UCC search and call - getting different results from phone vs online portal
Has anyone else had issues where the UCC search results you get over the phone don't match what shows up in the online portal? I've been trying to verify some filings for a client and when I call the SOS office, they're telling me there's an active UCC-1 on file, but when I search online using the same debtor name, nothing comes up. The phone rep said sometimes the online system has delays or indexing issues, but this filing is from 6 months ago so that doesn't make sense. I'm worried I'm missing something critical here - has anyone run into this before? The debtor name is spelled exactly the same way I'm searching, so I don't think it's a typo issue. Really need to get this sorted out before we proceed with our own filing.

Yeah I've seen this happen before. Sometimes the online database doesn't update properly or there's indexing problems. Have you tried searching with different variations of the debtor name? Like if it's a business, try searching with and without Inc, LLC, etc. Also check if there are any middle initials or abbreviated names that might be throwing off the search.

This is super frustrating when it happens. I had a similar issue last month where the online portal showed a filing as terminated but when I called, they said it was still active. UGH this drives me crazy!! The whole point of having an online system is so we don't have to call and wait on hold for 45 minutes just to get basic information. If their database isn't synced properly what's the point? I've had this happen multiple times and it's always a huge waste of time.

Here's what I'd recommend - get the filing number from the phone rep and then request a certified copy of the UCC-1. That way you'll have the actual document and can see exactly how the debtor name is listed. Sometimes there are subtle differences in how names are entered that cause search problems. Once you have the actual filing you can compare it to what you're searching for.

This happened to me last year with a continuation filing. The online system showed the original UCC-1 had lapsed but the phone rep said it was still active because a continuation had been filed. Turned out the continuation wasn't properly indexed in the online database. Took them 3 weeks to fix it. Really concerning when you're trying to do due diligence.

Have you tried searching at different times of day? I've noticed sometimes the online portal works better in the morning vs afternoon. Might be a server load issue or something. Also make sure you're not accidentally searching the wrong jurisdiction - I've done that before and felt really stupid about it.

This is exactly why I always document everything when I'm doing UCC searches. Screenshot the online search results, keep notes from phone calls with timestamps and rep names. If there's ever a question later you have a paper trail showing what information was available when you searched.
