Timing question: Restart my ESD claim this week or wait until next week if my last day is Wednesday?

I've been working part-time for the past few months after being on unemployment last year. Just found out my position is being eliminated, and this Wednesday will be my last day. I'm confused about when I should restart my unemployment claim with ESD. Should I file this week since I know I'm being let go, or wait until next week when I'm completely unemployed? I only worked 16 hours this week (Monday and Tuesday). Will reporting those hours cause problems if I restart my claim now? I'm worried about messing something up and getting denied benefits. Thanks for any advice!

you should wait until after ur last day of work to file. ESD wants u to actually be unemployed when u submit ur claim

Thanks! So even though I know for sure I'm being let go, I need to wait until after Wednesday to restart my claim? Should I do it Thursday or wait until Sunday when the new week starts?

You should restart your claim after your final day of work, but you don't need to wait until Sunday. You can restart it on Thursday, and then when you file your weekly claim you'll report the 16 hours worked this week (plus any earnings). This ensures your claim is reactivated properly while still accurately reporting your final part-time hours. When restarting, use the "restart claim" option in your eServices account rather than filing a completely new claim. Since you were previously on unemployment, your benefit year may still be active.

This is really helpful, thank you! I wasn't sure if I should use the restart option or file completely new. My previous claim was about 7 months ago, so I think it might still be in the same benefit year. I'll restart it on Thursday then.

I went thru this EXACT situation in January!!! I restarted my claim the day after my last day and everything went fine. just be SUPER CAREFUL to report your final hours worked on the weekly claim. I accidently put 0 hours and then had to call and fix it and it was a NIGHTMARE to reach someone.

I had the same experience trying to reach ESD! I finally used Claimyr (claimyr.com) to get through - it calls ESD for you and then connects you when an agent is available. Saved me hours of frustration. They have a video showing how it works: https://youtu.be/7DieNd3C7zQ?si=26TzE_zGms-DODN3 - it literally got me through to an agent in 25 minutes when I'd been trying for days.

The technical answer: According to ESD rules, you should restart your claim after becoming fully unemployed (after Wednesday). You can restart on Thursday, and you'll file your first weekly claim on Sunday or later for the week ending Saturday. On that first weekly claim, you'll report the 16 hours worked and the wages earned for those hours. Keep in mind that your first payment may be reduced due to those earnings, but this is normal and expected. The important thing is being accurate about your last day and hours worked.

this is why the system is so confusing!! why not just wait til sunday to restart AND do the weekly claim? seems easier to me

My company laid me off in December and my last day was a Wednesday too! What a coincidence!! I waited until Thursday to restart and when I did my weekly claim that Sunday I reported my hours. Everything worked out fine.

ESD is just gonna deny you anyway!!! I did EVERYTHING right after my layoff and they still put me in adjudication for 8 WEEKS with NO EXPLANATION!!! Then denied me for some made-up reason about my availability. The whole system is RIGGED to avoid paying benefits!!!!

While adjudication delays are frustrating, they aren't universal. Many claims go through without issues, especially if it's a straightforward layoff. Yes, there can be problems, but most restart claims with clear employment separation reasons are processed without major delays.

Thanks everyone for the helpful advice! I'll restart my claim on Thursday and make sure to accurately report my 16 hours of work this week when I file my weekly claim on Sunday. Fingers crossed everything goes smoothly - I really can't afford any delays right now with rent coming up. I'll update if I run into any issues.

One more important thing: make sure your employer has officially coded your separation as a layoff in their system. If they report it differently to ESD (like voluntary quit), it could trigger adjudication. If possible, get something in writing that confirms your position was eliminated. This documentation can be extremely helpful if any questions come up about your separation reason.

That's good to know! I do have an email from my manager stating the position elimination, so I'll save that just in case. I hadn't thought about them potentially coding it differently.
