Weekly claim shows 'disqualified' status for 4 straight weeks - need ESD help urgently

I started my unemployment claim exactly 4 weeks ago and something's seriously wrong. Every single weekly claim I've filed is showing as "disqualified" with no explanation!!! Does anyone know what's happening? I've verified all my info is correct, answered all the questions honestly, and made sure to do my 3 job search activities each week. I've never had unemployment before so I don't know if this is normal at first or if there's a problem with my claim. Tried calling ESD about 20 times but can't get through to talk to anyone. My savings are almost gone and rent is due next week... starting to panic. Has anyone dealt with this disqualified status before? How did you fix it?

There's definitely something wrong with your claim. "Disqualified" means ESD has determined you don't meet eligibility requirements for some reason. Common reasons include: - You didn't earn enough wages in your base year - You quit your job without good cause - You were fired for misconduct - You're not able and available for work - You didn't properly report earnings - You didn't complete your job search requirements Did you receive any letters or messages in your ESD account explaining the disqualification? Check your correspondence folder in eServices.

Thanks for responding! I checked my correspondence folder and there's a letter saying I'm disqualified because I "voluntarily quit without good cause" - but that's NOT true! I was laid off when my company downsized. I have the termination letter to prove it. What do I do now?

OMG thank you! The letter is dated March 10th so I still have time. Do I need to keep filing weekly claims while appealing or stop until it's resolved?

Yes, definitely continue filing your weekly claims while you appeal! This is extremely important. If you win your appeal, they'll only pay you for weeks you properly claimed, even if you were eligible. To appeal, you need to submit a written request explaining why the determination is incorrect, along with any supporting documents (like your termination letter). You can file online through your eServices account or mail it to the address on your determination letter. Make your appeal clear and factual - "I was laid off due to company downsizing on [date]. I did not voluntarily quit. I've attached my termination letter as evidence."

Thank you so much! I'll keep filing weekly and submit my appeal today with the termination letter attached. How long does the appeal process usually take? I'm really worried about paying bills.

Your employer probably reported incorrect information to ESD. This happens ALL THE TIME! They'll say you quit or were fired for misconduct to avoid their unemployment insurance rates going up. Make sure your appeal clearly states you were laid off in a company downsizing. I went through something similar in January when my employer told ESD I was fired for attendance issues when I was actually laid off with 50 other people. The appeal took about 5 weeks before I got a hearing date, and then another week for the decision. It was approved and I got all my back payments at once. One thing that helped me get through to ESD faster: I used Claimyr to connect with an ESD agent (claimyr.com). They got me connected to an actual person at ESD in about 20 minutes instead of trying to call for days. They have a video showing how it works: https://youtu.be/7DieNd3C7zQ?si=26TzE_zGms-DODN3. It was super helpful to talk to someone who could see what was actually happening with my claim and explain the appeal process.

Thank you for sharing your experience! It's reassuring to hear you got approved eventually. 5+ weeks is a long time though... I'll check out that Claimyr service. At this point I just need to talk to someone who can look at my claim and see what's going on.

they ALWAYS say disqualified at first lol its like they WANT you to give up. keep filing every week no matter what!!! also my uncle works for the state (not ESD but still) and he says companies LIE all the time about why people left. fight it!!!

I want to clarify something important here about the disqualification process. The system doesn't automatically disqualify everyone "at first" as some have suggested. Each claim is evaluated based on the information provided by both the claimant and the employer. What likely happened in your case is that your employer reported to ESD that you quit voluntarily. When there's conflicting information, ESD typically makes an initial determination based on the employer's report since they pay into the unemployment insurance system. Your appeal needs to include: 1. Your termination letter 2. Any emails or communications about the layoff 3. Names of other employees laid off at the same time (if applicable) 4. Clear timeline of events The hearing will be conducted by an Administrative Law Judge from the Office of Administrative Hearings (OAH), not ESD directly. Be prepared to explain your situation clearly and answer questions about your separation from employment. While waiting for your appeal, also check if there's an "able and available" issue on your claim. Sometimes multiple issues can cause disqualification.

This is extremely helpful, thank you! I'll gather all those documents for my appeal. There were 12 other people laid off the same day, so I'll mention that too. I'll double check for any other issues on my claim that might be causing problems.

I used Claimyr last week when I was in a similar situation (not disqualified but stuck in adjudication forever) and got through to ESD in about 15 minutes. The agent was able to see that there was a flag on my account that needed to be removed. Much better than spending days trying to call them directly.

It worked for me! They connect you through their system somehow. I was skeptical too but was desperate after trying to get through for two weeks.

UPDATE: I managed to get through to ESD today (after trying Claimyr - totally worth it). The agent confirmed my employer incorrectly reported that I quit. She put notes on my account and advised me to continue with my appeal. She said the appeal should be successful since I have documentation, but it will still take several weeks to process. For anyone facing similar issues - KEEP FILING YOUR WEEKLY CLAIMS even while disqualified! The agent emphasized this multiple times. Also, check your correspondence tab regularly for any letters requiring action. Thanks everyone for your help and advice. I'll update when my appeal is resolved.

Great update! Yes, continuing to file weekly claims is absolutely crucial. I'm glad you got some clarity on the situation. Make sure you're prepared for your appeal hearing - have all your documents organized and be ready to clearly explain the layoff situation. Good luck!
