What reasons can you get denied unemployment in Washington - need to understand my options
My brother just got denied for unemployment and I'm worried about my own claim. I left my job at a restaurant because my manager was scheduling me inconsistently and I couldn't afford the gas to drive there for just 4-hour shifts. Now I'm scared Washington ESD will deny me too. What are the main reasons people get denied? I want to make sure I don't mess up my application when I file next week.

There are several common reasons Washington ESD denies claims. The main ones are: quitting without good cause, being fired for misconduct, not being able and available for work, refusing suitable job offers, and not meeting wage requirements. Since you quit your job, they'll look closely at whether you had 'good cause' which is pretty specific under Washington law.

•What counts as good cause? The inconsistent scheduling was making it impossible to budget or plan anything.

•Good cause includes things like unsafe working conditions, harassment, significant changes to job duties or pay, or if continuing work would cause undue hardship. Inconsistent scheduling might qualify but you'd need to document that you tried to resolve it with your employer first.

washington esd is super strict about voluntary quits. my friend got denied because she quit to take care of her sick mom and they said it wasn't work-related good cause. the system is brutal honestly

•That's awful! Did she appeal it?

•yeah she tried but the appeal took forever and by then she found another job so she just gave up

I had to call Washington ESD like 50 times trying to get through to ask about my denial. The phone system is impossible. Finally used this service called Claimyr (claimyr.com) that actually got me connected to a real person. They have a video demo at https://youtu.be/7DieNd3C7zQ showing how it works. Worth checking out if you need to talk to someone about your case.

•How much does that cost though? I'm already broke from being unemployed.

•It's not free but way cheaper than losing out on weeks of benefits because you can't get through to clarify something important.

•I'll look into that if I need to call them. Thanks for the tip!

Other denial reasons include not earning enough in your base period (they need at least $3,500 in your highest quarter), being fired for things like theft or attendance issues, or not actively looking for work. You also get denied if you're not a US citizen or authorized to work, or if you're attending school full-time without approval.

•I definitely earned enough, I worked there for 8 months making $18/hour. Just worried about the quitting part.

•That should be plenty for the wage requirement. Focus on documenting why you had to quit - keep any texts or emails about the scheduling issues.

WASHINGTON ESD DENIED ME FOR THE STUPIDEST REASON! I got fired for being 5 minutes late ONE TIME after working there for 3 years with perfect attendance. They called it misconduct. THE WHOLE SYSTEM IS RIGGED!!!

Jamal Harris
•That sounds like it might be worth appealing. One incident usually isn't enough for misconduct unless there were prior warnings. Did you get any documentation about progressive discipline?

Giovanni Colombo
•No warnings ever. Just boom - fired and denied benefits. I'm so frustrated with this whole process.

they also deny you if you don't do your job search requirements properly. you have to log 3 job contacts per week and they're really picky about what counts

•Good to know, I'll make sure to keep detailed records if I get approved.

My cousin got denied because she didn't report some part-time work she did while claiming. Even if you only work a few hours, you HAVE to report it or they'll say you committed fraud. They're really strict about that stuff.

Zoe Stavros
•Yikes, I'll definitely be careful about reporting everything accurately.

Jamal Harris
•Yes, always report any work even if it's just a few hours. They cross-reference with wage records and will catch unreported income eventually.

honestly the whole system seems designed to deny as many people as possible. i know someone who got denied because they said she wasn't 'actively seeking work' even though she was applying to jobs every day

•The job search requirements are specific - you need to document your efforts properly in WorkSourceWA and make sure you're applying to suitable positions within your field or expanding your search appropriately.

If you're thinking about quitting, try to get documentation first. Email your boss about the scheduling problems, keep records of your shifts, maybe see if there are other employees dealing with the same thing. Washington ESD wants to see you made a good faith effort to resolve workplace issues before quitting.

•I already quit unfortunately, but I do have some text messages about the inconsistent schedule. Hope that helps.

Sofia Torres
•Those texts could definitely help your case. Make sure to mention them in your application and be prepared to provide copies if they ask.

Another thing - if you have any medical issues that affect your ability to work, you need to be really careful about how you handle that. You have to be able and available for full-time work to qualify for UI benefits.

•I'm healthy and definitely able to work full-time, so that shouldn't be an issue for me.

what about if you get laid off vs fired? is there a difference for washington esd?
0 coins
Jamal Harris
•Big difference. Layoffs due to lack of work, company downsizing, or economic reasons usually qualify automatically. Being fired for performance or misconduct requires investigation and often leads to denial.

•ok good to know thanks

I've been through the Washington ESD system twice now. First time got approved after a layoff, second time got denied for quitting but successfully appealed. The key is having good documentation and being able to clearly explain why your situation meets their criteria for good cause or why a firing wasn't actually misconduct.

Zoe Stavros
•How long did the appeal process take? I'm worried about going weeks without any income.

Miguel Ramos
•Mine took about 6 weeks total, but they paid retroactively once it was approved. You can also request expedited processing if you have financial hardship.

Sometimes people get denied just because they filled out the application wrong or didn't understand the questions. Like there's this question about why you left your job and if you answer it incorrectly it can hurt your case even if you actually qualify.
0 coins
Zoe Stavros
•That's scary. Are there any resources to help fill it out correctly?

•WorkSource offices sometimes offer help, and there are some online guides. Just be very honest but also make sure you're framing your situation in terms of the legal criteria.

Don't forget about the waiting week! Even if you get approved, there's usually a one-week waiting period before benefits start. Plan for that gap in income.

•Good point, I'll need to budget for that delay.

Had a friend who used that Claimyr service someone mentioned earlier when she got stuck in adjudication hell. Took her 3 months to get through on her own, then Claimyr got her connected the same day and she finally got her case resolved. Sometimes you just need to talk to a human being to sort things out.

Zoe Stavros
•3 months?! That's insane. I really hope my case doesn't get that complicated.
0 coins
Connor Gallagher
•Yeah it was ridiculous. The automated system kept saying she needed to verify her identity but wouldn't tell her how. Finally talking to someone cleared it up in 5 minutes.

also if you're collecting benefits in another state or have worked in multiple states recently that can complicate things. washington has agreements with other states but sometimes claims get delayed while they sort out which state should pay

•I've only worked in Washington so that shouldn't be an issue for me.

The good news is that if you do get initially denied, you have appeal rights. Don't just give up if you think the decision is wrong. A lot of denials get overturned on appeal if people can present their case properly.
0 coins
Zoe Stavros
•That's reassuring. I'll definitely appeal if needed.
0 coins
Jamal Harris
•Exactly. The initial determination is just based on the information they have at that point. Appeals let you provide more context and documentation.

Bottom line - be honest in your application, keep good records, and don't be afraid to seek help if you need it. The system is complicated but there are people who can guide you through it.

•Thanks everyone for all the advice. This has been really helpful in understanding what I might be facing.

•Good luck with your application! Just remember to clearly explain how the scheduling issues created an unreasonable hardship that made continuing employment impossible.

One more thing - if you end up needing to call Washington ESD and can't get through the regular way, I had success with Claimyr too. Worth having in your back pocket if you hit roadblocks. The video demo at https://youtu.be/7DieNd3C7zQ shows exactly how it works.
