EDD wrongly says employer still paying me - How to prove otherwise for appeal?

Hey everyone, I'm in a bit of a pickle with my unemployment benefits. The EDD is saying my employer is still paying me full wages, but that's not true at all. I haven't gotten a dime since I became disabled in February. Has anyone else dealt with this kind of mix-up? I'm planning to appeal, but I'm not sure what kind of proof I need to show them. Any advice on what documents would be most helpful? Also, do I need to mail these in or can I upload them somewhere?

Ugh, classic EDD mess-up. 🙄 You're definitely gonna need some solid proof to get this sorted. Here's what I'd suggest: 1. Get your most recent pay stubs that show zero income 2. Ask your employer for a letter confirming they stopped paying you 3. Print out your bank statements showing no deposits from work You can usually upload this stuff right to the EDD website. Don't mail anything unless they specifically ask you to. And make sure you keep the originals!

This is great advice! I had a similar issue last year and these exact documents helped me win my appeal. 💯

Quick question - how long did it take for your appeal to go through? I'm in the same boat and getting anxious about the wait time.

It took about 6 weeks for me, but I've heard it can vary. Hang in there!

Thanks so much for this! I'll start gathering everything ASAP. Fingers crossed it doesn't take too long to resolve. 🤞

man, the EDD is such a joke sometimes. how do they keep messing up like this?? 🤡

Fr fr, it's like they're playing darts with our claims blindfolded 🎯🙈

Guys, cut them some slack. They're dealing with millions of claims. Mistakes happen.

@profile 6 found the EDD employee lmao 🤣

I actually found a way to get someone on the phone about this kinda thing. There's this site called claimyr.com that has a calling tool. It dials through the phone menu, waits on hold, and then connects you when a real person picks up. It costs $20 but honestly it saved me days of frustration. Here's a video about it: https://youtu.be/1X-mEsLtbmQ

Sounds sketchy. Is it legit?

0 coins

Yeah, it's totally legit. I was skeptical too but it worked like a charm. Saved me hours of hold time.

20 bucks tho? That's steep for something that should be free.

@profile 9 I get that, but for me it was worth it. Time is money, ya know?

Quick tip: when you upload your docs, name them clearly like "Pay_Stub_Feb2025" or "Employer_Letter_NoPayment". Makes it easier for them to find what they need.

idk if this helps but I had to deal with somethin similar last year. turns out my HR dept had messed up and was reporting my status wrong. might be worth checkin with your company's HR to see if they made a mistake on their end?

0 coins

Oh wow, I hadn't even thought of that. I'll definitely give HR a call tomorrow. Thanks for the tip!

Oof, sorry you're dealing with this. The system is so broken. I've been fighting with EDD for months over a similar issue. It's like talking to a brick wall sometimes. 😫

Preach! 🙌 It's like they actively try to make things difficult.

Have either of you tried contacting your local state representative? Sometimes they can help push things along.

Hey OP, just a heads up - make sure you're keeping track of all your communications with EDD. Save emails, write down who you talked to on the phone and when. It'll help if you need to escalate things later.

That's a great idea, thanks! I'll start a log right away.

Not to be that guy, but have you double-checked that your employer actually stopped paying you? Sometimes there can be a lag in payroll systems. Might be worth verifying with your company's payroll department just to rule it out.

0 coins

Yeah, I've definitely confirmed it with payroll. They're as confused as I am about why EDD thinks I'm still getting paid.

0 coins

Ah gotcha. Classic case of government efficiency at work then! 🙃

tldr; EDD thinks OP is getting paid when they're not. Anyone else been through this? What docs helped?

Been there! 😤 When I dealt with this exact situation, I also had to get a "Wage and Employment Verification" form (DE 1326C) filled out by my employer - it's specifically for disability cases. Your HR department should know what this is. Also, if you have any medical documentation showing when your disability started, include that too since it helps establish the timeline. The whole process is frustrating but hang in there - once you get all the right paperwork together, they usually sort it out pretty quickly!

Oh wow, the DE 1326C form - I had no idea that existed! This is super helpful info. Do you remember roughly how long it took once you submitted everything? I'm trying to manage my expectations here since I've already been waiting a while just to get this mess sorted out.

@Malik Jackson This is exactly the kind of detailed info I was looking for! I had no clue about the DE 1326C form - my HR department never mentioned it. I ll'definitely ask them about this tomorrow. Quick question though - did you have to wait for your employer to fill it out before you could submit your appeal, or could you submit the appeal first and then add the form later? I m'worried about missing any deadlines while I m'gathering all this paperwork.

@Carmen Reyes You can definitely submit your appeal first and then add supporting documents later! Don t'wait - EDD has strict deadlines for appeals usually (30 days from when they sent you the determination .)Submit whatever you have now and then keep adding documentation as you get it. The appeal form itself should have a section where you can list what additional docs you re'planning to submit. Better to get your appeal in on time with partial documentation than to miss the deadline waiting for everything to be perfect!

Just wanted to add that when you're dealing with disability-related EDD issues, it's also worth reaching out to your State Disability Insurance (SDI) office directly. Sometimes there's a disconnect between what SDI has on file versus what the unemployment division sees. I had a similar mix-up where my employer was correctly reporting to SDI that I wasn't working due to disability, but somehow unemployment still thought I was getting wages. A quick call to SDI helped them sync up their records. Also, if you're getting any disability payments, make sure you have documentation showing those aren't wages from your employer - EDD sometimes gets confused between disability benefits and regular pay. Good luck with your appeal! 🍀

This is such valuable insight! I never would have thought about the disconnect between SDI and the unemployment division - that makes total sense why these mix-ups happen. The tip about documenting that disability benefits aren't wages is really smart too. Thanks for sharing your experience, this could save OP (and probably a lot of us) from going down the wrong rabbit hole!
