Washington ESD unemployment eligibility after getting fired - do I qualify?
My manager terminated me yesterday after I missed two shifts last month due to my car breaking down. I provided documentation from the mechanic but they said it was still job abandonment. I worked there for 8 months full-time making $18/hour. Do I qualify for Washington ESD unemployment benefits if I got fired? I'm really stressed about paying rent next month and don't know if I should even bother applying.

You can still apply for unemployment even if you were fired. Washington ESD will review your case to determine if the termination was for 'misconduct.' Missing work due to car trouble with documentation probably isn't misconduct, especially if it was only two instances.

•That's good to know! Should I mention the mechanic documentation when I file my claim?

Miguel Ramos
•Absolutely. Keep all that paperwork handy because Washington ESD might ask for it during adjudication.

I got fired from my last job too and still got benefits. The key is being honest on your application about why you were terminated. Washington ESD will contact your employer to get their side of the story.

•How long did it take for them to make a decision on your claim?

•About 3 weeks but that was during a busy period. Could be faster now.

File your claim immediately - even if you're not sure about eligibility. The sooner you apply, the sooner your benefit year starts. Washington ESD has specific criteria for what constitutes misconduct and your situation doesn't sound like it meets that threshold.

•This is exactly right. I waited two weeks to file thinking I wouldn't qualify and regretted it because those weeks don't count for benefits.

•I didn't know that! I'll file today then. Thank you for the advice.

Getting through to Washington ESD by phone can be a nightmare if you need to check on your claim status or have questions. I struggled for weeks trying to reach someone until I found Claimyr.com - they actually got me connected to an agent the same day. There's a helpful video demo at https://youtu.be/7DieNd3C7zQ that shows how it works.

•Is that service legit? I'm always suspicious of third-party sites when it comes to government stuff.

•I was skeptical too but they don't ask for any personal info - they just help you get through the phone queue to talk to actual Washington ESD staff.

•I used them last month when my claim got stuck in adjudication. Worth it just to avoid the endless busy signals.

whatever you do dont lie on the application!!! they WILL find out and then you'll owe money back plus penalties. just be honest about getting fired and let them decide

•I definitely won't lie. I'm just worried they'll automatically deny me since I was terminated.

•nah being fired doesnt automatically disqualify you unless its for serious misconduct like stealing or violence

For reference, Washington ESD considers misconduct to be willful or wanton behavior that violates employer policies. Missing work due to transportation issues, especially with documentation, typically doesn't meet this standard unless it was a repeated pattern with prior warnings.

•What if you were on a final warning though? Does that change things?

•It might make the case more complex, but they'd still evaluate whether the final incident constituted actual misconduct versus unfortunate circumstances.

I've been dealing with Washington ESD for months and honestly the whole system is broken. Half the time their website doesn't work and when you call you just get hung up on. It's designed to make you give up.

•The phone system is definitely frustrating but the online filing usually works okay. Just have to be patient with the process.

•Patient for 6 weeks while my claim sits in adjudication? Easy for you to say.

Make sure you start doing your job search activities right away even before your claim is approved. Washington ESD requires 3 job contacts per week and you need to log them in WorkSourceWA.

•Do I need to do job searches even during the adjudication period?

Natasha Petrova
•Yes, you should start immediately. If your claim gets approved, you'll need to show job search activities for all the weeks you're claiming.

My brother got fired for attendance issues similar to yours and still got benefits. The employer tried to fight it but Washington ESD sided with him because he had legitimate reasons for the absences.

•That's encouraging! Did he have to provide a lot of documentation?

Javier Morales
•He had to send in some paperwork during the adjudication process but nothing too crazy.

The fact that you worked there 8 months is good - shows you weren't a problem employee. Two missed shifts due to car trouble doesn't sound like job abandonment to me, especially with documentation.

•Exactly. Job abandonment usually means not showing up for several days without notice or communication.

•I did call in both times when my car broke down, I didn't just no-show.

I got denied initially when I was fired but won my appeal. Don't give up if they deny you at first - the appeals process exists for a reason and they often overturn wrongful denials.

•How long does the appeals process take?

•Mine took about 6 weeks but I got backpaid for all the weeks I was waiting.

Quick question - when you file, make sure you have your last day of work correct. If they fired you yesterday, that's your separation date, not today or when you would have worked next.

Ava Thompson
•Good point, I'll make sure to put yesterday's date. Thanks!

If your claim does go into adjudication and you need to speak with someone at Washington ESD, I really recommend checking out Claimyr. I wasted so many hours trying to get through on my own before finding them.

•How much does that service cost? I'm already tight on money.

•It's not free but honestly worth it compared to the time and frustration of trying to reach Washington ESD yourself. Check their site for current pricing.

Washington ESD is backlogged right now so even straightforward claims are taking longer than usual. Don't panic if you don't hear back right away - just keep filing your weekly claims.

•I'll keep that in mind. At least I know I should apply regardless of my concerns about being fired.

Your situation sounds very similar to mine and I got approved. The key is that you communicated with your employer and had valid reasons for the absences. Washington ESD understands that life happens.

One more tip - when you file your weekly claims, be consistent with your answers. If something changes in your situation, report it immediately to avoid any overpayment issues later.

•I'll definitely be careful about that. Thank you everyone for all the advice!
