Why would you get denied unemployment by Washington ESD?

I'm nervous about applying for unemployment benefits and want to understand what could cause Washington ESD to deny my claim. I've been working part-time for the last 8 months at a retail job but got laid off due to store closure. I'm worried there might be something in my work history that could disqualify me. What are the main reasons Washington ESD denies unemployment claims? I want to make sure I don't mess up my application.

The most common reasons Washington ESD denies claims are: 1) Quitting without good cause, 2) Being fired for misconduct, 3) Not meeting the earnings requirements, 4) Not being able and available for work, and 5) Refusing suitable work offers. Since you were laid off due to store closure, that shouldn't be an issue for you - that's typically considered a no-fault separation.

That's reassuring! I was worried the part-time hours might hurt me. Do you know what the earnings requirements are?

0 coins

You need to have earned at least $3,850 in your base year (first 4 of the last 5 completed quarters before you file). With 8 months of work, you should be fine as long as you were making decent hours.

I got denied initially because Washington ESD said I quit voluntarily, even though I was actually laid off. Took forever to get through to them on the phone to explain the situation. If you run into issues getting through to Washington ESD, there's this service called Claimyr at claimyr.com that helps you actually reach an agent - they have a video demo at https://youtu.be/7DieNd3C7zQ showing how it works.

0 coins

Oh no, that sounds stressful! How long did it take to get it resolved?

0 coins

About 3 weeks once I finally got through to them. The Claimyr thing made it way easier - no more sitting on hold for hours just to get disconnected.

0 coins

I've heard of that service but haven't tried it yet. Does it actually work?

0 coins

Yeah it worked for me. Much better than the nightmare of trying to call Washington ESD directly.

Washington ESD also denies claims if you're not actively looking for work or if you fail to report your job search activities correctly. You need to make at least 3 job search contacts per week and keep detailed records. Some people get denied because they think just applying online counts as 3 contacts, but each application only counts as one contact.

0 coins

Good to know! I wasn't aware of the 3 contacts per week rule. What counts as a job search contact?

0 coins

Applications, networking events, job fairs, contacting employers directly, working with WorkSource - basically any activity where you're actively seeking employment. Keep good records because Washington ESD audits these.

0 coins

I got audited and they wanted like 6 months of job search logs. Thank god I kept everything documented.

0 coins

MISCONDUCT is a big one!! If you got fired for attendance issues, theft, insubordination, or violating company policy, Washington ESD will deny your claim. They investigate this stuff pretty thoroughly too.

0 coins

Since I was laid off due to store closure, that shouldn't apply to me, right?

0 coins

Correct! Store closure is considered a lack of work situation, not misconduct. You should be fine on that front.

0 coins

Another reason is if you're not physically able to work or available for work. Like if you're on medical leave or can't work certain hours/days. Washington ESD requires you to be able and available for full-time work.

0 coins

I'm able to work full-time now, so that shouldn't be an issue.

0 coins

Just make sure you don't have any restrictions when you file. Even saying you can only work certain hours can cause problems.

0 coins

Thanks for the heads up! I'll be careful about that.

0 coins

Immigration status can also be an issue. You have to be legally authorized to work in the US. Washington ESD checks this stuff.

0 coins

I'm a US citizen so that's not a concern for me.

0 coins

Don't forget about the drug testing thing. If you were fired for failing a drug test, that's automatic disqualification in most cases.

0 coins

Good thing I was laid off and not fired!

0 coins

Yeah, store closures are pretty straightforward. You shouldn't have issues with that.

0 coins

Sometimes people get denied because they don't report other income correctly. If you're getting pension payments, severance, or working any side gigs, you have to report all of that to Washington ESD.

0 coins

I don't have any other income sources, so that should be fine.

0 coins

Make sure you report everything accurately on your weekly claims too. Any little mistake can cause problems.

0 coins

Another thing - if you refuse a job offer that Washington ESD considers 'suitable work,' they'll cut off your benefits. Suitable work is generally anything that pays at least 70% of your previous wage after the first 5 weeks.

0 coins

That's good to know. I definitely plan to accept any reasonable job offers.

0 coins

Just be careful what you consider 'reasonable' - Washington ESD's definition might be different than yours.

0 coins

I've seen people get denied because they attended school full-time while claiming benefits. Washington ESD generally requires you to be available for work, which means school can't interfere with your job search.

0 coins

I'm not in school, so that won't be an issue.

0 coins

There are some exceptions for approved training programs, but you have to get permission first.

0 coins

Honestly, based on what you've described, you should be fine. Store closure is one of the most straightforward reasons for unemployment. Just make sure you file your claim correctly and keep up with your job search requirements.

0 coins

Thank you! This thread has been really helpful. I feel much more confident about filing now.

0 coins

Good luck! The process isn't as scary as it seems once you get started.

0 coins

One more thing - make sure you file your claim as soon as possible after your last day of work. There can be penalties for delayed filing.

0 coins

I'll file this week. My last day was Friday.

0 coins

Perfect timing. You're doing everything right.

0 coins

The Washington ESD website has a good checklist of eligibility requirements if you want to double-check everything before filing. Better to be over-prepared than under-prepared.

0 coins

I'll definitely check that out. Thanks for all the advice everyone!

0 coins

If you do get denied for any reason, don't panic. You can appeal the decision. Just make sure you do it within the time limit they give you.

0 coins

Good to know there's an appeals process if needed.

0 coins

The appeals process can take a while though, so it's better to get it right the first time if possible.

0 coins

I had a friend who got denied because Washington ESD couldn't verify his identity. Make sure all your documents are in order and your Social Security number matches exactly.

0 coins

I'll double-check all my information before submitting. Thanks!

0 coins

Sometimes people get denied because they worked in multiple states and need to file in a different state. Since you worked in Washington, you should file with Washington ESD.

0 coins

Yeah, I've only worked in Washington state, so that's not an issue.

0 coins

If you need to talk to Washington ESD about anything, I'd recommend trying that Claimyr service someone mentioned earlier. I used it last month when I had questions about my claim status and it actually worked - got through to an agent in like 20 minutes instead of the usual 3+ hour wait.

0 coins

That's really good to know! I'll keep that in mind if I need to contact them.

0 coins

I second this recommendation. Claimyr saved me so much time and frustration.

0 coins

The key is just being honest and accurate on your application. Washington ESD will find out if you lie about anything, and that's an automatic denial plus potential fraud charges.

0 coins

Absolutely! I plan to be completely honest about everything.

0 coins

You sound like you're in a good position. Store closure, good work history, available for work - you should be approved without any issues. Just follow the rules and you'll be fine.

0 coins

Thank you so much! This community has been incredibly helpful. I'm going to file my claim today.

0 coins

Good luck! Keep us posted on how it goes.

0 coins

One last tip - when you file your weekly claims, be consistent with your answers. If Washington ESD sees discrepancies from week to week, it can trigger an investigation.

0 coins

Great advice! I'll make sure to be consistent with my reporting.
