If my employer fired can I get Washington ESD unemployment benefits?
My boss terminated me yesterday after working there for almost 2 years. It wasn't anything really bad, just said I wasn't meeting expectations but I tried my best. Can I still file for unemployment with Washington ESD if I got fired? I heard you can't get benefits if you're terminated but my friend said that's not always true. Really stressed about paying rent next month and need to know if I should even bother applying or if they'll just deny me automatically.

Yes, you can absolutely get unemployment benefits even if you were fired! The key is whether you were terminated for 'misconduct' or not. If your employer fired you for poor performance or not meeting expectations, that's usually NOT considered misconduct under Washington ESD rules. Misconduct is more like theft, harassment, or willful violation of company policy.

•That's such a relief to hear. They never said I did anything wrong ethically, just that my numbers weren't where they wanted them. I was really trying but it was a tough job.

•Exactly right - poor performance ≠ misconduct. File your claim ASAP because there's a waiting week and you want to get the process started.

File immediately! I got fired from my last job for 'performance issues' too and Washington ESD approved my claim. The employer might contest it but that doesn't mean you won't win. Just be honest about what happened when you file.

•Did your employer fight it? I'm worried they're going to say bad things about me to Washington ESD.

•They did contest it but I had documentation showing I was trying to improve. Washington ESD sided with me after reviewing everything.

I've been trying to reach Washington ESD for weeks about my claim status and it's impossible! Their phone lines are always busy and I keep getting disconnected. Has anyone found a way to actually talk to someone there?

•I found this service called Claimyr that helped me get through to Washington ESD when I couldn't reach them myself. They have a website at claimyr.com and there's a demo video at https://youtu.be/7DieNd3C7zQ showing how it works. Saved me hours of calling.

•Is that legit? I'm desperate at this point but don't want to get scammed.

•It's totally legitimate - they just help you get connected when Washington ESD phone lines are busy. Super helpful when you need to check on adjudication status or get claim issues resolved.

The system is so broken. I got fired for 'attitude problems' which is such BS and Washington ESD denied me. Now I'm appealing but who knows how long that will take.

•Attitude problems can sometimes be considered misconduct depending on the specifics. Did you have any written warnings or documentation about your behavior?

Douglas Foster
•Nothing written, just verbal complaints from my supervisor who didn't like me. That's why I'm appealing - it's not fair.

When you file your claim, be completely honest about the reason for termination. Don't try to sugarcoat it or lie because Washington ESD will contact your employer anyway. If it was truly performance-related and not misconduct, you should be approved.

•Should I mention that I was having some personal issues that might have affected my work? Or keep it simple?

Maya Diaz
•Keep it factual and simple. Focus on what your employer told you was the reason for termination, not personal circumstances that might have contributed.

•Good to know! I definitely didn't do anything like that, just struggled with the workload.

Here's what Washington ESD considers misconduct: deliberate violation of company rules, criminal activity, harassment, theft, or willful disregard of employer interests. Poor performance, inability to do the job, or personality conflicts usually don't qualify as misconduct.

•What about if you're late a lot? I got fired for tardiness and not sure if that counts as misconduct.

•Chronic tardiness can be considered misconduct if you were warned and continued the behavior. It depends on the circumstances and whether you had control over the situation.

If Washington ESD puts your claim into adjudication (which they might since you were terminated), that's when you really need to speak with someone to explain your situation. That's exactly when services like Claimyr become super valuable for getting through their busy phone lines.

•What's adjudication? Should I be worried about that?

•Adjudication just means they're reviewing your case to determine eligibility. It's normal for termination cases but can take several weeks without intervention.

I'm going through the same thing right now. Got let go three weeks ago for 'not being a good fit' and filed immediately. Still waiting to hear back from Washington ESD but keeping my fingers crossed.

Pro tip: Start looking for work immediately even while your claim is processing. Washington ESD requires you to do job searches anyway and it shows good faith if your employer contests the claim.

•How many job applications do I need to do per week? I want to make sure I follow all the rules.

•You need to do at least 3 job search activities per week and keep a log of them. Check the WorkSourceWA website for approved activities.

Whatever you do, don't quit your next job without having another one lined up. Getting unemployment after quitting is way harder than getting it after being fired for performance.

•Definitely learned that lesson. I should have started looking for another job before this happened but I kept hoping things would improve.

File your claim online at esd.wa.gov as soon as possible. Don't wait because your benefit year starts from when you file, not when you were terminated. The sooner you apply, the sooner you can start receiving benefits if approved.

The worst part is waiting to find out if you're approved. My claim was in adjudication for over a month before I finally got through to someone at Washington ESD who could explain what was happening.

•How did you finally reach them? I'm still struggling to get anyone on the phone.

•I ended up using that Claimyr service someone mentioned earlier. Worth every penny to skip the phone tree nightmare and actually talk to a real person who could help.

Make sure you have all your employment information ready when you file - dates of employment, wage information, reason for separation. The more accurate your initial application, the less likely it is to get held up in adjudication.

•I have all my pay stubs and my termination letter. Should I upload those somewhere or just wait for them to ask?

•Keep them handy but Washington ESD will usually contact your employer directly for verification. Only upload documents if they specifically request them.

Been through this exact situation. Got fired for 'performance' after 18 months on the job. Washington ESD approved my claim within two weeks. Your employer might contest it but don't let that scare you - just be prepared to explain your side if needed.

•That gives me hope. Did you have to do anything special or just wait it out?

•Just answered their questions honestly and provided any documentation they requested. The key is showing you weren't fired for misconduct.

Remember that even if your employer contests your claim, you can still receive benefits while the appeal is being decided. Don't assume you're out of luck just because they fight it.

Yara Campbell
•Really? I thought if they contested it I'd have to wait until everything was resolved.

•Nope! You keep getting benefits during the appeal process unless Washington ESD specifically stops them. Just make sure to keep filing your weekly claims.

Good luck with your claim! Most people in your situation do end up getting approved. The unemployment system isn't perfect but it does generally work for people who legitimately lost their jobs through no fault of their own.

I went through something very similar last year - got terminated for "not meeting performance standards" after 18 months at my job. I was really worried about applying because I thought getting fired meant automatic denial, but that's not true at all. Washington ESD approved my claim because performance issues aren't the same as misconduct. The key distinction is whether you were fired for something you did wrong intentionally (like breaking rules, theft, etc.) versus just not being able to meet their expectations despite trying your best. From what you've described, it sounds like you have a good chance of getting approved. File your claim online at esd.wa.gov as soon as possible - don't wait because the sooner you file, the sooner your benefit year starts. Be completely honest about the reason for termination when you fill out the application. Good luck!
