What can you apply for unemployment - Washington ESD eligibility requirements?
I've been working part-time at a restaurant for 8 months but my hours got cut from 25 to 10 hours per week. My manager says business is slow and they might have to let some people go entirely. I'm wondering what situations actually qualify you to apply for unemployment benefits through Washington ESD? I've never filed before and don't really understand the requirements. Can you apply if you're still working reduced hours, or do you have to be completely unemployed? Also heard there are different types of benefits but not sure what they are.

You can definitely apply for unemployment in Washington if your hours were reduced! This is called 'partial unemployment' and you might be eligible for reduced benefits. The main requirements are: you must have worked and earned wages in Washington during your base period (usually the first 4 of the last 5 completed quarters), you must be able and available for work, and you must be actively seeking work. Even if you're still working part-time, if your hours were cut through no fault of your own, you should qualify.

•That's helpful! Do I need to have worked a certain amount of time or earned a minimum amount to qualify?

•Yes, you need to meet the monetary requirements. Generally you need to have earned wages in at least 2 quarters of your base period and earned at least $7,000 total during the base period. Since you've been working 8 months, you should meet the time requirement.

There are several types of unemployment benefits you can apply for through Washington ESD depending on your situation: Regular UI (what most people get), Standby benefits if you're temporarily laid off but expect to return to the same job, and Shared Work if your employer participates in a work-sharing program. For your situation with reduced hours, regular UI sounds right.

•What's the difference between standby and regular UI? My manager mentioned they might bring hours back up in a few months.

•Standby is for when you have a definite return date to your job, usually within 8 weeks. Since your situation sounds uncertain with no clear timeline, regular UI would be better. You can still return to work when hours increase.

I was in a similar situation last year - restaurant hours cut due to slow business. I tried calling Washington ESD for weeks to ask about eligibility but could never get through. Finally used this service called Claimyr (claimyr.com) that helped me reach an actual person at ESD. They have a video demo showing how it works: https://youtu.be/7DieNd3C7zQ. Worth checking out if you need to talk to someone about your specific situation.

•Thanks, I'll definitely need to call them because I have questions about how they calculate benefits with partial employment.

•How much did that service cost? I've been trying to reach ESD for 2 weeks about my claim status.

•It was totally worth it for me - much less than what I would have lost by not getting my benefits sorted out quickly. The main thing is it actually gets you connected to a real person instead of hanging up after being on hold for hours.

One thing to keep in mind - even with partial unemployment benefits, you'll still need to meet the job search requirements. You need to make at least 3 job search contacts per week and keep a detailed log. This includes applying for jobs, networking, job fairs, etc. The requirements are pretty strict.

•Do I have to look for full-time jobs or can I search for other part-time positions?

Andre Dupont
•You should be looking for suitable work, which usually means full-time positions in your field or similar pay rate. But part-time can count depending on your work history and availability.

Just want to add - make sure you report ALL wages when you file your weekly claims, even from your reduced part-time work. Washington ESD will reduce your benefit amount based on what you earn, but you won't lose benefits entirely unless you earn more than your weekly benefit amount plus $5.

•Good to know! So if I'm still working 10 hours, I report those wages but still get some unemployment benefits?

Zoe Papadakis
•Exactly! They'll calculate your partial benefit based on your earnings. It's designed to help bridge the gap when your hours are reduced.

the restaurant industry is brutal right now, half the places in my area have cut hours or closed entirely. at least unemployment is there as a safety net when employers can't provide stable hours

•So true! My friend works at three different restaurants just to get full-time hours because none of them will guarantee a consistent schedule.

•That's exactly my situation - the uncertainty is the worst part. At least unemployment might help stabilize things a bit.

One more important point - you can apply online through the Washington ESD website or by phone. The online application is usually faster and available 24/7. Once you apply, there's typically a one-week waiting period before you can start receiving benefits. Make sure to file your weekly claims every week even during the waiting period.

