Washington ESD unemployment claim between accepting job offer and start date - is this allowed?

I just accepted a job offer yesterday but my start date isn't until January 15th (3 weeks away). I'm currently on unemployment benefits through Washington ESD. Can I keep filing my weekly claims during this gap period? I'm worried about reporting that I accepted a job but haven't started yet. Don't want to mess up my benefits or get in trouble for overpayment later. Has anyone dealt with this situation before?

Yes, you can continue claiming as long as you're still available for work and meet all the other requirements. The key is being honest on your weekly claim about your job search activities and availability. You'll need to report the job acceptance when you file your claim.

Thanks! Should I report it in the 'did you start work' section or somewhere else on the weekly claim form?

0 coins

Report it in the job search section as an offer accepted. Don't mark 'yes' for starting work until your actual first day.

0 coins

I had this exact situation last year. Washington ESD told me I could keep claiming until my start date as long as I was still available for other work if this job fell through. Just be completely honest about everything on your weekly claims.

0 coins

That's reassuring! Did you have any issues with Washington ESD questioning the gap period later?

0 coins

Nope, no problems at all. They just wanted to make sure I was being truthful about my availability and the job start date.

0 coins

Wait, this is confusing me. I thought once you accept a job offer you're no longer 'available for work' which is one of the requirements for UI benefits? I've been scared to even apply for jobs because of this.

0 coins

You're still available for work until you actually start. Accepting an offer doesn't mean you're working yet - things can change, offers can be withdrawn, etc.

0 coins

This is exactly why I used Claimyr to get through to an actual Washington ESD representative when I had this question. So much confusion online about what's allowed. The agent confirmed you can claim during the gap period. Check out claimyr.com - they have a video demo at https://youtu.be/7DieNd3C7zQ that shows how it works.

0 coins

Never heard of Claimyr before but getting through to Washington ESD is such a nightmare. Might have to try this.

0 coins

The Washington ESD handbook is pretty clear on this. You remain eligible for benefits until you actually begin work. The gap period between accepting an offer and starting is still considered unemployed status. Just document everything in case they ask questions later.

0 coins

Good point about documentation. I'll save my offer letter and any emails about the start date just in case.

0 coins

YES document everything! I learned this the hard way when Washington ESD asked for proof of my start date during an audit. Had to scramble to find emails from my employer.

0 coins

Be VERY careful about this. I've seen people get hit with overpayment notices for claiming during job offer gaps. Washington ESD can be really strict about availability requirements. Maybe stop claiming just to be safe?

0 coins

That's not accurate. As long as you're honest about your situation and meet the availability requirements, you're fine to claim during the gap.

0 coins

I'm just saying be careful. The rules can be interpreted different ways and it's better to be safe than sorry with overpayments.

0 coins

I actually had to appeal an overpayment notice related to this exact situation. Won the appeal but it was stressful. The hearing officer said as long as you're truthful on your claims, you're good.

Three weeks is a long gap! Are you sure you can't start sooner? Most employers are flexible about start dates, especially if it means you can get off unemployment faster.

0 coins

The start date is firm because they need to complete some facility renovations first. I asked about starting earlier but they said January 15th is the earliest possible.

0 coins

Ah that makes sense. Well at least you have income coming in during the gap then!

0 coins

I'm dealing with something similar but my gap is only one week. Still planning to file that weekly claim though. Every little bit helps with bills!

0 coins

Exactly! Three weeks of benefits will definitely help cover expenses before my first paycheck.

0 coins

Make sure you're still doing your job search activities during the gap period. Washington ESD requires 3 job search contacts per week even if you've already accepted an offer.

0 coins

Wait really? I thought once you accept an offer you don't need to keep job searching?

0 coins

This whole system is so confusing. I spent 45 minutes on hold with Washington ESD yesterday trying to ask about a different issue and got hung up on. How are we supposed to get accurate information about these situations?

0 coins

That's exactly why I started using Claimyr! No more waiting on hold for hours. They call Washington ESD for you and connect you when an agent is available. Saved me so much time and frustration.

0 coins

How much does something like that cost? I'm on unemployment so money is tight.

0 coins

It's worth checking out their website at claimyr.com - they explain everything there. Much cheaper than losing benefits because you couldn't get through to ask questions.

0 coins

I think you're overthinking this. Just file your weekly claims honestly and you'll be fine. Washington ESD deals with this situation all the time.

0 coins

You're probably right. I tend to worry too much about these things. Thanks for the reassurance!

0 coins

Better to ask questions than assume though. Unemployment rules can be tricky and overpayments are no joke.

