Washington ESD unemployment benefits with nursing license suspended - am I eligible?
My nursing license got suspended last month due to some documentation issues at my previous job (nothing criminal, just paperwork problems). I've been working as an RN for 8 years and this is my first issue ever. I applied for unemployment through Washington ESD but I'm worried they'll deny my claim because of the license suspension. Has anyone been through this situation? Can you still get UI benefits if your professional license is suspended? I'm really stressed about this because I have rent and bills to pay while I work on getting my license reinstated.

License suspension doesn't automatically disqualify you from unemployment benefits in Washington. The key question is whether you were discharged for misconduct or if you're able and available for work. If the suspension was for paperwork issues and not willful misconduct, you should still be eligible.

•That's reassuring, thank you. The suspension was definitely not for misconduct - just some missing documentation that should have been filed. I can still work in other capacities while my license is under review.

•Yeah but don't they ask about your availability for work? If you can't practice nursing without the license, how are you available?

You need to be very careful about how you answer the weekly claim questions about being able and available for work. You can look for non-licensed positions or work in other fields while your nursing license is suspended. The Washington ESD wants to know you're actively seeking employment you're qualified to perform.

•Good point about the weekly claims. I've been applying for medical assistant positions and some administrative roles at clinics since I don't need an RN license for those.

•Smart approach! That shows you're genuinely available for work even without the nursing license.

I had a similar situation with a different professional license. Washington ESD approved my claim but it took forever to get through adjudication. Couldn't reach anyone at Washington ESD for weeks to check on the status. Finally used this service called Claimyr (claimyr.com) that helped me get through to an actual agent. They have a video demo at https://youtu.be/7DieNd3C7zQ showing how it works.

•How long did your adjudication take? Mine's been pending for 2 weeks now and I'm getting worried.

•Took about 6 weeks total, but once I could actually talk to someone at Washington ESD they resolved it quickly. The Claimyr thing was worth it just to avoid sitting on hold for hours.

•Never heard of Claimyr before but anything that helps get through to Washington ESD sounds useful. Their phone system is terrible.

UGH the Washington ESD system is so frustrating!! I've been trying to call them for WEEKS about my claim and either get hung up on or sit on hold forever. Why can't they just have enough staff to answer the phones???

•I know it's frustrating but keep trying. The best times to call are usually right when they open at 8am.

•I've tried calling at 8am and still can't get through. It's like they only have 2 people working the phones for the entire state.

For what it's worth, I know someone who got unemployment while their teaching license was suspended. The Washington ESD seemed more concerned about whether they were fired for misconduct versus the license issue itself.

•That's encouraging! In my case I wasn't fired - I actually resigned when I found out about the license issue because I wanted to focus on getting it resolved.

•Resigning can sometimes complicate unemployment eligibility. You'll need to show you had good cause for leaving related to the license suspension.

wait so you QUIT your job? that might be a problem for getting unemployment benefits. i thought you had to be laid off or fired without cause to get UI
0 coins
Ayla Kumar
•Not necessarily. Washington allows unemployment benefits for people who quit with good cause. A license suspension that prevents you from doing your job could qualify as good cause.

•Yeah I made sure to document everything about why I had to resign. I couldn't continue working as an RN without a valid license.

Been through something similar - had my CPA license suspended for continuing education issues (forgot to complete some credits). Washington ESD approved my unemployment but it went to adjudication because I quit rather than being fired. Took about a month to resolve.

•A month isn't too bad, mine's at 2 weeks so hopefully not much longer. Did they require any special documentation about your license issue?

Dananyl Lear
•They asked for the suspension notice and a letter explaining why I had to quit. Keep all your paperwork related to the license suspension.

The job search requirement might be tricky too. You'll need to show you're looking for work you can actually do without the nursing license. Keep good records of your job search activities.

•Good point. I've been keeping a spreadsheet of all the positions I've applied for, including the non-nursing ones.

•That's exactly what you should be doing. Washington ESD wants to see you're making a genuine effort to find work.

My sister is a nurse and went through this exact situation 2 years ago. Her license was suspended for 6 months but she got unemployment the whole time. The key was showing she was actively working on getting her license back AND looking for other work.

•That's really helpful to hear! I'm definitely working on the reinstatement process and have documentation showing my efforts.

•Yeah keep all those records. Washington ESD likes to see you're being proactive about fixing the situation.

I used to work in HR at a hospital and saw this come up occasionally. Usually the nurses were able to get unemployment as long as the license issue wasn't due to criminal activity or gross misconduct. Paperwork problems typically wouldn't disqualify you.

Clay blendedgen
•That's reassuring coming from someone with HR experience. It really was just documentation that should have been filed with the state board.

•Those kinds of administrative issues happen more often than people think. The nursing board is usually pretty reasonable about reinstatement if you address the paperwork properly.

Whatever you do, don't lie on your weekly claims about being available for work. Be honest about your situation but emphasize that you're looking for positions you can legally perform.

Clay blendedgen
•Absolutely. I've been completely honest on all my weekly claims about the license suspension and the types of work I'm seeking.

If you're still having trouble getting through to Washington ESD about your claim status, I second the recommendation for Claimyr. Used it last year when I couldn't reach anyone about my adjudication. Worked way better than trying to call myself.

•I might have to try that if I don't hear something soon. The waiting is the worst part of this whole process.

•Yeah the uncertainty is brutal. At least if you can talk to someone you know where you stand.

Just want to add that you should also check if your employer contests your unemployment claim. Sometimes when someone resigns due to license issues, the employer might dispute it to avoid higher unemployment insurance rates.

•Good point. My former employer seemed understanding about the situation but I'll keep an eye out for any contests.

Ayla Kumar
•If they do contest it, you'll have a chance to provide your side of the story during the adjudication process.

Been following this thread because I'm in a similar boat with a different license. Sounds like as long as you can show good cause for leaving and you're available for other work, Washington ESD should approve the claim.

•That's my understanding too based on everyone's responses. Fingers crossed we both get approved soon!

One more thing - make sure you're documenting your reinstatement efforts. Washington ESD might want to see that you're actively working to resolve the license issue and not just sitting around waiting.

•Great advice. I've been keeping copies of all my communications with the nursing board and the continuing education courses I'm taking.

UPDATE: Just got word that my claim was approved! Similar situation to yours - professional license issue, had to quit, but they determined I had good cause. Took 5 weeks total but worth the wait.

For anyone else reading this thread in the future - keep detailed records of EVERYTHING. Every phone call, every document, every job application. Washington ESD might ask for any of it during adjudication.

One last thought - if your claim does get approved but then later gets flagged for any reason, don't panic. Sometimes Washington ESD does random reviews or gets additional information. As long as you've been honest throughout the process, you should be fine.

•Thanks for that heads up. I hadn't thought about the possibility of later reviews but good to know it can happen.

•It's not super common but it does happen occasionally. Just stay consistent with your story and keep those records we talked about.
