a local school district that starts NEXT WEEK. Here's where it gets complicated - I'll work for only about 3 weeks before summer break, then I'm not paid during summer (June-August), and regular employment resumes in September. I'm definitely taking the job since it's stable long-term, but I'm stressed about the summer period with no income. Will EDD cut off my benefits completely once I report this job, even though I'll have 2+ months with zero income during the break? Can I somehow reactivate my claim just for summer or am I just out of luck? Really worried about how I'll cover rent in July and August if I can't get either unemployment or a paycheck.

Update: I finally got through to EDD today! The agent confirmed what many of you said - I likely won't qualify for benefits during summer break if I have a definite return date in September. BUT she did say if my contract specifically states I'm "laid off" during summer (not just on unpaid break), I could potentially qualify. I'm going to: 1) Ask HR about the specific wording in my contract, 2) Look into summer school IT opportunities, and 3) Set up delivery app gigs as a backup plan. Thanks everyone for all the advice - this community has been so helpful while navigating this mess!

Glad you finally got through to EDD and got some clarity! That's a huge relief just knowing where you stand. The contract wording thing is really important - I've seen cases where districts classify summer as "temporary layoff" vs "unpaid leave" and it makes all the difference for EDD eligibility. Since you're IT support, definitely ask about summer maintenance projects too - a lot of districts do major system updates/upgrades when students aren't around. Even if it's just a few weeks of work, every bit helps bridge that gap. Good luck with everything and thanks for updating us! It's really helpful to see how these situations actually play out.

EDD eligibility after employer changed layoff to termination - can they deny my UI claim?

So my situation is super frustrating. I worked at this marketing agency for over 5 years with a spotless record. Last week, management announced they needed to reduce staff by 20% due to budget cuts. They called me into a meeting and told me I was being laid off with 9 others, and specifically said they 'wouldn't contest unemployment claims' since this was purely financial. They gave me until Feb 15th as my last day and said I'd get 2 weeks severance. But today (just 4 days later!!), I received an email saying they've 'reconsidered' and are now terminating me for cause - citing a day back in NOVEMBER when I arrived 35 minutes late because of a major accident on the freeway. I literally had ONE tardiness in 5+ years! This feels like such a blatant attempt to avoid their unemployment insurance rates going up. I'm freaking out because I have rent and car payments. Can EDD see through this obvious BS or am I going to be denied benefits? Has anyone dealt with an employer pulling this kind of last-minute switch from layoff to termination? What evidence should I gather before my last day?

This is textbook employer manipulation to avoid UI tax increases. I went through something very similar - employer said "budget cuts" then suddenly found "performance issues" right before my last day. Here's what worked for me: File your claim IMMEDIATELY and select "lack of work/layoff" as your reason. In the additional comments section, explain the timeline: "Initially told this was a layoff due to budget cuts on [date], employer changed to termination for cause on [date] citing single tardiness from November." The key evidence that helped my case: - Screenshots of ALL communications (the layoff email, termination email, any company announcements) - Timeline documentation showing the gap between the alleged incident and when it suddenly became "serious enough" for termination - Witness statements from coworkers who heard the original layoff announcement EDD investigators are trained to spot these tactics. The 4-day turnaround from "we won't contest your claim" to "fired for cause" is a huge red flag. Combined with your 5+ year clean record and the fact that only high-paid employees got this treatment, you have a strong case. Stay calm during your phone interview and stick to the facts. You've got this!

I'm dealing with something very similar right now and this thread has been incredibly helpful. My employer laid me off two weeks ago citing "business restructuring" and now they're trying to say it was for performance issues that were never documented or mentioned during my 3+ years there. From what I'm reading here, it sounds like EDD is used to seeing these employer tactics. The advice about documenting everything and being specific about the timeline in your application seems crucial. I'm also going to look into that Claimyr service since getting through to EDD by phone seems nearly impossible on your own. @QuantumQuest - the fact that they specifically told you they wouldn't contest your claim and then changed their story 4 days later is going to work heavily in your favor. That kind of flip-flopping shows their true motivation. You should definitely mention that exact quote during your phone interview. Keep us updated on how it goes! This community has been a lifeline for navigating these situations.

EDD misconduct definition - husband terminated unfairly, will he be denied unemployment?

My husband just got fired from his carpentry job after 3 years with the same company. His boss is claiming "misconduct" but all that happened was he had two tardies in one week because our car broke down. Now I'm worried he'll be denied unemployment benefits. The termination letter just says "violation of attendance policy" but makes it sound way worse than it was. Can anyone explain what actually counts as misconduct for EDD purposes? Will he automatically be denied? We have a mortgage and two kids, so we're really stressed about this. He's already applying for new jobs but it might take a while in his industry right now.

hey just wonderin did your husband get his final paycheck yet? dont forget they have to pay him for any unused vacation days too

Yes, he did get his final check with the vacation payout yesterday. At least they didn't mess that part up! Thanks for checking.

I've been through a similar situation with my employer trying to claim misconduct when it was really just a normal termination. The key thing to remember is that EDD looks at whether your husband's actions were willful and deliberate violations of company policy. Car trouble causing tardiness is clearly beyond his control - that's not misconduct, that's just life happening. Make sure he applies right away and doesn't wait. The sooner he files, the sooner he can start receiving benefits if approved. Also, when he does the phone interview (if there is one), he should focus on the facts: car broke down, he was late twice because of it, and he got fired. Don't over-explain or get defensive - just stick to what happened. The EDD representative will be able to tell the difference between genuine misconduct and an employer trying to avoid paying into the unemployment system. Good luck to your family! It sounds like he has a solid case based on what you've shared.

EDD Money Network Card Delivery Timeline - Anyone Receive Theirs Yet?

Just found out my unemployment claim was approved last week (finally!) and EDD said benefits will be on the new Money Network card. Has anyone actually received one of these new cards yet? My previous UI claim from 2023 was on BoA, so this is all new to me. The EDD rep I spoke with couldn't give me a clear timeline on when to expect the card. My rent is due on the 15th, and I'm getting nervous about timing. Also, do we get any kind of tracking number or notification when it ships? The EDD website just shows 'paid' status but nothing about the card itself.

mine took like 9 days but my roomates took almost 2 weeks, its random

Seems like it really varies. I'm hoping I'll be on the shorter end of that range!

I'm in a similar situation - just got approved for benefits last week and desperately need that card to arrive! Reading through all these responses, it sounds like I should expect anywhere from 7-14 days after my payment shows "paid" status. The lack of tracking is really frustrating when you're counting on this money for basic expenses like rent and groceries. I'm definitely going to set up direct deposit to my bank account immediately once I get the card so future payments are faster. Thanks everyone for sharing your experiences - this thread has been more helpful than anything I could find on the official EDD website!
