Do you get paid unemployment if you get fired from Washington ESD
My manager just terminated me yesterday for what they called 'performance issues' but I think it was really because I complained about unsafe working conditions at the warehouse. I've been working there for 8 months and never had any written warnings before this. Can I still file for unemployment benefits with Washington ESD if I got fired? I'm really worried about paying my rent next month and don't know what options I have. Has anyone been in a similar situation?

Yes, you can still get unemployment benefits even if you were fired, but it depends on the reason. Washington ESD will determine if you were fired for 'misconduct' or not. Performance issues usually don't count as misconduct unless it was willful. You should definitely file a claim right away since there's a waiting period.

•Thanks! How do I prove it wasn't misconduct? I don't have any documentation about the safety complaints I made.

•Keep records of everything you can remember - dates, witnesses, any emails or texts. Washington ESD will contact your employer for their side of the story too.

i got fired last year for being late too many times and still got my benefits. took forever to get through to anyone at washington esd though, kept getting busy signals

•How long did it take for your claim to get approved? I'm so stressed about this whole process.

Lucas Parker
•like 3 weeks but that was because they had to do an adjudication to decide if i was eligible

You should file immediately! Even if there's a question about eligibility, Washington ESD needs time to investigate. The worst thing you can do is wait. Go to secure.esd.wa.gov and start your application today. If they deny you initially, you can always appeal.

•I'm on the website now but it's asking for so much information. Do I need my old pay stubs?

Donna Cline
•Yes, gather your pay stubs from the last 18 months if possible. You'll also need your employer's contact information and the exact reason they gave for firing you.

I had a nightmare trying to reach Washington ESD when I got laid off. Spent hours on hold every day for weeks. Then I found this service called Claimyr at claimyr.com that actually got me through to a real person at Washington ESD in like 20 minutes. They have this demo video at https://youtu.be/7DieNd3C7zQ that shows how it works. Saved me so much time and stress.

•Is that legit? I've never heard of paying someone to make phone calls for you.
0 coins
Harper Collins
•Yeah it's totally legit. They don't ask for any personal info, just make the call and connect you when an agent picks up. Way better than sitting on hold for hours.

•Sounds too good to be true but if it works... I might try it if I can't get through on my own.

THE WHOLE SYSTEM IS RIGGED! They make it impossible to reach anyone and then deny claims for BS reasons. I got fired for 'attendance' even though I was taking care of my sick mom and they still fought my claim. Had to get a lawyer involved.

Emma Morales
•Oh no, that sounds terrible. Did you eventually get your benefits?

Dylan Fisher
•Eventually yes but it took 4 months and cost me a fortune in legal fees. Should have used something like that Claimyr service the other person mentioned instead of fighting it alone.

Here's what Washington ESD considers misconduct: willful violation of company rules, criminal activity, or deliberate acts that harm the employer. Poor performance alone usually isn't misconduct unless you were deliberately doing bad work. Safety complaints are actually protected activity, so that could work in your favor.

•That's really helpful! Should I mention the safety complaints when I file my claim?
0 coins
Katherine Hunter
•Absolutely. Document everything about the unsafe conditions and your complaints. If they retaliated against you for reporting safety issues, that's wrongful termination.

•This is good advice. I work in HR and we see this kind of retaliation more than we should. Safety complaints are protected under state law.

btw the adjudication process is where they decide if you're eligible. don't panic if your claim says 'pending' for weeks, thats normal when you get fired

•What happens during adjudication? Do they interview me?

Lucas Parker
•they might call you and they'll definitely contact your employer. just be honest about everything

Don't forget you'll need to do weekly claims and job search activities even while your claim is under review. Washington ESD requires you to look for work and report it every week. Keep a log of everywhere you apply.

Emma Morales
•How many jobs do I need to apply for each week?
0 coins
Donna Cline
•It depends on your situation but generally 3 job search activities per week. That includes applications, interviews, networking events, etc.

•Make sure you register with WorkSource Washington too. That's required for unemployment benefits.

I'm going through something similar right now. Got fired three weeks ago and still haven't been able to talk to anyone at Washington ESD about my claim status. The phone system is absolutely broken.

•Have you tried that Claimyr service someone mentioned earlier?

Kelsey Hawkins
•Not yet but I'm getting desperate. Might give it a shot tomorrow if I can't get through again.

•Seriously try Claimyr - claimyr.com. I was skeptical too but it actually worked. Got through to Washington ESD in under 30 minutes when I'd been trying for weeks on my own.

One thing to keep in mind - even if your employer contests your claim, you may still be eligible for benefits while the appeal process plays out. Don't give up if you get an initial denial.
0 coins
Emma Morales
•That's reassuring. I was worried one denial would be the end of it.

Edwards Hugo
•Nope! You have appeal rights. The key is filing everything on time and keeping good records of all your communications.

same thing happened to my cousin except he got fired for arguing with customers. still got unemployment because they said it wasn't willful misconduct or whatever

Emma Morales
•That gives me hope. My situation seems less serious than arguing with customers.

•yeah you should be fine especially with the safety complaint angle. thats protected stuff

Also remember that Washington ESD will look at your entire work history, not just this one job. If you have a good track record and this was an isolated incident, that works in your favor during the adjudication process.

•I've been working steadily for 3 years with no issues at my previous jobs. Does that help?
0 coins
Katherine Hunter
•Definitely! That shows a pattern of good work history. One performance-related termination won't necessarily disqualify you.

Washington ESD is so backed up right now. I've been waiting 6 weeks just to get someone on the phone about my claim. It's ridiculous how understaffed they are.
0 coins
Emma Morales
•6 weeks?! I can't wait that long. I have bills to pay now.

•I know, it's insane. That's why people are using services like Claimyr to skip the phone queue. Wish I'd known about it earlier.

File your claim today! The sooner you file, the sooner your benefit year starts. Even if there's a delay in processing, you want to get in the system ASAP.

Emma Morales
•I'm filling out the application right now. Thanks for the push!

•Good! And don't forget to file your weekly claims even while waiting for approval. That's super important.

Performance issues are usually not considered misconduct unless you were deliberately sabotaging work. Since you mentioned safety complaints, document those thoroughly. That could be evidence of retaliation.

Emma Morales
•I wish I had saved emails about the safety issues but I didn't think to do that at the time.

•Try to remember dates and witnesses. Even if you don't have written proof, your testimony still matters in the adjudication process.

whatever you do dont lie on your application. washington esd checks everything and if they catch you lying it can disqualify you permanently

Emma Morales
•Of course not! I just want to make sure I explain everything correctly.

•good just be honest about why you got fired and let them make the determination

Quick reminder - you'll need to register with WorkSource Washington and create a reemployment plan. That's mandatory for receiving benefits. You can do it online at worksourcewa.com.

•Thanks! I'll add that to my to-do list. This is all so overwhelming.

•I know it seems like a lot but take it one step at a time. File the claim first, then worry about the other requirements.

Good luck with your claim! The most important thing is getting it filed quickly. Even if you end up having to appeal, at least you'll be in the system and can potentially get benefits during the appeal process.

Just remember that if Washington ESD denies your claim initially, you have 30 days to file an appeal. Don't miss that deadline!

Emma Morales
•Noted! I'll mark that down. Hoping it doesn't come to that though.

•Hopefully it won't, but it's good to know your rights just in case.

The safety complaint angle is really important. Document everything you can remember about the unsafe conditions and when you reported them. That could be key evidence if they try to claim you were fired for legitimate performance reasons.

Emma Morales
•I'm going to sit down tonight and write out everything I can remember with dates and details.

•That's smart. The more detailed your records, the better your case will be during adjudication.