•How long does it usually take to get approved after applying?

Aisha Mohammed
•If your claim is straightforward with no issues, approval can happen within a week or two. But if there are questions about your separation from work or eligibility, it might go into adjudication which can take several weeks.

Watch out for the overpayment issues too. I know people who didn't report their part-time wages correctly and ended up owing money back to ESD later. Better to be completely honest upfront than deal with that mess.

•Yikes, I definitely don't want to deal with owing money back. I'll make sure to report everything accurately.

•This is so important! The penalties for not reporting wages can be severe - they can disqualify you from benefits and make you pay back everything with interest.

Also remember that unemployment benefits are taxable income. You can choose to have taxes withheld from your weekly payments or pay them when you file your tax return. Just something to keep in mind for planning purposes.

•I hadn't thought about taxes. Is it better to have them withheld or pay later?

Liam O'Sullivan
•Most people find it easier to have taxes withheld so they don't owe a big chunk at tax time. You can change this setting in your ESD account.

The whole system seems designed to confuse people honestly. I spent hours reading through all the eligibility requirements and still wasn't sure if I qualified. Finally just applied and let them figure it out - worst case they say no.

•Yeah, it does seem complicated. But I guess if I meet the basic requirements it's worth applying.

•That's actually good advice - if you think you might qualify, it's better to apply and let ESD make the determination than to not apply at all.

Make sure you understand the difference between being laid off and being fired for cause. If you were fired for misconduct, you might not be eligible. But if your hours were just reduced due to lack of work, that's not your fault and you should qualify.

•Definitely just lack of work in my case. Business has been really slow and they've had to cut everyone's hours.

I wish I had known about partial unemployment benefits when my hours got cut a few years ago. I struggled for months thinking I had to be completely unemployed to qualify. Don't make the same mistake I did!

•That's exactly what I was thinking - I thought unemployment was only for people who lost their jobs completely.

•It's a really common misconception. The partial unemployment program is specifically designed to help people in situations like yours.

Another thing - if you're approved for benefits, you'll get a debit card (KeyBank debit card) that your payments are loaded onto. You can also choose direct deposit to your bank account, which I'd recommend since it's faster and more convenient.

•How quickly do the payments usually come once you're approved?

•Usually within 2-3 business days after you file your weekly claim, assuming there are no issues with your claim.

Does anyone know if you can collect unemployment if you quit your job to take care of a sick family member? That's not the OP's situation but I'm curious.
0 coins
Aisha Mohammed
•Generally no, if you voluntarily quit you don't qualify unless it's for 'good cause' as defined by law. Family care might qualify in some situations but it's complicated.

Sofia Rodriguez
•There might be Family Medical Leave options instead of unemployment in that situation. Different programs entirely though.

OP should also know that if they end up getting completely laid off later, they can modify their existing claim rather than filing a new one. Just mentioning in case the restaurant situation gets worse.

•Good to know, hopefully it doesn't come to that but the way things are going it's possible.

The job search requirement is no joke btw. They do audit people and if you can't prove you did your required job searches, they can disqualify you and make you pay back benefits. Keep detailed records!

•What kind of records do I need to keep?

•Date, employer name, position applied for, method of contact (online, in person, phone), and result. Washington ESD has forms you can use to track this.

I had trouble reaching ESD when I first applied and found Claimyr really helpful for getting through to speak with someone about my eligibility questions. Sometimes it's worth paying a small fee to get expert help navigating the system instead of spending weeks trying to figure it out on your own.

One last tip - when you do apply, have all your employment information ready: employer names, addresses, dates of employment, reason for separation, and your Social Security number. Having everything organized will make the application process much smoother.

Just remember that even if you're still working part-time, you're considered 'unemployed' for benefit purposes since your hours were involuntarily reduced. Don't let anyone tell you that you don't qualify just because you're still working some hours.

•That's reassuring to hear. I was worried they might say I don't qualify since I'm still technically employed.
