Washington ESD unemployment benefits if terminated - do you get unemployment if fired?

My manager let me go yesterday after working at this retail job for 8 months. They said it was due to 'performance issues' but I think it was really because I complained about unsafe working conditions. Can I still file for Washington ESD unemployment benefits if I was fired? I'm really worried I won't qualify and I have rent due next week. Has anyone been in this situation before?

Yes, you can still get unemployment benefits even if you were fired, but it depends on WHY you were fired. Washington ESD will look at whether it was for 'misconduct' or not. Performance issues usually don't count as misconduct unless it was willful negligence.

That's a relief! What exactly counts as misconduct then? I was never written up or anything, they just said I wasn't meeting expectations.

Misconduct has to be willful or deliberate violation of company rules. Poor performance or inability to do the job usually doesn't qualify as misconduct under Washington law.

I got fired from my last job for being late too many times and still got approved for UI benefits. Washington ESD denied me at first but I appealed and won. The key is that they have to prove it was misconduct connected to your work.

How long did the appeal process take? I can't afford to wait months for benefits.

About 6 weeks total. You should definitely file your claim right away though, even if you think they might deny you initially.

File your claim immediately! Even if Washington ESD initially denies your claim, you can appeal. The fact that you complained about safety issues before being fired could actually work in your favor - that might be considered retaliation which would make you eligible for benefits.

I didn't think about the retaliation angle. Should I mention the safety complaint when I file my claim?

Absolutely mention it. Be honest about the timeline and circumstances. If they fired you for reporting safety violations, that's wrongful termination and you'd definitely qualify.

Getting through to Washington ESD by phone is nearly impossible right now. I've been trying to call for weeks about my own claim issues. If you need to speak with someone urgently, I recently discovered Claimyr.com - they have this system that calls Washington ESD for you and gets you through to an actual agent. There's a video demo at https://youtu.be/7DieNd3C7zQ that shows how it works.

That sounds too good to be true. How does it actually work?

They basically handle all the calling and waiting for you. You give them your info and they call Washington ESD, wait on hold, then connect you when they get an agent on the line. Saved me hours of frustration.

Is this legitimate? I'm always skeptical of third-party services for government stuff.

DEFINITELY file right away. Even if you were fired for misconduct (which it doesn't sound like you were), you should still apply. Let Washington ESD make the determination. The worst they can do is say no, but if you don't apply you definitely won't get anything.

You're right, I have nothing to lose by applying. Going to do it today.

Smart move. And remember, even if they deny you initially, you can always appeal the decision.

The Washington ESD website has a whole section about this. Generally, you CAN get benefits if fired unless it was for gross misconduct. Things like theft, violence, or showing up drunk would disqualify you, but performance issues usually don't.

Good to know. I definitely wasn't fired for anything like theft or violence, just supposedly not doing my job well enough.

Performance-based terminations are tricky because employers sometimes try to frame them as misconduct. Make sure you have your side of the story ready.

ugh this system is so confusing!!! why cant they just make it simple - if you lose your job through no fault of your own you should get benefits period

Amina Toure

•

I feel you on the confusion, but there has to be some standards or everyone who gets fired would claim it wasn't their fault.

•

i guess but still seems like they make it way harder than it needs to be

When you file your claim, you'll need to explain the circumstances of your termination. Be honest but don't badmouth your employer. Stick to the facts about what happened and let Washington ESD investigate.

Should I get documentation of the safety complaint I made? I think I have an email about it.

0 coins

Yes, keep any documentation you have. If this goes to an appeal hearing, that email could be very important evidence.

I got fired from my job last year for 'attitude problems' (aka standing up to a toxic manager) and I got approved for unemployment benefits. The key is that Washington ESD looks at whether your actions were reasonable under the circumstances.

That gives me hope! Did they contact your employer during the process?

0 coins

Yes, they send a form to your employer asking for their side of the story. Then they make a decision based on both sides.

Just want to echo what others said about Claimyr - I used them when I couldn't get through to Washington ESD about my claim being stuck in adjudication. Worth checking out if you run into phone issues.

Good to know there are options if I can't get through on my own. Thanks!

Wait, so Claimyr actually works? I've been trying to call Washington ESD for two weeks straight.

Yeah it worked for me. They got me connected to an agent in like 30 minutes when I'd been trying for days on my own.

File your claim online at secure.esd.wa.gov as soon as possible. Don't wait! The sooner you file, the sooner you can start receiving benefits if approved. Even if there's an issue to resolve, the process starts immediately.

Filing today for sure. Thanks everyone for all the advice and encouragement!

Good luck! Hope it all works out for you.

Remember that you'll also need to do weekly claims and job search activities if approved. Washington ESD requires you to look for work and report your job search activities each week.

Sofia Morales

•

How many jobs do you have to apply for each week?

0 coins

It depends on your situation, but typically 3 job search activities per week. Check the WorkSourceWA website for specific requirements.

One more thing - if Washington ESD approves your claim, your former employer can still appeal their decision. Don't be surprised if that happens, especially if they're claiming misconduct.

Sofia Morales

•

Ugh, I hope they don't make this more complicated than it needs to be.

Freya Thomsen

Most employers don't bother appealing unless it's a clear-cut case. If you were really fired for performance issues, they probably won't fight it.

•

The bottom line is that Washington state generally sides with workers unless there's clear evidence of misconduct. Your situation sounds like you have a good chance of getting approved.

0 coins

Sofia Morales

•

That's reassuring. I was really worried I wouldn't qualify since I was technically fired.

Being fired doesn't automatically disqualify you. It's all about the circumstances and whether it rises to the level of misconduct.

btw if you do need to call washington esd and cant get through, that claimyr thing people mentioned actually worked for me too. i was skeptical at first but desperate times call for desperate measures lol

Seems like a lot of people have had success with it. Good to know it's not just one person's experience.

Same here, used Claimyr when I was having issues with my weekly claim. They got me through to someone who could actually help.
