EDD wrongly says employer paying full salary during maternity leave - How to appeal and keep benefits?
Hey everyone, I'm in a bit of a pickle with EDD and could use some advice. I've been on maternity leave and receiving disability insurance payments, but now EDD is saying my employer is paying my full salary (which they're not). I got a letter saying my employer started paying my full salary, but that's incorrect. My employer is only providing supplemental pay on top of what EDD gives me. I'm worried about losing my benefits and don't know what to do. Has anyone dealt with this before? What are the next steps to appeal this and make sure I keep getting paid while on leave?

Ugh, the EDD system is such a mess! I had a similar issue last year. You need to file an appeal ASAP. Don't wait on this or you could lose your benefits. Here's what I did: • Call EDD first thing in the morning (like 8:01 AM) to try and get through • Explain the situation and ask for an appeal form • Fill out the form with ALL the details - dates, amounts, everything • Include a letter from your employer confirming they're only paying supplemental • Send it all certified mail so you have proof they received it • Follow up every week until it's resolved It's a pain, but you gotta be persistent. Good luck!

•This is solid advice 💯 I'd add one thing - keep a log of every single interaction with EDD. Names, dates, what was discussed. It'll help if things get messy.

•Thank you so much for this detailed advice! I'll definitely start calling first thing tomorrow morning. Quick question - how long did your appeal process take?

•It took about 6 weeks for me, but I've heard it can take up to 3 months. Just keep following up and don't let them forget about you!

I'm dealing with the exact same thing rn! Its so frustrating. My HR dept told me to just keep cashing the EDD checks until they sort it out. Idk if thats good advice tho 🤔

•NO NO NO do NOT do this! If EDD overpays you, they WILL come after you for that money. Trust me, I learned the hard way 😭

Have you tried reaching out to your state representative? Sometimes they can help cut through the red tape with EDD. Worth a shot!

OP, make sure you get everything in writing from your employer about the supplemental pay. You'll need that documentation for your appeal. And don't forget to make copies of EVERYTHING before you send it in!

•That's a great point, thank you! I'll email HR right now to get that in writing.

I feel for you, OP. The system is so broken. I've been fighting with EDD for months over a similar issue. It's like they don't even read the forms we submit 🤦♂️

Hey, I found a way to actually get someone on the phone at EDD! I used this site's (claimyr.com) calling tool that dials the phone menu, stays on hold, waits for a live agent to pick up, then sends the call to my phone. It does cost $20, but it works. Here's a video about it: https://youtu.be/DOLxZQb92wM

•Wait, seriously? How does that even work? Sounds too good to be true.

•I was skeptical too, but I tried it and it actually worked! The robot just navigates the phone tree and waits on hold for you. When a real person picks up, it calls your phone. Saved me hours of hold time.

•Idk man, paying to talk to a government agency feels wrong. Shouldn't this be free?

•I get that, but for me, the time saved was worth the $20. I was spending hours on hold every week trying to sort this out. This way I could actually talk to someone and get it resolved.

Quick tip: if you can't get through on the phone, try faxing your appeal. Sometimes it's faster than mail and you get a confirmation it was received.

OP, make sure you're documenting EVERYTHING. Save those EDD letters, emails from your employer, pay stubs, everything. You might need it all for your appeal.

•Definitely! I've started a folder with all the paperwork. Hoping I don't need it, but better safe than sorry.

Has anyone had luck with the EDD website? I keep trying to update my info there but it never seems to go through 😤

•The website is useless. I swear it was built in 1995 and never updated. Always call or mail stuff in.

•Pro tip: use Internet Explorer. I know it sounds crazy, but the site works better on old browsers for some reason 🤷♂️

I went through something similar a few months ago! One thing that really helped me was getting a written statement from HR that clearly breaks down exactly what they're paying vs what EDD should be covering. Make sure it includes specific dollar amounts and dates. Also, if you have direct deposit, screenshot your bank statements showing the actual amounts you're receiving from your employer - this helped prove my case when EDD kept insisting I was getting full salary. The whole process took forever but having that documentation made all the difference. Hang in there mama! 💪

•This is really helpful advice! I'm dealing with a similar situation right now and hadn't thought about getting bank statements as proof. Did you have to submit all of this through the appeal process or were you able to resolve it just by calling them with the documentation?
