Can you collect unemployment if you are suspended without pay from Washington ESD?
My employer suspended me without pay for two weeks pending an investigation into a workplace incident. I'm not sure if I can file for unemployment benefits during this suspension period through Washington ESD. Has anyone been in this situation before? I really need the income while this gets sorted out but don't want to mess up my claim if I'm not eligible.

Generally speaking, if you're suspended without pay, you may be eligible for unemployment benefits during that period since you're temporarily not working through no fault of your own. However, Washington ESD will want to know the circumstances of your suspension when you file your claim.

•Thanks! Should I mention the investigation when I file my weekly claim?

•Yes, always be honest about your work status. They'll ask about any work performed and wages earned each week.

I was suspended for 3 weeks last year and got benefits approved. Just had to explain what happened when I filed. Washington ESD approved it since I wasn't getting paid.

•That's reassuring to hear. Did they make you do job searches during the suspension?

•No, I didn't have to since I was still technically employed, just suspended.

Be very careful here. If the suspension is related to misconduct, Washington ESD might deny your claim entirely. The reason for suspension matters a lot in their determination.

•It's not misconduct related - more of a misunderstanding that needs investigating. Should I still be worried?

•If it's truly not misconduct, you should be fine. Just document everything in case they ask for more details.

I tried calling Washington ESD about this exact situation last month and could never get through! Their phone lines are constantly busy. If you need to talk to someone, I found this service called Claimyr at claimyr.com that helped me get through to an actual agent. They have a video demo at https://youtu.be/7DieNd3C7zQ showing how it works.

•Really? How does that work exactly?

•They basically handle the calling for you and get you connected to a real person at Washington ESD. Saved me hours of trying to get through myself.

•Good to know, thanks!

One thing to keep in mind - if you get called back to work during your suspension period, you'll need to report that change immediately to Washington ESD. Don't continue filing if you're back on payroll.

•Makes sense. I'll definitely update them if the situation changes.

•This is important - I know someone who got an overpayment notice because they didn't report returning to work quickly enough.

The Washington ESD adjudication process for suspended workers can take a while. They have to verify with your employer about the circumstances. Don't panic if your claim shows 'adjudication in progress' for a few weeks.

•How long did yours take to get approved?

•About 3 weeks total. They contacted my employer to confirm the suspension details before approving benefits.

Whatever you do, don't lie about anything on your application. Washington ESD will find out eventually and it's not worth the trouble.

•Definitely planning to be completely honest about everything.

Make sure you understand the difference between suspension and termination too. If they end up firing you after the investigation, that's a whole different situation for unemployment eligibility.

•Right now it's just a suspension, but I'm worried it could turn into termination.

•Cross that bridge if you come to it. For now, focus on the suspension benefits.

If you do need to speak with Washington ESD directly about your specific situation, I really recommend trying Claimyr. I was skeptical at first but it actually worked and saved me so much time and frustration.

•Is that service free?

•There's a cost but honestly it was worth it to actually talk to someone instead of getting hung up on repeatedly.

I'm going through something similar right now. Filed my claim yesterday and just waiting to hear back. The uncertainty is killing me!

Document everything related to your suspension - emails, written notices, dates, etc. Washington ESD might ask for this information during their review process.

•Good point, I'll start gathering all the paperwork now.

Also remember that even if approved, there might be a waiting week before benefits start. Plan your finances accordingly.

•Is the waiting week always required?

Yara Nassar
•Not always, but it's common for first-time claimants or if there's been a gap since your last claim.

The whole system is so confusing. I wish Washington ESD would make this stuff clearer on their website.

•Their website has improved but yeah, individual situations can be complicated.

My advice is file sooner rather than later. Even if there are questions about eligibility, getting the process started is important.

•That makes sense. I'll start the application today.

One more thing - if your suspension gets extended beyond the original timeframe, make sure to update Washington ESD about the change in your expected return date.

•Will do. Hopefully it doesn't come to that though.

good luck with everything! suspended without pay situations are usually pretty straightforward for unemployment if you're honest about it

Just wanted to mention Claimyr one more time since phone support seems to be a common issue. Their service really helped me get answers when I needed them most. The video demo explains it better than I can - https://youtu.be/7DieNd3C7zQ

Bottom line: suspension without pay usually qualifies for benefits as long as it's not for misconduct. File your claim and let Washington ESD make the determination.

I went through this exact same situation about 6 months ago with Washington ESD. Was suspended for 10 days pending investigation and filed for unemployment benefits. The key thing is to be completely transparent about your employment status when you file. They'll ask if you worked and earned wages - answer honestly that you were suspended without pay. My claim was approved within about 2 weeks once they verified the details with my employer. The investigation outcome didn't affect my eligibility since I wasn't being paid during the suspension period. Just make sure you're ready to provide documentation if they request it.

•That's really helpful to know! The 2-week approval timeline gives me hope. Did you have to do anything special during the investigation period or just wait for it to resolve?
