What will disqualify you from unemployment in Washington ESD?

I'm worried about making a mistake that could disqualify me from unemployment benefits. I've been getting UI for about 6 weeks now but I keep hearing horror stories about people losing their benefits over small things they didn't know about. What are the main things that will disqualify you from unemployment in Washington? I want to make sure I'm doing everything right because I can't afford to lose these benefits right now.

The main disqualifications are: quitting without good cause, getting fired for misconduct, refusing suitable work, not being able and available for work, or not meeting job search requirements. Washington ESD is pretty strict about the job search - you need 3 contacts per week and they have to be legitimate.

What counts as 'suitable work'? I'm worried they'll say I should take any minimum wage job even though I made $25/hour before.

0 coins

Generally suitable work is something in your field or pays at least 80% of your previous wage for the first few months. But after a while they expect you to expand your search.

0 coins

Don't forget about the earnings reporting! If you work part-time and don't report it correctly, that can disqualify you too. I almost got in trouble because I forgot to report some gig work I did.

0 coins

How do you report part-time work? Do you have to report it even if it's just a few hours?

0 coins

Yes, you have to report ALL work and earnings when you file your weekly claim, even if it's just one hour. Better to over-report than under-report.

0 coins

This is so important! Washington ESD cross-checks with employers so they'll find out if you don't report work.

0 coins

I had a friend who got disqualified because she went on vacation for a week and marked that she was 'able and available' on her weekly claim. Big mistake! If you travel out of state or can't work for any reason, you have to report it.

0 coins

Wait, you can't travel at all while on unemployment??

0 coins

You can travel but you have to report it on your weekly claim and you might not get paid for those weeks depending on the circumstances.

If you're having trouble reaching Washington ESD to clarify any of these rules, I found this service called Claimyr that helps you get through to agents. They have a video demo at https://youtu.be/7DieNd3C7zQ showing how it works. Sometimes you really need to talk to a human to understand the specific rules for your situation.

0 coins

How much does something like that cost? I'm already struggling financially.

0 coins

Check out claimyr.com for details. For me it was worth it to avoid potentially losing weeks of benefits over a misunderstanding.

alcohol and drug issues can disqualify you too if that's the reason you lost your job or if you fail a drug test during the claim process

0 coins

That's true, but Washington ESD doesn't randomly drug test UI claimants. It's usually only an issue if misconduct involved substances.

0 coins

What about if you get fired for attendance issues? Is that considered misconduct?

0 coins

It depends on the circumstances. If you had legitimate reasons (medical issues, family emergency) it might not be misconduct. But chronic tardiness without good cause usually is.

0 coins

That's what I was afraid of. I was late a lot because of childcare issues but I don't know if that counts as a good reason.

0 coins

You should definitely talk to Washington ESD about your specific situation. Childcare can be considered good cause in some cases.

0 coins

The job search requirements are where most people mess up. You need to make 3 job search contacts per week and keep detailed records. They can audit you at any time and ask for proof.

0 coins

What kind of proof do they want? I've been applying online but I don't always save screenshots.

0 coins

Keep confirmation emails, take screenshots of applications submitted, save job postings. Document everything with dates and contact info.

0 coins

Immigration status can be an issue too. You have to be legally authorized to work in the US to get unemployment benefits.

0 coins

That makes sense. Do they verify that when you first apply?

0 coins

Yes, they cross-check with other databases. If your work authorization expires while you're on benefits, you need to update them immediately.

0 coins

Don't lie about ANYTHING on your application or weekly claims. Even small lies can disqualify you and they might make you pay back everything you received.

0 coins

How do they find out if someone lies?

0 coins

They cross-check with employers, tax records, other state agencies. Washington ESD has access to a lot of databases.

0 coins

This is why it's so important to be completely honest even if you think it might hurt your claim.

0 coins

If you're going to school, that can sometimes disqualify you because you might not be considered 'available for work.' There are some exceptions but you need to check with Washington ESD first.

0 coins

I thought going to school while on unemployment was encouraged?

0 coins

There are approved training programs that don't affect your benefits, but regular college classes might make you unavailable for work during class hours.

0 coins

I used Claimyr when I was confused about whether my training program would affect my benefits. Got through to an agent in like 10 minutes instead of calling for hours. Really saved me from making a costly mistake.

0 coins

Did they give you different advice than what you found online?

0 coins

Yes! The online info was confusing but the agent explained exactly how my specific program would be handled. Some rules have exceptions that aren't clear from the website.

0 coins

being self-employed while collecting can be tricky too. you have to report all income and depending on how much you make it could reduce or eliminate your weekly benefit

0 coins

What if it's just occasional freelance work?

0 coins

still have to report it. even $50 in freelance income needs to be reported on your weekly claim

0 coins

Military discharge status can affect eligibility too. Dishonorable discharge usually disqualifies you from benefits.

0 coins

What about other than honorable discharge?

0 coins

That gets reviewed case by case. Not automatically disqualifying but they'll look at the circumstances.

0 coins

The scariest part is that some disqualifications are permanent and some are just temporary. Like if you refuse suitable work, you might be disqualified for several weeks but not permanently.

0 coins

How do you know which is which?

0 coins

Washington ESD will send you a determination letter explaining the type and length of disqualification. You can appeal if you disagree.

0 coins

Appeals are really important. Don't just accept a disqualification if you think it's wrong. You have 30 days to appeal.

0 coins

I got temporarily disqualified for 'failure to report to WorkSourceWA' even though I never got a notice to report. Took weeks to clear up.

0 coins

How did you get it cleared up?

0 coins

Had to provide proof that I never received the notice and show that my address was correct in their system. Eventually they reversed it but I lost 3 weeks of benefits while it was being sorted out.

0 coins

Bottom line - when in doubt, contact Washington ESD before you do anything that might affect your claim. I keep the Claimyr service bookmarked because their phone system is impossible to get through on your own.

0 coins

Agreed. Better to ask first than try to fix a disqualification later.

0 coins

Thanks everyone. This has been really helpful. I'm going to be extra careful about documenting everything and reporting accurately.

0 coins

don't forget about the waiting week requirement too. if you don't serve your waiting week properly at the beginning that can mess up your whole claim

0 coins

What's the waiting week? I don't remember doing that.

0 coins

it's the first week you file where you meet all requirements but don't get paid. if you worked or weren't available that week it doesn't count and you have to serve it later

0 coins

One more important one - if you move out of state, you need to notify Washington ESD immediately. Different states have different agreements about continuing benefits.

0 coins

What happens if you move to a state that doesn't have an agreement with Washington?

0 coins

You might have to transfer your claim to the new state or potentially lose benefits. That's definitely something to clarify before moving.

0 coins

The key thing is to always be honest and report everything. Washington ESD would rather work with you to fix problems than catch you in a lie later.

0 coins

That's reassuring. I've been so paranoid about making mistakes.

0 coins

Just stay on top of your weekly claims, keep good records, and don't hesitate to ask questions when you're unsure about something.

0 coins

Thanks for starting this thread OP. I learned a lot from reading everyone's responses. The Claimyr thing sounds useful for when I need to actually talk to someone at Washington ESD.

0 coins

Glad it was helpful! I feel much more confident about staying compliant now.
