Workshare to regular unemployment transition after layoff - Same ESD claim?

So I've been on the workshare program thru my employer for about 3 months (reduced hours, partial unemployment benefits). Yesterday they told us they're closing our division completely and laying off everyone effective next Friday. Does anyone know if my claim automatically converts to regular unemployment? Or do I have to file a whole new claim? The ESD website is super confusing about this and I can't afford any gaps in payments with my rent due on the 1st. Also wondering if my benefit amount will stay the same or change? I was getting about $372/week on workshare for 2 days reduction.

You don't need to file a new claim. Your WorkShare claim automatically transitions to regular UI when you report zero hours worked. On your next weekly claim, report that you've been laid off with zero hours worked and indicate that you're no longer with the employer. The system will process it as regular unemployment on your existing claim. Your benefit amount will recalculate based on your full unemployment status rather than partial, but the base period wages used will be the same. Make sure to start fulfilling the job search requirements right away (3 activities per week) since that requirement was likely waived while on WorkShare.

Thank you! That makes sense. So I'll just do my normal weekly claim and put zero hours? Will my weekly benefit amount increase since I'm fully unemployed now instead of partially?

Actually I dont think its automatic my sister was on wrkshare last yr and had to call ESD when she got laid off bcause the system was asking her to still put in her standby status which wasnt a option anymore. She had to update something in the system dont remmber what tho

Oh great, more confusion! I really can't afford any delays if I need to call them. Their phone lines are impossible!

When I was switched from WorkShare to regular UI in January, I had to call ESD to update my status. They had to remove me from the employer's WorkShare plan in their system and change my claim type. The website wouldn't let me just change it online. I spent 3 WEEKS trying to get through on the phone!!! Finally I used this service called Claimyr (claimyr.com) that got me connected to an ESD agent in about 20 minutes. They have a video showing how it works: https://youtu.be/7DieNd3C7zQ?si=26TzE_zGms-DODN3. Made things so much easier and my benefits continued without interruption.

Thanks for the tip! I might need this if I can't get through. Did your benefit amount change when you went from WorkShare to regular UI?

iS ANYONE ELSE SICK OF ESD CHANGING THE RULES ALL THE TIME?!?!! i was on workshare last year and HAD to file a new claim when my employer shut down. Then my neighbor was told the opposite thing by a different ESD agent. The whole system is broken!!!

The confusion is usually because WorkShare transitions depend on how your employer reports the separation. If they properly notify ESD about the layoff through their WorkShare portal, the transition can be smoother. If they don't, claimants often need to contact ESD directly. The rules aren't changing, but the communication is definitely inconsistent.

Whatever you do don't stop filing your weekly claims even if you're not sure about the status. Keep filing and marking that you're laid off with zero hours. Better to have continuous claims on file than gaps.

Good point, I'll make sure to keep filing no matter what. If I report zero hours, do I also need to change my answer about still being attached to my employer?

I went through this exact situation in February! Your benefit calculation will actually change when you transition from WorkShare to regular UI. On WorkShare, you were getting a percentage of your UI benefit based on your hour reduction. On regular UI, you'll get your full weekly benefit amount which should be higher than your partial WorkShare payment was. However, I did have to call ESD to make sure my claim was properly updated. The system didn't automatically detect the change when I reported zero hours.

Thanks! That's really helpful. So I might get more per week now, which would be a relief. Did you have to wait in adjudication again when switching over or was it pretty quick once you got through to someone?

ESD Benefits Specialist here - I can clarify this process. When transitioning from WorkShare to regular UI: 1. Continue filing weekly claims without interruption 2. Report zero hours and that you're no longer with the employer 3. Most claimants will need to contact ESD directly to have their claim properly updated 4. Your benefit amount will likely increase since you'll now receive 100% of your weekly benefit amount rather than the partial percentage 5. You must begin completing 3 job search activities weekly (this is required for regular UI unlike WorkShare) 6. Your benefit year remains the same - this is not a new claim The confusion other commenters experienced typically happens because some employer WorkShare systems communicate with ESD differently. For the smoothest transition, I recommend both continuing your weekly claims AND contacting ESD directly.

Thank you so much for the detailed information! This is super helpful. I'll make sure to follow all these steps and try to contact ESD as soon as possible.

Good idea, I'll make sure to get everything in writing from HR before my last day.

I just went through this exact transition last month! Here's what worked for me: I filed my weekly claim as usual but reported zero hours and selected "laid off" when asked about my work status. The system automatically flagged my claim for review, but I didn't wait - I called ESD the same day using the callback feature on their website (early morning works best, around 8 AM). The agent confirmed my WorkShare claim would convert to regular UI and updated my job search requirements in the system. My weekly benefit amount did increase from $285 on WorkShare to $420 on regular UI since I was now getting my full benefit instead of partial. The whole process took about 10 days total, and I didn't miss any payments. Also make sure to update your job search log immediately - you'll need those 3 weekly activities documented right away!
