Washington ESD unemployment benefits if terminated - do you get unemployment if fired?
My manager let me go yesterday after working at this retail job for 8 months. They said it was due to 'performance issues' but I think it was really because I complained about unsafe working conditions. Can I still file for Washington ESD unemployment benefits if I was fired? I'm really worried I won't qualify and I have rent due next week. Has anyone been in this situation before?

Yes, you can still get unemployment benefits even if you were fired, but it depends on WHY you were fired. Washington ESD will look at whether it was for 'misconduct' or not. Performance issues usually don't count as misconduct unless it was willful negligence.

File your claim immediately! Even if Washington ESD initially denies your claim, you can appeal. The fact that you complained about safety issues before being fired could actually work in your favor - that might be considered retaliation which would make you eligible for benefits.

DEFINITELY file right away. Even if you were fired for misconduct (which it doesn't sound like you were), you should still apply. Let Washington ESD make the determination. The worst they can do is say no, but if you don't apply you definitely won't get anything.

The Washington ESD website has a whole section about this. Generally, you CAN get benefits if fired unless it was for gross misconduct. Things like theft, violence, or showing up drunk would disqualify you, but performance issues usually don't.
