Can you claim unemployment if you get fired in Washington ESD?
My manager fired me last week after I was late a few times due to my car breaking down. I explained the situation but they said it was still job abandonment or misconduct or something. I've never filed for unemployment before and I'm really confused about whether I can even apply since I got fired instead of laid off. Does Washington ESD allow claims when you're terminated? I really need the income while I look for another job.

Yes, you can absolutely file for unemployment even if you were fired, but it depends on the reason. Washington ESD will investigate whether your termination was due to misconduct. Being late due to car trouble doesn't sound like willful misconduct - that's more like circumstances beyond your control.

•That's a relief! I was worried I couldn't get anything since they fired me. Should I mention the car problems when I file?

•Definitely mention it. Document everything - repair receipts, mechanic visits, anything that shows it was a legitimate transportation issue.

The key thing Washington ESD looks at is whether you were fired for misconduct connected with your work. Simple tardiness due to transportation issues usually doesn't qualify as misconduct. You should file your claim immediately and let them make the determination during adjudication.

•What exactly counts as misconduct? My friend got fired for being on her phone too much and couldn't get benefits.

•Misconduct has to be willful disregard of employer interests or deliberate violation of rules. Phone usage during work time could definitely qualify as misconduct.

I was in a similar situation last year - got terminated for attendance issues but it was due to medical appointments I couldn't reschedule. I used Claimyr to get through to Washington ESD when my claim went into adjudication. The service helped me reach an actual agent who could explain my case status instead of just waiting weeks for a decision. Check out claimyr.com - they have a video demo at https://youtu.be/7DieNd3C7zQ that shows how it works.

•How long did your adjudication take? I'm worried this is going to drag on forever.

•It took about 3 weeks once I was able to talk to someone. Before using Claimyr I spent days trying to get through on the phone with no luck.

File anyway!!! The worst they can say is no but at least you'll know for sure. I got fired from my last job for stupid reasons and still got approved.

•What were you fired for if you don't mind me asking? Trying to figure out what my chances are...

Make sure when you file that you're honest about the reason for termination. Washington ESD will contact your employer anyway, so any discrepancies will hurt your case. But based on what you described, you have a good chance of approval.

•Should I file online or over the phone? I've heard the website is easier but I'm not sure.

•Online is definitely easier and faster. Go to esd.wa.gov and follow the initial claim filing process.

washington esd is so backed up right now, expect delays even if you qualify. took them 6 weeks to process my partners claim when she got laid off

•6 weeks?? That's crazy. Did she eventually get backpay for those weeks?

•yeah she got all the back payments once it went through

Important note: if your employer contests your claim, be prepared for a phone interview or hearing. Keep all documentation about your car problems, work schedule, and any communication with your employer about the attendance issues.

•What happens in a phone interview? I'm nervous about having to defend myself.

•They'll ask you to explain your side of the story. Just be honest and stick to the facts. Having documentation really helps your credibility.

I hate how they make you feel guilty for needing help when you lose your job through no fault of your own. Like getting fired automatically makes you a bad person or something.

•Right? The system acts like everyone who gets fired deserved it. Sometimes bosses are just unreasonable.

•Exactly how I'm feeling right now. Thanks for saying that.

Another tip - if you do get approved, make sure you understand the job search requirements. Washington ESD requires you to log at least 3 job search activities per week and keep records in WorkSourceWA.

•What counts as job search activities? Just applying for jobs?

Mateo Rodriguez
•Applying, networking events, career fairs, informational interviews - there's a list on the Washington ESD website.

My advice is don't wait - file immediately. Even if there's adjudication, your claim date starts from when you first file, not when it gets approved. Every day you wait is money you might not get back.

•Good point, I'll file today. Thanks for the push!

•This is absolutely correct. The waiting week starts from your claim date, not approval date.

Just want to add that if your claim gets denied initially, you can appeal. Don't give up if the first decision doesn't go your way - the appeals process exists for a reason.

Zara Ahmed
•How long do you have to file an appeal?

Emily Jackson
•30 days from the date of the determination letter. Don't miss that deadline!

Transportation issues are usually considered non-misconduct, especially if you were trying to resolve them. I had a friend who got approved after being fired for attendance due to childcare problems.

•That's encouraging. I think a lot of people don't realize that not all firings disqualify you from benefits.

•Yeah I definitely thought getting fired meant no unemployment. Glad I asked here first.

Pro tip: if you end up needing to talk to Washington ESD during adjudication and can't get through, there's a service called Claimyr that helps you reach actual agents. I discovered it when I was stuck waiting for weeks with no updates on my claim status. Really saved me a lot of stress trying to get answers.

Zara Ahmed
•Is that the same service someone mentioned earlier? Might need that if this gets complicated.

Jacob Smithson
•Yeah, same one. Super helpful when you need to actually talk to someone instead of waiting around wondering what's happening.

make sure to file your weekly claims even during adjudication otherwise you'll lose those weeks even if you get approved later
0 coins
Zara Ahmed
•Wait really? I thought you couldn't file weekly claims until approved?
0 coins
Luca Esposito
•No, you definitely need to keep filing weekly claims. The system will hold the payments until adjudication is complete.

The whole misconduct thing is so subjective. I know people who got fired for way worse stuff and still got benefits, while others got denied for minor things. Really depends on how your case gets reviewed.

Aiden Rodríguez
•That's so frustrating. There should be clearer guidelines about what qualifies.

Maya Patel
•Agreed. The inconsistency makes the whole process more stressful than it needs to be.

OP, based on what you described, I think you have a solid case. Car problems causing tardiness isn't willful misconduct. Just make sure you have documentation and file ASAP.

One more thing - if your employer fights the claim and you end up in a hearing, don't go in unprepared. Organize all your evidence beforehand and be ready to explain your situation clearly.
0 coins
Zara Ahmed
•Hopefully it won't come to that, but I'll keep that in mind just in case.

Ethan Anderson
•Better to be prepared and not need it than the other way around!

The fact that you were trying to explain the situation and it was due to circumstances beyond your control should work in your favor. Washington ESD generally looks favorably on that kind of case.
0 coins
Zara Ahmed
•That makes me feel better. I was worried they'd automatically side with the employer.
0 coins
Layla Mendes
•They're supposed to be neutral and look at all the facts. Don't assume they'll automatically deny it.

Just remember that even if there's a delay in processing, you'll get backpay for all eligible weeks once approved. So don't stress too much about the timing as long as you file promptly.

Zara Ahmed
•That's really good to know. I was worried about missing out on weeks of benefits.

Aria Park
•Yep, as long as you keep filing those weekly claims during adjudication, you won't lose anything.

Last thought - if you do get approved and this was your first job loss, make sure you understand all the requirements. Missing job search activities or weekly claim deadlines can cause problems later.

Zara Ahmed
•I'll definitely read through everything carefully. Don't want to mess this up!

•Smart approach. The rules seem complicated at first but you'll get the hang of it.