0 coins

Congratulations on the job offer! That's the whole point of unemployment benefits - to bridge the gap until you find work. Keep claiming until your first day and you'll be fine.

0 coins

Thank you! I'm excited to start working again. The job search process was longer than expected but finally paid off.

0 coins

How long were you on unemployment if you don't mind me asking? I'm at month 4 of searching and getting discouraged.

0 coins

I was on for about 5 months total. It was tough but don't give up! The right opportunity will come along.

0 coins

Make sure you understand what happens to your claim after you start work. You'll need to report your first day of work on your next weekly claim and that will end your benefit year.

0 coins

Good point. I assume I just mark 'yes' for starting work on my January 19th weekly claim (covering the week I start)?

0 coins

Exactly. That claim will probably be your last one for this benefit year unless you become unemployed again.

0 coins

I'm in HR and we see this question a lot. From the employer side, we don't report anything to Washington ESD until someone actually starts work and we begin paying them. So your benefits shouldn't be affected by just accepting the offer.

0 coins

That's really helpful to know from the employer perspective! Makes me feel more confident about continuing to claim.

0 coins

That's interesting. I always wondered what employers report to Washington ESD and when they report it.

0 coins

We report new hires within 20 days of their start date, not when they accept offers. Big difference!

0 coins

Does anyone know if there are any restrictions on what types of jobs you can accept while claiming? Like does it have to be full-time or in your field?

0 coins

No restrictions on job type as long as you're actively seeking work. Part-time work just means reduced benefits, not loss of eligibility.

0 coins

I was worried about this too but Washington ESD told me any legitimate job offer is fine. They just want people to get back to work.

0 coins

Three weeks seems like a long time but it's pretty normal in some industries. My friend in healthcare had a 6-week gap between accepting an offer and starting due to background checks and credentialing.

0 coins

Wow, 6 weeks! That would definitely make me nervous about benefits. Good to know longer gaps aren't unheard of.

0 coins

Government jobs can have even longer gaps. I had a 2-month wait for security clearance processing. Washington ESD was fine with it as long as I kept filing honestly.

0 coins

Just want to add that if your job offer gets rescinded for any reason during the gap period, you can continue claiming without any issues. That's another reason Washington ESD allows claiming during offer gaps.

0 coins

Hopefully that won't happen but good to know I'd be covered if it did. This job seems solid though.

0 coins

I had an offer rescinded 2 days before my start date last year. Was so grateful I had kept claiming during the gap period. Saved me from a benefits lapse.

0 coins

Oh no, that must have been devastating! I'm sorry that happened to you.

0 coins

When I had questions like this, I used Claimyr to get through to Washington ESD quickly. The representative confirmed that gap periods are totally normal and allowed. Much better than trying to guess based on online forums!

0 coins

How does Claimyr work exactly? I've seen it mentioned a few times in this thread.

0 coins

They basically call Washington ESD for you and wait on hold, then connect you when an agent is available. Saves hours of waiting. There's a demo video at https://youtu.be/7DieNd3C7zQ that explains it better than I can.

0 coins

That actually sounds really useful. I'll check it out.

0 coins

Thanks for asking this question! I'm in a similar situation with a start date in February and was wondering the same thing. This thread has been really helpful.

0 coins

Glad it helped! I feel much better about the situation after reading everyone's responses.

0 coins

Same here. I was scared to even accept job offers because I thought it would mess up my benefits immediately.

0 coins

One more thing to consider - make sure your new employer knows you're currently on unemployment. Some companies want to coordinate start dates to help employees transition smoothly off benefits.

0 coins

I did mention it during the interview process and they were understanding about the situation. They actually said the 3-week gap was good for both of us to prepare.

0 coins

That's a good employer! Shows they care about their employees' financial well-being during the transition.

0 coins

I went through this exact same situation a few months ago with Washington ESD. You're absolutely fine to continue claiming during the gap period - just be completely transparent on your weekly claims about accepting the offer and your availability status. I documented everything (offer letter, start date confirmation emails) and had zero issues. The key thing Washington ESD cares about is honesty, not penalizing people for normal employment transitions. Congrats on the job offer and don't stress about it!

0 coins

This is so reassuring to hear from someone who actually went through it! I was getting a bit anxious reading some of the conflicting advice in this thread. The documentation tip is really smart - I'll make sure to keep copies of everything. Thanks for sharing your experience and the congratulations!

0 coins

Thanks for sharing your experience! It's really helpful to hear from someone who actually went through this process recently. I'm definitely going to follow your advice about documenting everything - better to be over-prepared than caught off guard later. Did Washington ESD ask you any specific questions about the gap period during your claims, or was it pretty straightforward as long as you were honest about everything?
